Perry Fire Department got
the call on the fire at 2:57

engines and called Warner

assist with a third engine.
Flames were showing as the
first units arrived.
Allford said he got off work
about noon and came home
and turned on a heater.
He said the heater has a
breaker to shut it off. “I
don’t think that was it. I
hadn’t been gone that long,”
he said.
Perry Fire Department
Deputy Chief Joel Gray said
“we believe the fire was an
accident from statements
from the homeowner. There
was a space heater in one of
the back rooms.”

RECORD
From page fA
A person sentenced under
the first offender act (either
one) is not “adjudicated
guilty” at the time of sen
tencing - even if there is
some prison time involved.
The sentencing judge with
holds final adjudication
and if the person success
fully completes the terms
of the sentence the charges
are ultimately dismissed.
However, if the terms of the
sentence are violated, the
first offender status can be
revoked, and the judge has
authority to re-sentence the
individual up to the statu
tory maximum of the origi
nal charges.

The mother pled guilty

“We all want them to go
away for the rest of their
life,” Ashford said of child
molesters.
But, the mother, as non
custodial parent, he said
“is not in the position to
be aware of the impact tes

child.”
“We think this was an
appropriate disposition of
the trial,” he said, noting
the sheriffs office agreed
with the sentence.
Ashford explained the man
had never been arrested in
tenced under a first offender
statute. If you were, you are
in luck and you can have
your record expunged. If you
were not, however, Georgia
has no other law permit
ting for you to have your
record expunged. In theory,
you might try to either have
your guilty plea withdrawn
or claim your attorney was
“ineffective” for not inform
ing you of your right to make
use of the first offender stat
ute.
Unfortunately, the rules
for appealing a guilty plea
make it very difficult, if
not almost impossible to
achieve. Finally, you could
ask for a pardon and to have
your conviction erased - this
almost never happens, but is
theoretically possible!
Your question asks about
voting as your ultimate goal.
