10—(#)—Failing in two attempts to
quash the charge of murder against
Charles R. Davis, former Flat Top
prison mine warden, new on trial
before Judge John P, McCoy of the
eriminal court, in connection with
the death of James W. Knox, state
convict, August 14, 1924, the de
fense today placed Hugo L. Black,
United States senator-elect, on the
stand as the first of about 30 wit
nesses who arc to unfold the de
fense of the accused warden,
Mr. Black gave a character testi
monial in behalt of Warden Davis
and promptly thereafter court re
cessed, in order to allow Roderick
Beddow, Hugh Locke and George
Fay, defense counsel to confer on
the order of presenting the defen:e.
When court recessed Mr. Locke
said that only about 30 witnesses,
geveral of whom are to testify to the
defendant’s character, would be used
and expressed an opinion that the
