Harry S. Mausley, who are accused
of having tried to manufacture evi- 1
dence In the suit of Mrs. Frank J.
Gould for divorce, will know on Fri
day whether or not they will have to
face the grand jury on the charges
which Mabel MacCauslan brought:
against them. They put in their de
fense before Magistrate Corrigan yes
terday and as their chief witness call
ed Frank Gould himself.
For the first time yesterday the
actual specification charged in the
Gould suit for divorce was brought
/>ut when the defense had the com
plaint in the suit put in evidence.
The charge against Mr. Gould by his
wife is that he was guilty of improp
er conduct in a disorderly house in
North Sidney, Cape Breton, when he
was there on a cruise in the yacht
Helenite.
That was about the only thing of
Interest that the defense brought out
In its examination of Mr. Gould. Mag
istrate Corrigan refused to allow the
divorce cas e to be tried in his court,
and in this way nearly the whole of
the defendant's line of examination
was thrown out. The only thing that
Magistrate Corrigan would let them
prove was that Miss MacCauslan was
in the apartment of Bessie de Vole
at the time that the statement she
says she made to Mrs. Teal and Maus
ley declares she was.
This the defense could not prove
and so they tried to go on and show
that Gould had been in the apart
ments of Bessie de Voie. Here it
! was that Magistrate Corrigan stop
ped them. He said that a police court
was no place to try the merits of a
divorce suit and he would not allow
i It.
"Do you know Bessie de Voie?" ask
ed Mr. Smythe, who is Mausley’s at
torney.
"I do," replied Mr. Gould.
“Were you in her apartments dur
ing March last?"

Hart oblected and was sustained.
The defense argued that any evi
dence which might show that the
statement made to the detective hy
Miss MacCauslan was true, was ad
missible as tending to show that
Mausley thought that the affidavit
which she made was true.
The magistrate would not alloow It,
however, and almost every question
that the defemdant's lawyetr asked
was rulpd out by Magistrate Corri
gan. Mr. Smyth called a negro elr
vator boy of the Glenmore and tried
to get him to identify Mr. Gould.
Mr Goujd refused to arise to be
identified and Magistrate Corrigan,
would not make hint stand up. Mr. j
Smyth then took the boy around in
front of Gould, but the boy refused
to Identify him.
Thp hearing lasted until tl o’clock
last night, and took the place of a
roof garden for a number of speeta
tors. Berry Wall was there and there
were a number of women sight
seers.
TWO DEFENDANTS
WERE NOT GUILTY

Morning. Bob Ivey and
Benny Sharpton Escaped
Scotfree.
In city court this morning two of
! the defendants who stood trial for lar
ceny fanni the house were found not
guilty by the Jury. These were Bob
i Ivey and RenHy Sharpton, tried on
1 separate charges. The time consum
ed In the trials was twit a few min
utes In each case and the jury prompt
j ly rendered a verdict acquitting them.
| Richard Harley pleaded guilty to !

and will be sentenced Saturday.

Taft, as representative of the repub-!
lican party capitalism, to the ques-,
tion: "If a man is out of work and
has a family starving, what is he to
do?" answers, "God knows, I don’t.”
The Herald as representative of
democratic party capitalism, answers
this same question by denouncing the i
man who asked it as a fool, and by j
stating that a man with a family has i
no business to be out of work. We i
are here reminded of the proverbial
lawyer who abused the client since j
he had no case. Indications from
your reply to the question, Mr. Edi- (
tor, are that your case is very weak.
No man. and not even the demo-!
cratic party, can silence this question
by crying out fool to the man who j
asks it. It is the question of the
hour, and it will continually confront
the two capitalist parties, no matter
how much they ostrich-like put their
petrified heads into the sands of
"tariff reforms” to hide from the real
issues. “When a man is out of work
and has a family starving what is he
to do?" When a man is working tn
some mill at starvation wages what
does he do? He puts his wife and
! little children to work in the mill in
an endeavor to improve his desper
ate condition—children that should be
in school. We see little children hud
dling around the factory gates, the
poor little things whose bones are
not yet hard. We see them clutched
from the hearthstone, taken from the
family altar, and carried to the bas
tiles of labor and their little bones

i some aristocratic Jezebel. If Taft,
when asked the question could have
thought of the beneficlent administra
tion of the Bryanite party of Georgia,
he could have advised the unemploy
ed man to sell his little children into
mill slavery to keep himself from

elected, would improve industrial con
ditions for we all well know what is
being done for the working people
by his followers who have charge of
the legislative, judiciary and execu
tive departments of such democratic
states as Georgia and Alabama.
Pat McCarren and Roger Sullivan,
the noted election crooks, gamblers
and traction thieves, who at Denver
convention placed Bryan at the head
of their party again, they also, of
course, expect such Improvements in
industrial conditions if Bryan is elect
ed. that agitation for improvement
will thereafter be unnecessary.
We cannot have things much bet
ter under the rule of Bryan with th#

man with a family needs not be out
of work. You say there is always
work for a man to do who really
wants work. Do you mean to assert
that the six millions of unemployed
do not wans work? Then, like our Bon

Yes, the question referred to was
asked Taft by a socialist, and the
socialist platform alone answers the
question in its first demand as fol
lows :
“I—The immediate government re
lief for the unemployed workers by
building schools, by reforesting of cut
over and waste lands, by reclamation
|of arid tracts, and the building of
ranals, and by extending all other
useful public works. All persons em
ployed on such works shall be em
ployed directly by the government un
\ der an eight-hour work day and at
the prevailing union wages. The gov
ernment shall also loan money to
states and municipalities without in
terest for the purpose of carrying on
i public works. It shall contribute to
the funds of labor organizations for
the purpose of assisting their unem
ployed members, and shall take such
' other measures within its power as
will lessen the widespread misery of
the workers caused by the misrule of
j the capitalist class.
