Braselton Police Department Incidents
Dog alerts BPD to drugs during traffic stop
A canine unit alerted officers to drugs
during a traffic stop last week, but no nar
cotics were found during a search.
Officers with the Braselton Police
Department stopped the vehicle for driv
ing 90 miles-per-hour on 1-85 North. The
driver told officers he was going to visit
family “somewhere in Atlanta,” but they
did not find any luggage when they later
searched the car.
Officers could smell marijuana in the
vehicle. After stepping away from the
vehicle and later returning, the driver had
to put the vehicle back into park.
Officers searched the vehicle and the
driver “would not look at the vehicle”
during the search.
A drug dog alerted the police to pos
sible drugs in the vehicle. Officers took
the vehicle in and noted it had been taken
apart and was in bad condition, although it
wasn't a year old.
Officers did not locate any narcotics
inside the vehicle.
The driver was issued citations for
speeding.
Another officer was called in to translate
into Spanish. The driver told officers he
worked as a taxi driver and had brought
one person to Marietta. He told officers
he’d previously been arrested for cocaine,
but said he did not have drugs in his car
and did not drop off any drugs in Atlanta.
WOMAN DENIES
MARIJUANA DESPITE SMELL
A woman denied smoking marijuana in
her vehicle last week after officers smelled
the substance during a traffic stop. She
was later issued citations after they found
a half smoked “blunt” in her cigarette
pack.
Officers with the Braselton Police
Department stopped the woman’s vehicle
for driving 20-miles-per-hour over the
speed limit.
She said she was driving to her boy
friend’s house and officers smelled mari
juana inside the vehicle. The woman said
she hadn’t smoked marijuana and said it
could have been her brother, who stole the
vehicle last weekend.
In a purse in the front floorboard, offi
cers found a multi-colored pipe, but said
it was not hers. But she confirmed the
panties and baggie with marijuana residue
were indeed hers. Officers also found a
half-smoked marijuana “blunt” in a ciga
rette pack in the driver's side door and a
small baggie of marijuana in an eyeglass
holder.
OTHER INCIDENTS
Other incidents reported to the BPD last
week were:
•recovery of stolen property at a Park
Bend Drive location. A man pulled a
Suzuki QUV out of the mud down by the
river. The vehicle was stolen from Road
Atlanta.
•damage to a vehicle at the police
department. A woman said she thought
her vehicle was damaged when she was at
a restaurant.
•theft of PVC columns at a construction
site on Jackson Avenue.
•burglary at a Mossy Oak Landing res
idence. A woman said her house doors
were unlocked, although she knew they
were locked when she left. Officers saw
the door was kicked open, but nothing was
taken.
•theft of a Georgia Bulldog birdhouse
and sign at a Lexington Way residence.
•damage to property in front of a gro
cery store on Spout Springs Road. A man

Braselton Police Department Arrests
Drugs ‘must have been a bad joke’
A man arrested for drugs last week said
someone must have planted the marijua
na and pills in his vehicle ‘as a bad joke.’
Danial John Szalay is facing charges of
possession of marijuana, possession of a
controlled substance, original container
violation and possession of a drug-re
lated object. Officers with the Braselton
Police Department stopped Szalay after
he failed to maintain his lane.
Szalay told officers he had just had
surgery and would have a difficult time
walking. Officers said he also had slurred
speech.
He did not consent to a search of the
vehicle, but when officers checked the
vehicle identification number (VIN), they
saw a cotton swab “commonly used to
prepare illegal substances for injection”
and smelled marijuana in the vehicle.
Officers asked if there was any reason
they should smell marijuana, and Szalay
said “there's probably a roach in there.”
Officers searched the vehicle and found
several tops to syringes, multiple Q-Tips
and cotton swabs, a bent spoon with burn
marks on the bottom side. On the spoon
was a cotton part of a Q-Tip with some
type of dissolved residue.
They also found two marijuana “roach
es,” an unused glass smoking device and
an unused brillo pad. Inside a leather
jacket, they found more marijuana and a
baggie with 27 pills (Alprazolam).
