The factual basis for this seizure is as follows: On or about December 10, 2004, investigators from the Warner Robins Police De partment executed a search warrant at Bobby's Food Mart, 2129 Elberta Road., Warner Robins, Houston County, GA, in reference to illegal gambling at that location, i.e. cash payout on December 2, 2004. Offi cers seized the above-described cash and property at that business which is owned and operated by Bharat Patel. The gaming machines listed above are "gambling devices" as that term is defined in O.C.G.A. 16-12-20(2)(B),(C), and (D). The lo cation is a "gambling place” as de fined in O.C.G.A. 16-12-20(3) in that one of the principal uses of which is the playing of gambling devices. Cash payments were made to cus tomers who received certain winning combinations while playing the video gambling devices. The gambling de vices were used in illegal gambling, to wit: to facilitate commercial gam bling as defined in O.C.G.A. 16-12-22(a)(1); to facilitate keeping a gambling house as defined in O.C.G.A. 16-12-23; and possession of a gambling device, O.C.G.A. 16-12-24. The cash listed above is proceeds from the illegal gambling activity more fully described herein. The machine owner(s), Ketal C. Pa tel and/or Silver Coin USA, knew, or by the exercise of reasonable care should have known, that the seized machines were used to violate O.C.G.A. 16-12-20 et seq.
