Oregon may face 1994 hate vote
Salem, OR—Leaders of the Oregon Citizens
Alliance have started a new petition drive to put
an anti-gay/lesbian rights measure on the ballot
statewide.
While Oregon voters rejected a similar pro
posal in 1992, the new measure has been cleansed
of the most extreme homophobic language that
upset some voters—including labeling homo
sexuality as abnormal and perverse and requir
ing state and local governments to discourage it.
The new initiative is called “The Minority
Status and Child Protection Act,” denying mi
nority status based on sexual orientation. It would
prohibit children, students and employees from
being “advised, instructed or taught by any gov
ernment agency, department or political unit in
the state of Oregon that homosexuality is the
legal or social equivalent of race, color, religion,
gender, age or national origin; nor shall public
funds be expended in a manner that has the
purpose or effect or promoting or expressing
approval of homosexuality.” Marital status of
“domestic partnerships” and spousal benefits
would also be barred on the basis of homosexu
ality. .
The proposed initiative would, however, rec
ognize private lawful sexual behaviors as “non
job related factors, provided such factors do not
disrupt the work place.” It would also safeguard
gays from being denied business licences, per
mits or services.
In an effort to placate fears of censorship
created by the defeated ballot measure, called
Measure 9, the OCA included a provision in the
new iniuative that says that adult access to li
brary books addressing homosexuality would
not be limited, “provided access to such materi
als is limited through the existing library review
process.”
If the OCA can collect enough signatures on
the peduons, a statewide vote on the measure
would be held in November, 1994.
In the meantime, more local and-gay rights
ordinances, dubbed “The Sons of 9,” were over
whelmingly approved by voters recendy in six
Oregon cities and one county.
Sponsored by the OCA, the local measures
called for “no special rights” for gays or lesbians
and would prohibit local governments from grant
ing minority or affirmadve acdon status to them.
The ordinances passed in the cities of
Creswell, Medford, Estacada, Molalla, Sweet
Home and Lebanon, as well as Jackson County.
The OCA previously succeeded in getting seven
similar measures passed in other dues and coun
ties.
While Measure 9 passed in 21 of Oregon’s
_ 36 counties, it lost statewide because of strong
opposition in heavily-populated metropolitan ar
eas. So OCA leaders began pushing the local
referendums.
Those referendums, however, have been
thrown into confusion after the legislature, on
August 3, passed a new state law which invali
dates all such local measures. The latest local
votes have been allowed to proceed until a judge
decides whether the state law is constitutional.
That ruling is expected this month.
Several gay/lesbian rights activists said un
certainty over whether or not the courts would
actually allow the elections made it difficult for
them to convey their message to voters.
“We’re disappointed,” said Gina Davis of
the organization Creswell for Human Rights,
after seeing the anti-gay measure pass 368-268
in her town. “But 1 don’t think any of us are real
surprised. We didn’t manage to educate people
enough about what this issue meant for
Creswell.”
