New Constitution Limits
Malta Church Privileges
LONDON (NC>~The House of
Commons voted (July 23) to give
Malta independence and approv
ed a constitution for that pre
dominantly Catholic Mediter
ranean colony.
The constitution, as approv
ed by the government and pass
ed by Parliament, modified the
privileged position for the
Church in Malta called for in
the draft constitution submitted
by the island's Catholic pre
mier, Giorgio Borg Olivier. But
it makes the Catholic Church the
established Church of Malta.
BOTH THE Holy See and
Church authorities in Malta
were consulted by the Brit
ish government before it
amended the draft and restrict
ed some Church privileges.
Colonial secretary, Duncan
Sandys, who presented the
amended constitution to the
House of Commons, said that
the "amendments which have
been made in order to streng
then the human rights provi
sions are fully approved by the
ecclesiastical authorities in
Malta."
THE NEW constitution states
that "the religion of Malta is the
Roman Catholic Apostolic reli
gion.
THE MALTESE State
guarantees to the proper spir
itual and ecclesiastical func
tions and duties and to man
age her own affairs."
But in the chapter on funda
mental rights and the freedom
of the individual, the govern
ment deleted from the Borg
Olivier draft an entire section
that was construed to place the
Church above the ordinary func
tioning of secular law.
THE DRAFT was approved in
Malta in a referendum (May 3)
with 65,714 votes in favor and
54,919 opposed. There were
9,016 blank or spoiled ballots.
Malta's opposition Labor par
ty, led by former Premier Dorn
Mintoff, had campaigned against
it on the grounds that its re
tention of a favored status for
the Church would saddle Malta
with a "clerical form of colon
ialism,"
ABOUT 98% of Malta's 330,000
people are Catholics, and under
the draft constitution approved
by the May 3 referendum, as
well as under an earlier one,
civil marriage was not permit
ted and the Church's Code of
Canon Law had the force of civil
law.
The constitution approved by
Parliament says that all per
sons will have "full freedom of
conscience and enjoy the free
exercise of their respective

IT IS understood here that the
government consulted the Vati
can through the Apostolic Dele
gate in Britain, Archbishop Igi-
no Cardinale, before amending
the draft. The Archbishop was
understood to have said he saw
no reason why Church authori
ties in Malta should object to
the normal human rights claus
es as listed in the constitution.
Archbishop Michele Gonzi of
Malta was reported to be in
agreement.
Earlier, reports here said
that the Holy See and Maltese
Church authorities were in dis
agreement on the amendments
to the constitution and that the
Vatican had asked the Maltese
to tone down their insistence
on privileged safeguards for the
Church. Later, a spokesman for
the Maltese Hierarchy denied
the reports.
NO DATE has yet been set
for Maltese independence, but
it is expected by the end of Sep
tember. The new nation will ap
ply for membership in the Brit
ish Commonwealth and remain
a monarchy under Queen Eliz
abeth II. The Queen, who is tem
poral head of the Anglican
Church in England and the Pres
byterian Church in Scotland,
will become the legal protector
of the Catholic Church in Malta.

Transferred
LOS ANGELES (NC) —Father
William H. DuBay, 29, who
criticized James Cardinal Mc
Intyre in June for failing to
provide Catholics in the Los
Angeles archdiocese with civil
rights leadership, has been
transferred to a new parish in
suburban Anaheim, Calif.
Msgr. Benjamin G. Hawkes,
chancellor of the archdiocese,
confirmed (July 24) that Fa
ther DuBay has been moved
from predominantly Negro St.
Albert the Great parish in
Compton, Calif., to the pre
dominantly white parish of St.
Boniface in Anaheim.

year-old Paul Gilleran, sixth
grader at St. Charles elemen
tary school, got the thrill of
his life when he was given a
baseball glove by San Francisco
Giant outfielder Willie Mays
and Archbishop Joseph T. Mc-
Gucken of San Francisco for
having won a CYO contest to
name the most sportsmanlike
Giant player. The presentation
was made prior to a Giant
game.
It is not recorded whether
Paul explained to Mays how he
came to choose Giant out
fielder Jim Davenport as the
most sportsmanlike.

Harry Golden, best selling au
thor and publisher of the Caro
lina Israelite Newspaper, will
speak at the sixth National
Cursillo Conference Aug. 19 to
22 at Michigan State University
here.

address will be "The Probelm
of Our Age." More than 1,000
bishops, priests and lay persons
are expected to attend the con
ference. <

THE BILL would legalize
abortions for women pregnant
as a result of rape or incest
or in cases where there was a
risk that either mother or child
would suffer grave impairment
of physical or mental'health.
Hospitals would be authorized
to set up boards of five doctors
to decide whether or not an
abortion should be performed.
Present California law per
mits abortion to save the life
of the mother.
Dr. M.B. Flanagan, an ob
stetrician representing Catho
lic Physicians Guilds, said that
with new medical techniques it
is unnecessary to abort a fetus
to save a woman’s life.
AS FOR mental illness, Dr.
Flanagan said, "pregnancy does
not cause psychosis . . . An
abortion does not cure it.
Abortion cannot safeguard the
mental health of the mother."
Eugene Brenner, repre
senting the St. Thomas More
Society, and Walter Trinkaus,
representing the California
Conference of Catholic Hospi
tals, attacked the legality of
the proposal, contending that it
would violate the legal rights
of the unborn child as a per-

TRINKAUS cited legal pre
cedents supporting the rights
of an unborn child to recover
damages in the event of injury,
and commented that "if the un
born child is a person for the
protection of such rights, it
unquestionably is a person for
the protection of the most basic
of all rights, the right to life."
However, testimony in sup
port of the bill came from the
Rev. Lester Kinsolving, re
presenting Episcopal Bishop
James Pike, and Rabbi San
ford E. Rosen, president of the
Northern California Board of
Rabbis.
Rabbi Rosen, speaking per
sonally but with the backing of
"conservative and reformed
colleagues," contended that the
fetus is a part of the mother
prior to birth and as such can
be sacrificed for the sake of
the mother, just as an arm or
a leg could be amputated.