When he was placed in the patrol car,
Szalay reportedly continued to move his
body seemingly uncontrollably.
He told officers the leather jacket was
his. But he said he didn’t know where
the drugs came from and said “someone
must have played a bad joke on him.”
THEFT, CHILD
CRUELTY ARRESTS
MADE
In another incident, two people were
arrested for theft and cruelty to children
during a traffic stop. Officers with the
BPD arrested Jeffery Moss and Jennifer
Naomi Jones during the incident.
The two were driving a vehicle pulled
over for a seatbelt violation. When offi
cers approached the vehicle, they saw
Moss had his pants undone and marijua
na shake was spread out on his lap.
He told officers he didn’t have a license
and wrote down a false name (the name
of Jones' son) when asked for his identi
fication.
Officers also saw a five-point star on
his neck, known to be a gang tattoo. He
said “that was a long time ago,” then told
officers he was 17 years old.
Officers learned his real name and
learned he had a warrant out of Hall
County.
While searching the vehicle, officers
found a bag of synthetic marijuana and
three handguns. One was a Bersa Thun
der 380 and another was a black Wit-
ness-P .9 mm, which was loaded with
six bullets in the magazine and one in the
chamber. A third pistol was a replica of a
real firearm.
All the firearms were reported stolen
out of Hall County.
Jones called Tosha N. Dale to come
and pick up her 14-year-old son who was
in the vehicle. Dale was arrested after
officers checked her identification, learn
ing she had a warrant out of Hall County.
Moss is facing charges of possession
of a firearm by a convicted felon, driving
while unlicensed, wanted person, theft
by receiving stolen property and giving a
false name to the police.
Jones is facing charges of permitting
an unlicensed person to drive, safety
restraint violation, theft by receiving sto
len property and first degree cruelty to
children.
METH ARREST MADE
IN TRAFFIC STOP
In another incident, the BPD arrested a
man for possession of methamphetamine
after a vehicle he was in was pulled over
for following too closely and failing to
maintain lane. Phillip Richard Maloch
(a passenger in the vehicle) is facing
charges of possession of methamphet
amine, possession with intent to distrib
ute a controlled substance and possession
of a drug-related object.
Officers noted Maloch's head went
down when they pulled the vehicle over.
They said he moved around inside the
vehicle like he was hiding something
under the seat.
When they were speaking with the
driver, Maloch was reportedly trying to
hide something with a gold/silver handle
between the seat and the console. When
the officer was out of sight, they noticed
Maloch reached between the seat and
console again where the item was.
Officers asked him to keep his hands
on his lap and noticed the handle had
been pushed farther down.
The female driver and a toddler got out
of the car. Officers searched the vehicle
and found a large knife (the item with the
gold/silver handle).
Officers found a sunglasses case where
Maloch had reached when they pulled the
vehicle over. Inside, they found metham
phetamine. Officers also found a glass
pipe.
Maloch didn’t ask officers what they
located, but said he wanted to kiss his son
before leaving for jail. He told officers
he'd recently lost his job and said the
meth did not belong to his wife and she
did not know anything about the items
located inside the vehicle.
OTHER ARRESTS
Other arrests made by the BPD last
week were:
•Brett Leon Miele, possession of mar
ijuana and possession of methamphet
amine.
Miele was pulled over for a broken
taillight and reportedly appeared nervous
and was trying to hide his body and face
behind the metal pillar located beside the
window on vehicles. He consented to a
search and officers found marijuana in
his pocket and methamphetamine and
a syringe in a black cloth pouch in the
vehicle.
•Dennis Morgan Waugh Jr., wanted
person. Officers were called to the Park
Bend Avenue residence for a domestic
dispute.
Waugh, who was standing outside,
told officers he had to sleep outside that
night because his mother wouldn't open
the door. Officers checked his identifica
tion and learned he had an outstanding
warrant.
•Danny Shelton Holcomb, wanted per
son. Officers were called to a bank on
Grand Hickory Drive on reports of a
suspicious person. Someone was report
edly walking around the parking lot and
making the employees feel uneasy.
