THIS INDENTURE, made and ex
ecuted this nineteenth day of

the city of Augusta from springs, or
streams, or other sources, in the neigh
borhood of said city, the'City Council of
Augusta hath given and granted, and
doth l>y these presents give and grant,

associates, the full and complete right
and privilege of bringing and introducing
waters into this city from the (Savannah
river, or any of the neighboring springs,
Which said water, is to be, and may be
1 brought into tliis city, through pipes or
conduits of wood, iron, clay, or any other
substantial material: and the said right
ami privilege is hereby granted to the
said 'fhomas MeGran and Ids associates,
their executors, administrators, heirs and
assigns, fi»r the space and term of twenty
five years, from and utlertho signing and
1 delivery of these presents, and to the en
tire exclusion of ali uiul every other per

And the grant of the right and privi
lege aforesaid, by the City Council of Au
gusta, is hereby declared, consented, and
agreed to he upon the conditions follow
ing, to wit;—That the said Thomas Mc-
Ginn, and I is associates, shall bring wa

pure, good and wholesome, into the body
of said city to wit; at the Market-House

struct and keep in repair under the super
intendence ofthe City Council of Augus
ta. a number of hydrants or fire-plugs,
which shall he for the use of the said city
of Augusta in cases of fire or conflagra
tion, and shall always he supplied with
! wafer by the said Thomas IMcGran and
his associates, free of any charge or ex
pense whatever to the said city, saving
and excepting, nevertheless, ail accidents
which may he unavoidable. That the
supply of said water shall he regular and
without intermission, and shall not fail
for a period longer than thirty days, eith
!• er for public or private use, and upon the
1 failure ofthe said water, the said Thomas
1 IMcGran and his associates shall ami will
forfeit, to each and every purchaser ofthe

the City Council of Augusta, upon com
plaint ofthe person or persons aggrieved,
unless If shall appear, after due investi
gation, that the said failure or intermis
sion of the water was unavoidable by
reason of some accidental disordered
state of the pipes, or conduits, or other
j cause which could not have been preven
, ted, by ordinary caution and diligence.
* That at the conclusion of the twenty
| five years aforesaid, the said water works
C shall belong, (with the exclusion of the
. soil which they may occupy, and which
1 may be the property ofthe city or not the
, property of the said Thomas IMcGran
and his associates,) to the said Thomas
, IMcGran and his associates, but ifthe said
j should desire to own and
possess the said water-works at the time
} last mentioned, then the said City Council
, shall take and possess the same, paying
f therefor to the said Thomas IMcGran and
his associates, the just ami full value of
the same, which said value, shall he as
certained by u relerencc to five distin
guishes! persons, two of whom shall be
chosen by the said Thomas IMcGran and
his associates, two others by the said City
Council of Augusta, and the fifth to be
chosen by these four persons, selected as
aforesaid. Provided, that nothing here

vent the renewal of this contract! or the
execution ol any other contract, between
the said City Council of Augusta, and the
said Thomas IMcGran and his associates,
and their heirs and legal Representatives,
should the parties think proper to renew
the said contract, or to e ecute Knottier.
And the said Thomas IMcGran and his
associates shall not charge more than
twelve dollars per annum to oieh and
every family living on Broad street in
said city, for the use and purchase of the
said water, and it is hereby, consented
and agreed that a family shall be estima
ted, to consist of not more than ten per
sons, but when there are more than that
number actually be lapsing, to any family,
then the charge f r flu use of the said
water, may be greater than the said a
mount, but hearing, nevertheless a pro
portion thereto. And it is further con
sented ami agreed, that there shah be ex
cepted from the last mentioned regula
tion all dyeing establishments. Brewer
ies, Inns, Taverns. Houses of Entertain
ment, Public Stables, and Manufactories,
with the keepers, owners, or conductors
of which, the said Thomas MeGran and
his associates, shall he at liberty to eon
tract as may he mutually agreed between
each party. And lastly that n refusal on
the part ofthe said Thomas MeGran and
Ids associates to deliver water to any
person or persons who live on Broad
street in said city, and is ready and wil
ling to pay for the same according to the
rate hereby and hereafter to he establish

consider it practicable to deliver the wa
ter. shall he held and considered an of
fence against the good order of the city,
and for each and every such refusal, tin

may he fined by the said City Council in
a sum not exceeding fifty dollars. Ami

agreed, that all and everj person, or per
sons purchasing the water aforesaid, slniii

FRANKLIN COLLEGE.
THE Faculty of Franklin College pro
poses giving a prize, ofthe value of about
ten dollars, in appropriate and well se
lected hooks, to the best Latin Scholar,
and another to the best Greek Scholar,
who shall enter the Freshman Class next
August, for a regular course. The names
ofthe young gentlemen thus distinguish
ed, At ofthe Teachers hy whom they were
educated, will also he made public, that a
laudable emulation may he excited,
nnd the standard of Literature raised
throughout the State.
The Latin prize, however, will not
he given to any who shall not manifest,
1 on examination, a thorough knowledge
' of at least, Jacob's Latin Reader, both
I vols. Cteaar’s Commentaries, all the wars
in Gaul. Gould's Ovid, the whole of

AT u period like the present, when ino
Science of Music stands so high in pub
lie estimation—forms so important a lea
tore in education—takes so prominent c
part in the amusements of good society—
and constitutes a part of the holy ofiicev
of the church; it is no less a matter of
surprise than of regret, that its interi st;<
should remain destitute of those power
ful auxiliaries by which the love of litera
ture is so nobly upheld, and its \ iews are
so extensively promoted. In every 0i1.e.-
science there now are public channels for
the communication of knowledge, in
which the professor can offer his specu
lations, or discuss those of others, and
th • student can meet with information
and suggestions which might otherwise
escape him. The general progress oi
science, we think, demonstrates that they*
have been ofessential service in the pro
motion of discovery, & the advancement
of learning. Hut Music is without any us
sistaacc of the kind in this country; and
why should this he? Why should' an art
so divine, and which affords so spacious
a field for the display of' genius, be de
prived ofthut literary support which hau
been so liberally extended to others not
more deserving of it?
The friends of Music in this country
arc united in saying, that a periodical,
devoted to the interests of Music, is imicL
wanted. And as the time has now arri
ved, when such a publication woiu.i re
liably receive support, the subscriber,
seeing no one disposed to enter upon t.io
project, deems himself justified in nvA.-.mg

of musical works, particulars of all kinds
of musical entertainments, critiques on
performances, and a variety of ether
musical information, will constiute tho’

From two to four pages of each number
will be occupied by new, popular, or ori-'
ginal Music, arranged for the Vince, tiir>
piano-fort*', or the organ, and occasion
ally for the flute, violin, clarionet, .aid

men who are advantageously known to
the public through the medium of then?
musical productions.
Besides the Music and musical infor-*
mntion to be furnished by this paper, it
