clause of the Constitution of the State
which declares that no session of the Gen
eral Assembly, after the second, shall Con
tinue longer than forty days, uuless pro
longed by a two-thirdi vote of each branch
thereof, makes the fo’lowing very extraor-
diary decision :
In the case before me it is alleged “that
the Legislature that passed the law under
consideration had sat beyond forty days,
and tbat too after the second session, with
out prolonging said session by a two-thirds
vote of each branch thereof. Admit it
Where do I get the authority to inquire in
to that fact ? Are they not made the
judges of their election returns and quali
fications, and is it not the presumption of
law that they adjudged themselves quali
fied to do legislation, and if being a mat
ter clearly (under their bath to support the
Constitution) for the determination in what
manner and by what authority can the
courts either restrain them, dissolve them,
or force them to adjourn, and being re
stricted to legislative acts which of them
selves are in violation of this Constitution
or the Constitution of the United States,
we are powerless and can only remit them
to the people; were we to do more, would
it not be an unwarrantable interference by
one with another distinct branch of the
government, or rather would it not be -as
suming to * be tho custodians of the con
sciences of the legislators themselves.
This decision is prefaced by quite
lengthy argument, in which the Judge sets
forth the prerogative, power, and relation
of the three branches of the government
which argument it is not necessary to re
produce, since the conclusion to which
led his mind is given in the above, whie'
conclusion completely upsets our ideas of
legislative responsibilty and judicial au
thority.
If the Legislature can, in defiance of
plain clause in the Constitution, prolonj
its session one day, it can perpetuate
ail infinitum, and if the courts are not com
petent to pass upon the Constitutionality of
its acts, then are the people indeed at the
mercy of the fools and thieves of the Gen
eral Assembly.
The responsibility of the Legislature to
the people is certainly a new idea. We
supposed that the members took an oath to
support the Constitution of the State, and
not to please the peoph. Tbeir tenure of
office is dependent upon the people, but
their acts should be regulated by coDstitu
tional restrictions.

So long as monied men can be found to
advance money to a fast man, just so long
will he be lavish and reckless in scatterin
it; but when the purse strings begin to con
tract, aud the paper offered scrutinized
with lowered spectacles, itis time for the
prodigal to begin to shorten bis sails. For
this reason we are glad to see that the
new government loan is not so readily ta
ken, and that the market in Europe is
glutted with bonds.
If Grant’s administration has done such
wonderful things in the way of financier
ing, ns the Republican platform of Ohio
claims, we do not see the use of borrowing
any more money. Or, perhaps, this is
the way it has paid the debt, by borrowin
money.
We give the following as the Secretary
of the Treasury’s new departure :
Secretary Boutwcll contemplates calling
in soma twenty-five millions of the five
twenties of the issue of 1862 and replac
ing them where the holders desire it, by
equivalents in the new five per cents. The
object of the financial departure is to cre
ate, as far as possible, a market for the new
loan, as the majority of the holders of the
bonds which are to be cancelled are Euro
peans, and it is expected that the foreign
market will be relieved to that extent. It
would appear from the statement of the
Treasury agents, already absent in Europe
that the markets there, are glutted with se
curities o f all kinds seeking purchasers.—
The Franeo-Prussian war has thoroughly
deranged the financial system of Europe,
and capitalists are extremely cautious about
making investments. The heavy balances
on hand in the Treasury warrant this step
on the part of the Secretary, and if it suc
ceeds, it is proposed to follow it up in the
exact ratio that the reveuuo receipts will
justify.
THE GOOD SEEK SPROUTING.
We have the copy of a protest signed
by a large numlicr of shoe-makes of Massa
chusetts against the protection duties, as
being injurious to the interest of those
themselves whom it has heretofore been ar
gued that they would benefit.

“It is signed by over four hundred firms,
all of them doing business In the State of
Massachusetts. They show that all the
raw materials imported for use in manufac
taring their goods are taxed so high by
protective duties that they are unable to
produce goods cheap enough to sell in for
eign markets when they come in competi
tion with manufacturers of other nations.
The combined taxes upon all articles for
ming the materials of their industiy yield
the government a revenue of only S3,500,-
000, while they impose on the manufactu
rers of boots and shoes a tax of SIS,000,-
000, which as these pioteetants very cor
rectly remark, “must eventually be paid
by the wearers of these necessary articles.’
—This blow from a “protected” interest
will spread consternation among the monop
oly lords.” A

ing and the sugar will tumble out.

contemplates a change in the Attorney
General’s department. It is stated that
the present incumbent will be succeeded
by either Solicitor General Bristow or by
General Harlan, which latter is republican
candidate for Governor in-Kentucky. It
is well known that Mr. Akorman has been
on the eve of retiring for sevaral months,
and that it was an understoed fact that he
was to go oqt some time last spring, but he
has found it convenient to retain his port
folio np to the present time, and will prob
ably retain it until the Kentucky election
is heard from.
Of course Amos found it convenient to
retain his potifolio until now, and he will
retain it until he is choked off by the strong
grip'of some other higher office seeker. |Qe
belongs to the holding on tribe; he wanted
the Legislature to hold on, and fixed up the
election bill with that aim. We hope that
when he does let loore he will drop in some
other land than Georgia; as it wants no
more of him.

in Now York on the 27th. And the;same
day a drunken fightest fell over a little girl
in a saloon and killed her. Out in Indiana
they go it on a more sulphurous scale. On
the 26th some ruffians attacked a house oc
cupied by four bachelor brothers, their sis
ter and servant. Three jugs of benzine
were thrown into the house, followed by
loaded torpedoes, nails, buckshot and
screws. The explosion of the torpedoes
fired the house and awakened the family,
when.the ruffians fired into the house, fa
tally woundiDs several of the inmates and
then made their escape. A thousand dol
lars has been offered for tneir detection.
They ought to have our rich Governor
Rufus the infernal Bnllock after them with
a reward. 81,000, would be notbihg to
his rich ideas. Nothing short of S5,000
for the first one, SI ,000 each for the bal
ance coaid express his idea of the value
of a ku-klux. Bully for Bullock.
A number of counterfeiters have been
captured in Cincinnati, .including I. M. Bis-
sel, Wu 1 . H. Burr, John Hickman, Chris
topher C. Brady, Geo. A. Shawen, Geo.
Frederick, Mathew A. Boyd, Sim Rives,
Harry Peartcr, Joe Warren and other well
known rascals. Shawen peached on his
confederates.
