Regents Copyright Committee: Students pay too much for course packets

The Georgia Board of Regents
Copyright Committee has found a prob
lem that costs students extra money
they shouldn’t have to pay for course
packets
Publishing companies charge a fee to
copy material from their textbooks to
course packets, even though under the
Pair Use Doctrine professors should be
exempt from It. regents officials said
Ray Patterson, a University law pro
fessor and member of the regents com
mittee. said students follow along
because they are Ignorant about the
laws, and so they pay the fee
"Students are a captive market — the
publishers claim that the students have
a duty to pay royalties." Patterson said
Patterson sees this oversight as costly
for students and yet profitable for book
stores and publishing companies.
"There Is a difference In using a work
and a copyright You don’t have to ask
permission to make fair use of copyright
ed materials It Is to free up educational
exchange Instead tying It up," said
Stanley Undberg. editor of The Georgia
Review
"There was a class a few years back
where students In the course had to buy
three course packs that cost MOO. more
than the tuition for the class." Patterson
said. "The dean refused to require stu
dents to buy the packets because of the
cost This Is the kind of abuse they are
subjected to."
Undberg agrees students and faculty
are getting the short end of the stick.
"I can’t speak for other faculty mem
bers but a lot have been brainwashed
and they believe that they have to pay."
Undberg said
“Fair Use Is In danger, it will be a lost
right, and soon there will be a dollar
price on every piece of paper." he said
Undberg said bookstores and faculty
are put In a difficult position by this
problem.
"The faculty want to use something,
and they’re In a bind The bookstore has
been intimidated. The copy clearance
center is not going to say anything, and
the students pay through the nose,"
Undberg said.
Undberg Is a veteran of this process
from many angles as a teacher, student,
writer and publisher.
"If one poem of T.S. Elliot's is used In
an article to educate people on how
Elliot used allusions — that Is education
al. If It Is used for an anthology of 20th
century poets, then they are using as
copyright and they have to pay,"
Undberg said.
University Bookstore manager Henry
Bryan said he couldn't comment.
“We are waiting to hear from the office
of legal affairs to comment," he said
Delmer Dunn, a professor of political
science, sees the copyright problem as
inhibiting for educators
"Basically, the copy shops won’t copy
articles from journals and If you are using
a number of these, like in a graduate
course it can take months or even a
year,” Dunn said. “It is a disincentive to
assign the latest articles to be copied, it
Interferes with my teaching."
These claims by Patterson and the
regents aren't going unanswered The
Association of American Publishers fired
a letter back at Patterson claiming
they’re within the bounds of the law.
Undberg said the next step is for the
student body and faculty to become
aware and educated of the problem.
“Students should be educated,” he
said. "This should come out In public.”
Patterson agrees, and said the people
in charge should be educated also.
"I think students and teachers, but
also administrators and those responsi
ble, should be made aware of what Is
going on,” he said "The administration
at the regents and University level do not
recognize the abuse that is going on.
Who is willing to stand up and speak for
the students?"
HOW IT WORKS
When professors piece together course
packets to accompany their class text
book. publishing companies require pay
ment of a copyright tee According to the
Regents Copyright Committee, course
packets fall under the Fair Use Doctrine
and aren't subject to royalty costs. The
doctrine says “scholarship" and ‘classroom
use’ fall under the Fair Use Doctrine.
