and those whose agent 1 am. requires
that I should deelare Mr. Carnes,
statement, using a milder term than
it deserves, to be erroneous The
foundations upon which P H. Carnes
pretends to predicate his claim, ara
these—the first following of which
he has more than once affirmed in
my presence—that by a recent survey
of his tract of land, he soys he finds
a small deficiency, without reflecting
upon the natural cause which might
have produced this dimunilion in
quantity, (namely, the pear approach
of the bed of the river to the Georgia
shore.) and secondly, the rumour
whieh has for some time prevailed,
that the present proprietors of Lot,
No. 12, Irom their apparent neglect of
it, were supposed not to be in posses
sion of good <s■ sufficient title,—and
thereby, from the circumstance of tho
lot being situated contiguous to h s
tract,connected with lhe foregoing rea
sons constitute his whole claim to it:
Common report affirms P H. Carnes
to be already in possession of a greater
number of aeres than his plat call*
for, without touching the Lot No. 12.
Judgment was obtained in the Fe
deral Court in 1816, against Major
George Walton, and possession of
said Lot No 12, given to the propril
tort by the Federal Marshal in April
last—This Lot is of eourse, still, as
heretofore, ottered for sale—General
warranty titles will be given to the
purchaser ; end if contested by P. H-
Carnes, who has not the shadow of a
title, he will he firmly opposed by
those who know how to estimate as
well as defend their rights.
