When the Constitution was framed, all
power was rested in three branches—the
Executive, Judicial, aqd-the iLegiiletiTe?-?-
And it {rks'thyaim of the framers - to pre-
Kervo ^a. balance of power.
Since the. Radicals have been in power
Congress has stripped-the Executive of ao
many of 1 itspferogatoriesthat only one-bar
rier stood between that body and abaolnta
supremacy, viz: the. Supreme Court. And
now it is believed that they will tear from
that power its supremest privileges.
The Verger case, now,pending, will soon
be decided. The case is one in whieb a
wan ts tried and condemned by a military
tribunal in times of peace, and involves the
constitutionality of the Reoonstrnetioj
measures.
It is thought that it will be decided that
the Reconstruction acts were not constitu
tional. In that event Congress will toko
the matter in hand and annu'l the decision
of the Court.

ing off Congress without waiting for, Abe
December session.” And. again: “If the
acts should be decided unconstitutional, a
grave. duiytjvill devolve upon the Execu
