WITH FREEDOM Separation Wall Not Compatible ST. LOUIS, (NC) —The American people want a sep aration of Church and State that is compatible with religious freedom, the dean of St. Louis University's graduate school said here. Complete ‘'separation" of Church from State would mean that the Church could not ex ist, Father Robert J. Henle, S. J., said in a talk to gra duate students of the university. FATHER Henle, who is also academic vice president of the university, denied that there is any such thing as "a clear, indisputable, universally ap plicable principle of separation of Church and State that can be called American.’’ He said "separation" is not "a yes-no situation" and added: "There has to be some relat ionship between the two. What the relationship will be can have many variations, with qu alitative and quantitative de grees of difference." "ABSOLUTE separation of Churcij and State means the ex istence of only the State. The Church ceases to exist. And wherever we find attempts at such absolute separation in his tory, the goal has been to de stroy the Church," he said. In place of absolute sepa ration, there actually exist all sorts of different relations in most countries he pointed out. They range from cordial to ho stile, "but in all kinds of these there is some recognition of the positive value of some sort of relationship between the two," he said. THE priest praised the Sup reme Court for its handling of Sunday Closing Measure ALBANY, N.Y. (NC) —The New York Legislature has passed a bill to permit shop keepers in New York City to open their stores on Sundays if they close to observe another day of the week as the sabbath. The bill was adopted (April 4), as the legislature hurried to adjourn, by a vote of 46- 11 in the Senate and 135-10 in the Assembly. A measure which would have permitted Sunday opening throughout the state was passed earlier by the Assembly, The Senate, however, voted a bill which would apply only to New York City, and the Assembly accepted this version of the leg islation. The measure is permissive, not compulsory. It will not go into effect unless New York City passes its own Sunday opening ordinance by December 31 of this year. If the city fails to act by that date, the authori zation to enact such an ordin ance will no longer remain In effect. Cross Berlin BERLIN (NC) — Berlin’s So viet Zone authorities have granted permission to Arch bishop Alfred Bengsch to cross the wall and go into West Ber lin at Eastertime. He applauded Justice Hugo Black for the decision he wrote on the New York Re gents' case, holding unconstitu tional a paryer composed by the New York State Board of Re gents for recitation in public schools. "The kind of disestablish ment we want in the United States ls the kind that is com patible with freedom of relig ion," he said. "We want to set up a kind of society in which civil citizen ship and any kind of religious beliefs are perfectly compati ble—with neither privileges nor perrogatives, with no benefits and no handicaps," he said. SPRINGFIELD, ILL., April 5—The State Senate has voted almost unanimously to limit sharply the new program of tax-supported birth control among public relief recipients. The House is scheduled to act after the Easter recess on the proposal. The program will be stopped at least until tner by a Chicago judge. THE SENATE approved by a vote of 45 to 2 a bill to pro hibit the Illinois Public Aid Commission from giving birth control information and cont raceptives to unmarried mot hers or to married women liv ing apart from their husbands. The proposal would permit use of tax funds to support a birth control program only for women on relief who are living with their husbands and who re quest state assistance. The bill's sponsor, Sen. Mor- Chamblee Girl On Deans List Theresa Wilkinson, daughter of Mr. and Mrs. E. J. Wilk inson, of 3091 Parkridge Crest- cent, Chamblee, has been put on the Dean's list at Rosary College, River Forest, Illinois. Miss Wilkinson, a 1962 graduate of St. Plus X High School, was also chosen to re present Rosary College at the National Convention of Young Christian Students at Green Bay, Wisconsin. gan M. Finley of Chicago, told the Senators that com mission’s original plan to fin ance birth control for lin ing away from their husbands would involve "the expenditure of public funds to foster, con done and even encourage im morality." IN CHICAGO, Superior Court Judge John J. Lupe said he would issue a temporary in junction to stop the birth con trol program, which began April 1. A suit seeking an injunction was filed by Benjamin Adamow- skl, unsuccessful Republican candidate for Chicago mayor, during the election campaign. In a switch, State Atty, Gen. William Clark, whom IPAC spokesmen expected would de fend the program, joined Ad- amowski in his suit, alleging that "use of public money for the purposes contemplated would make the State of Illi nois a sovereign accessory to sexular promiscuity and pro stitution." JUDGE Lupe said he would issue his injunction as soon as a legal technicality in the suit was straightened out. Adamowski's suit asks for a temporary injunction against the program until the Legis lature completes actions on bills to curb it. In the meantime, by the end of the first week of the plan, not one public relief recipient had requested birth control ser vices. Harold O. Swank, executive secretary of the aid commiss- ' ion and a principal backer of the program, said that in view of such disinterest, heads of welfare departments across the state had been asked to sub mit reports covering the first ten days of the program. SWANK noted that com mission regulations demand that recipients request infor mation. Case workers are not supposed to introduce the sub ject. The program's backers have said that by preventing tlie birth of children who would be de pendent on public welfare, the costs of public relief would be cut. Opponents, largely Catholic groups, have charged that the plan is "bad public policy” and that it will promote immor ality. Appointed WHEELING, W. Va., (NC)— Robert E. Ramsey has been named editor and general man ager of the West Virginia Re gister, Wheeling diocesan newspaper. He succeeds Msgr. Frederick J. Schwertz, who was associated with the earlier dio cesan paper since 1923 and had been editor of the Register since it was founded in 1934.
