HAVING purchased the estate of Wil
liam Fuxwf.ll, deceased, from the
heirs, Edward Poxwell and Allen Nichols,
the husband of Kisiah Foxwell, the only
heirs, and they reside in Caswell counvy.

into peaceable possession ; John M‘Wade.
being executor to the will of said Foxwell,
swore 1 broke open the doors of the da el
iing li.'iise of said deceased, and took for
cible possession, bad me taken, and 1 was
confined sixteen days before 1 could call
the attention of the Honorable Inferior
Court; before them I proved (got into
peaceable possession, and was relieved by
that tfstimony from my confinement;
Esquire M‘Wa<Je told several persons he
would have me taken again; if he does,
my request is, that he may be more par
ticular in nis next oath, for in the first, he
was in or near Savannah at the time I took
possession, and without his coming to see
if j was in possession, swore I was, and
Jiat 1 broke locks io do to (unless he
came by night) and if by night he saw me
in possession; I know not how he swore
w hat he has, for there never was a lock,
holt or latch to the doors since I knew the
house, and I do not believe there ever
was since the building of the house; tin
tact is, Esquire M‘Wade designs keeping
the property until the law relieves him of
that trouble which I believe he will be
sorry so hope the clerk will be parti
cular in keeping M'Wade’s eatn until the
silting of the next Superior Court.

RULE NIS(
UPON the petition of Roberts Thomas,
stating that he was possessed of a
certain bond given by one Henry Hughs
in his life time t« said Thomas, under the
penalty of 5 hundred dollars, with a condi
tion thereunder written, and to be void of
the said Henry Hughs, shall make and
execute good and sufficient warranted ti
des to a certain tract of Land lying and
being in the county of Burke, containing
two hundred and fifty acres adjoining lands
of Hell and Walton, and bearing date on
the 12th day of December 1810, a true co
py of said bond as nearly as can as recol
lected by said Thdmas is annexed to said
petition and filed in the clerks office to
gether with such other evidence as the
said Thomas has, and the said original be
ing destroyed. It is therefore ordered that
the said Copy of »aid bond annexed to said
petition be established in lieu of the ori
ginal so destroyed, unless good pause be
shewn to contrary on or before tht first day
of the next term of this Court. And it is
further ordered that a copy of this rule be
published in one es ihe public Gazettes of
this State once amonthuntil the next term
