their Plenipotentiaries, at Washington,
on the lirst day of Way, one thousand
eight hundred and twenty-eight, which
i reaty, being in the English and French
languages, is word for word, as follows:

Article I,
'flare shall he between the territories

tion. The inhabitants of (heir respective
States shall, mutually, have liberty to en
ter the ports, places, and rivers of the
territories of each party, wherever for
eign commerce is permitted. They shall
he at liberty to sojourn and reside in all

Prussian vessels arriving either laden

All kind of merchandize and articles of
commerce, either the produce of the soil
or the industry of the United States of
America, or of any other country, which
may he lawfully imported into the ports
of the kingdom of Prussia, in Puissian
vessels, may. also, he so imported in ves
sels of the United {Stales of America,
without paying other or higher duties or
charges, of whatever kind or deiiomina
tion, levied in the name, or to (he prullt of
the government, tin* local authorities, or
of any private establishment whutsouv
er, that ifthe same merchandize or pro
duce hail been imported in Prussian ves
sels. And, reciprocally, all kind of mer
chandize and articles of commerce, ci

Article IV.
To prevent the possibility of any mis
understanding, it is hereby declared that

preceding articles, arc, to their full
extent, applicable to Prussian vessels,
and their cargoes, arriving in the ports
of the United .States of America; and,re
ciprocally, to vessels of the said {States
mid their cargoes, arriving in (lie ports

An exact reciprocity shall be observed *
ia the ports of the kingdom of Prussia,
so that all kind of merchandize and nr
tieles ol commerce, either the produce
oflhe soil or the industry of the said
kingdom, or of any other country, which
may ho lawfully expot ted from Prussian
ports in national vessels, may also be ex
ported therefrom in vessels oflhe United
Stales of America, without paying other
or higher duties or charges of whuleveg
kind or denomination, levied in the name,
or to the profit of the Government, the
local nuiliorities, or of any priv ate estab
lishments whatsoever, than if the samo
merchandize or produce hud been ex
ported in Prussian vessels.

The preceding articles are not appli
cable to the coastwise navigation ol’ Iho
two countries, which is respectively, re
served. by each of the high contracting?
parties, exclusively, to itself.
Article VIII.
No priority or preference shall he giv
en, directly or indirectly, by cither of the
contracting parties, nor by any compa
ny. corporation, or ngent, acting on their
behalf, or under their authority, in the
purchase of nay article of commerce,
lawfully, imported, on account of, or in
reference to, the character of the vessel,
whether itheof the one party, or of th«
other, in which such article was import
ed; It being Iho true intent mid meaning
oflhe contracting parties; that no dis
tinction or (lillemicc whatever, shall bo
made in this respect. .
Article IX.
If either party shall, hereafter, grant to
any other nation, any particular favor in
navigation or commerce, it shaft, imme
diately, become common to the other
party, freely, where it is freely granted to
such other nation, or on yielding the
same compensation, when the grant is
conditional.
Article X.
The two contracting parties have
granted to each other the liberty ofhuv
ing, each in the ports of the other, Con
suls, Vice-Consuls, Agents uml Commie*
’ saries of their own appointment, who

derstood, that this species of judgement
or arbitration slnill not deprive the con
tending parties oft he right they have to
resort, on their return; to the judicial au
thority ol their country.
Article XI.
The said Consuls, Vice-Consuls, nml
commercial agents, arc authorized to re
quire the assistance of the local authori
ties, for tlie search, arrest, and imprison
ment of the deserters from the ships of
war and merchant vessels of their coun
try. Uor this |Hir|n)se they shall apply
to the competent tribunals, judges, and
olllccrs, and shall in writing, demand
said deserters, proving, by the exhibition
of the registers of the vessels, the rolls of
the crews, or by other official documents
that such individuals formed part of the
crews: and, on this reclamation being
thus substantiated, the surrender shall
not he refused. Such deserters when
arrested, shall he placed nt the disposal
of the said Consuls, Vice-Consuls, or
Commercial agents, and may be confin
ed in the public prisons, at the request
nml cost of those who shall claim them,
in order to lie sent to the vessels to which
they belonged, or to others oft he samo
