Court Decision Decried

WASHINGTON (NC) -
Arguing that recent court
decisions have marked a
shift from making
abortion a right to making
it an entitlement, the U.S.
Catholic Conference has
asked the U.S. Supreme
Court to reverse a lower
court ruling on the
constitutionality of Hyde
Amendment-style
restrictions on abortion
funding.
In a friend-of-the-court
brief filed with the court
in Washington, the USCC
said the court’s 1973
abortion rulings created a
right by offering “an
immunity from state
interference with
abortion” but “they did
not create an entitlement
to benefits.”
Such an entitlement has
been created, the USCC :
argued, by court decisions
striking down as
unconstitutional
legislation at the federal
and state level limiting
public funding of
abortion.
The brief was filed in a
case accepted by the
Supreme Court from
Illinois. In that case, a
federal district judge in
Chicago ruled that federal
restrictions on abortion

Father John Provost,
co-director of the Albany
Family Life Commission,
defined family as “the
place where values come
together and are nurtured
and developed. It’s any
household of faith.” He
admitted that the
definition is broad but said
it is necessary to be
acceptable in the church
which serves a changing
society.
Sister Branson called
the economic situation the
number one influence on
families today and noted
that economic pressures
are growing.
“Today in many
two-parent families both
parents work at jobs with
many pressures, come
home from work and take
their pressures out on their
children. As a result we
have another problem
situation of children who
are not being nurtured.”
She said the
government has the power
to alleviate some of the
pressures through services
such as day care and after
school programs. But even
these help only part of the
problem.
“For many people, the
whole economic picture is
simply demoralizing,” she
said. “Young couples are
unable to set aside money
for education because
they’re struggling just to
make ends meet on a
day-to-day basis. Many
aiso see the dream of
owning a home as out of
reach as the cost of a
house goes higher and
higher. They’re becoming
disheartened.”
In this complicated
world the government
cannot bear the entire
blame for the state of the
economy, she said, but
added that government has
the obligation to take the
leadership in solving
economic problems.
Providing national
health insurance and
promoting welfare reform
are two ways in which she
believes the government
can address the country’s
economic crisis. She also
called for a tuition tax
credit program and
preventive services for
people.
Sister Branson said the
government must “show
its inclination to help
parents by being
supportive of family life.
We need to press for a
public policy which will be
more favorable to families
in ail that government
does.”

which were medically
necessary.
The court agreed last
November to accept the
case for oral argument and
to decide whether it had
jurisdiction to rule on the
constitutional issues
involved.
The brief was written
before a federal judge in
Brooklyn issued a similar
ruling Jan. 15 which
would stop enforcement
of federal restrictions on
abortion funding.
The USCC brief argues
that the actions of the
federal and state
legislatures on abortion
funding “manifest a social
policy which does not
favor the practice of
abortion.”
But the lower court,
the brief argued, has
replaced that policy
judgment and “seeks to
create a legal entitlement
and award the practice of
abortion the status of an
affirmative public good.”
The brief added that
the lower court decision
removed from the state
any interest in the rights
of nonviable human
fetuses.
“The right to take a life
has always been presumed
to be a public right,
exercised only under the
most rigid rules of due
process,” the USCC
argued. “The legislature
has, we believe,
constitutional authority to
make the decision that
will not pay
human life

bishop of souls means to
protect the word (of God),
to watch over the truth,”
he said.
The day before, in a
letter asking Dutch
Catholics to pray for the
synod’s success, the pope
emphasized that the
bishops were chosen to be
leaders of their people, not
just spokesmen for the
people’s views.
Opening the synod’s
first business session that
afternoon, Cardinal
Willebrands described the
meeting as an exercise of
“sacramental collegiality”
and said the participants
had a three-fold task:
-- “To revive our
communion with the
universal church and
especially with the bishop
of Rome.”
-- “To share our
information regarding the
situation and problems of
the church in the
Netherlands.”
~ “To reach agreement
in our conceptions and
pastoral action.”
The Vatican-approved
summaries of the sessions
often mentioned
“tensions,” “divisions”
and “differences” among
the Dutch bishops. But all
the discussions have taken
place in a “cordial and
relaxed” atmosphere
marked by “disagreements
but not confrontations,”
according to Spekman.
“They were dealing
with problems and not
with each other,” he
added. “Now they are
openly saying what they
think. They are speaking
more frankly than they
did at home in their
episcopal conference.”
Pope John Paul has
attended nearly all of the
sessions, but delegated the
presidency of the synod to
Cardinal Willebrands and
Archbishop Godfried
Danneels of Malines-Brus-

Consumerism Denounced
CARACAS, Venezuela (NC) -- The Catholic
bishops of Venezuela are waging a campaign
against the excesses of consumerism, sex in
advertising, drinking and loafing on the job. “We
must seek a society where dignity and solidarity
prevail,” the Venezuelan Bishops’ Conference said
in a pastoral letter to the country’s 13 million
Catholics. The bishops condemned “the insatiable
thirst for having more, fed by an alienating
propaganda in the advertising industry.”
Pro-Lifer Loses Case
HACKENSACK, N. J. (NC) - A nurse who
refused to participate in abortion procedures lost
her first court case against the hospital that
transferred her from the maternity ward. Beverly
Jaczalik, 31, plans to appeal the ruling, which said
the rights of patients seeking abortions and of the
hospital to provide care for them outweighed the
nurse’s right to a place on the maternity staff at
Valley Hospital in Ridgewood. N. J.
Highway Interference
ROME (NC) - The Polish bishops are deeply
upset at the building of a four-lane super highway
by Polish authorities only 500 yards from the
National Shrine of Our Lady of Czestochowa,
gathering point for millions of pilgrims every
year. The highway would present a barrier
between the Monastery of Jasna Gora, site of the
shrine, and the city of Czestochowa, where
virtually all shrine pilgrims sleep and eat during
visits to the shrine.
Bishops’ Suit Dismissed
WASHINGTON (NC) - A suit filed by the
National Conference of Catholic Bishops
challenging the abortion provisions of the
one-year-old Pregnancy Discrimination Act has
been dismissed by a federal judge in Washington.
U.S. District Judge John H. Pratt said that while
the bishops’ suit raised “matters of serious
importance,” the suit had to be dismissed because
there was no proof that the act’s abortion
provisions actually had violated an employer’s
right to freedom of religion.

Pope Speaks
Of Charismatics
SOUTH BEND, Ind.
(NC) - In a meeting with
13 international leaders of
the Catholic charismatic
renewal, Pope John Paul II
spoke warmly of the
movement, the
Charismatic Writers
Association reported in its
January newsletter.
“I am convinced that
this movement is a very
important component of
the entire renewal of the
church,” the pope said in
an audience in December
with the leaders, who
came from nine countries.
The association
reported that Pope John
Paul told the group that
since he was 12 or 13
years old, he has daily said
a prayer to the Holy Spirit
in a prayer book his father
gave him. “This was my
own spiritual initiation, so
I can understand all these
different charisms. They
are all part of the richness
of the Lord. I am
convinced that this
movement is a sign of His
action,” the pope said.
The 13 leaders included

archbishop of
Malines-Brussels, Belgium,
Bishop Uribe Jaramillo of
Sonson-Rionegro,
