SEEKS AMENDMENT Becker Polling Bishops On School Prayer Bill WASHINGTON (NC) — Rep. Frank J. Becker plans another letter to U.S. Catholic bishops asking their opinion on his pro posal to amend the Constitution and permit prayer in public schools. The New York legislator sent a letter June 24 to all 229 bishops, but a spokesman said replies have been "rather slow in coming” and a second let ter will be sent as a follow-up. ABOUT 35 replies had been received by July 9, the spokes man said, a number not suffi cient in Becker's judgment to be released as indicative of a trend in the bishops’ thinking. Becker is the chief force in the House behind an effort to permit voluntary prayer in pub lic schools find to override the FmilNlMCTIONTCALL CE. 7-8694 U.S. Supreme Court’s 1962 and 1963 decisions which held that conducted religious exercises in public schools violate prop er Church-State separation. THE HOUSE Judiciary Com mittee held lengthy hearings on Becker’s proposal and about 145 similiar ones, but it has taken no action. Several Cath olics testified, including Auxi liary Bishop Fulton J. Sheen of New York, but all stressed they represented only themselves and not the Catholic Church. Becker’s letter to the hier archy was prompted, he said, by the diclosure by the Legal Department of the National Catholic Welfare Conference that it has adopted an attitude of caution and reserve toward the so-called prayer amend ments. WILLIAM R. Consedine, di rector of the NCWC unit, made the attitude known in a memo randum sent to directors of Catholic bureaus of informa tion throughout the country. The memorandum accom panied a pamphlet prepared by George E. Reed, associate di rector of the department. BECKER assailed the legal department's statement in a public statement and in his June 24 letter to the bishops. He said he was shocked by the "implications” that the de partment’s view could be con sidered as reflecting the opin ion of the American hierarchy. Becker petitioned the bishops for a response to these two questions: "Do you support the premise that children in public schools be permitted to pray on a voluntary basis? Do you oppose such an amendment?” BECKER, in his letter, said he is a member of the Knights of Columbus, a Knight of the Holy Sepulchre and a graduate of public schools as are his three children. Tax Issue Heads For Courts BALTIMORE (NC)--Parties to a test case on the constitu tionality of tax exemptions for church and rectory property have been given until Septem ber to file briefs. Judge Wilson K. Barnes took this action after a day-long hearing on the pros and cons of tax exemption for church prop erty. THE SUIT, filed last October, was brought by Mrs. Madalyn Murray, widely publicized Bal timore atheist, against city and state taxing officials. Religious groups, including the archdio cese of Baltimore, have also entered the case. Mrs. Murray was represent ed at the hearing by attorney Leonard J. Kerpelman. She was in Hawaii, where she went with members of her family after being released on bail of char ges of assault arising from an altercation with police. The state is seeking extradition of Mrs. Murray and her son Wil liam. KERPELMAN contended that the exemption for church prop erty is an unconstitutional es tablishment of religion. He said the exemption results in loss of $78 million yearly in potential tax revenues in Baltimore alone. Francis X. Gallagher, lawyer for the Baltimore archdiocese, said the state has a right to choose whom it will and will not tax. In exempting church prop erty on a non-discriminatory basis, it is exercising this right, he said. ASSISTANT State Atty. Gen. Mathias J. DeVito said the state has a duty to "accommodate” the religious views of citizens, and tax exemption of church property is such accommoda tion.
