AN ACT
To prohibit the importation of Jlavti into
any po rt or place 'within the jurifdidion
of the United Mtates , from and after the
JirJi day cj January , in the year of our
Lord, One thousand eight hundred & eight,

Sec. 7. And be it farther evaß ed, That
if any (h>p or velfcl (hall be found, from and
after the (irk day of January, one thousand
eight hundted and eight, in any river* port,
bay, or harbor, or on the high fcas, with,
in the jimldiftional limits of the United
States, or hovering on the coast thtieof,
having on *oard any negro, mulatto, or
perlon of color, tor the purpose Os felling
them as Haves, or with intent to land the
fame, in any port or place within thejurif*
diction cf the United States, contrary to
the prohibition of this aft, every such (hip
or veil'd, together with her tackle, appa
rel, and furniture, and the goods or effefts
which (hall be found on board the fame,
(hail he forleitcd to the ufc of the United
States, and may be ieized, profecutcd, and
condemned, in any court of the United
States, having jutifdiciion thereof. And
it thall be lawful (or the preSident of the U.
States, and he is hereby authorized, (hould
he decaf it expedient, to cause any of the
aimed vtffels of the United Slates to be man
ned and employed to cruise on any part of
the coal! ot the United States, or territories
thereof, where he may judge attempts will
be made to violate the proviltons of this
act, and to inrtruft and direst the com
manders of armed vdfels cf the U, States,
to seize, take and bring into any port ot
the United States all such (hips or veffels*
and moreover to seize, take and bring into
any port ot the United States ail ihtps or
vefleis of the Uriled States, wherefeever
found on the high leas, contravening the
proviiions ot this ait, to be proceeded
againit |mcoiuing to law, and the captain,
matter, ot commandei ot every such (hip ui:

tween the United States and the officers and
men who (hall make the ftizure, take, or
bring tha fame into any port or halbot for
condemnation* whether the fcifcurobe made
by an armed vtflcl cf the United States* or
revenue cutters thereof, and the fame (hall
be diftribited in like manner, as i.) provided
by law, for the distribution of prices taken
from an enemy : Provided, That the offi
cers and men, to be entitled to oic half of
the proceeds afotefaid, (hall fafe keep every
negro* mulatto* or per fun of colour, found
on board of any (hip or vessel, fp by them
seized, taken, or brought into pirt for con
demnation* and (hail deliver every such
negro, mulatto, or person of colour, to
such person or persons as (hall bfc appointed
by the refpeftive dates, to 'receive the
fame; and if no such person or persons (hall
be appointed by the refpeftive dates, they
(hall deliver every such negro, bmlatto, or
person of colour, to the overfeed of the popj
of the port or place where such (hip or vcf
fel may be brought or found, arid (hall im
mediately transmit to the governor or chief
magiflrate of the date, an accounjt of their
proceedings* together with the biimber of
such negroes* raulattoes, or persons of col
our, and a defcripnve lid of the fame, that
he may give direftions refpefting such ne
grocs, malattocs, or persons of colour.
Sec* 8. And be it further ena&ed, That
no captain, matter, or commander of any
(hip cr vessel, of less burthen than forty
tans, (hall, from and after the firft day of
January, one thousand eight hundred and
eight, take on board and transport any ne
gro, mulatto, or petfon cf colour* to any
port or place whatsoever, for the purpose
of felling or disposing of the fame ss a (lave,
or with intent that the fame may be fold ot
disposed of to beheld to Service or labor* on
penalty of forfeiting for every such negro,
mulatto, or person of colour, so taken on
board and transported as aforefaid, the sum
of eight hundred dollars j one moiety there
of to the use of the United States, and the
other moiety to any person, or persons,
who (hall sue for, and pfofccute the fame to
effeft 5 Provided, However, that nothing
in this feftion (hall extend to prohibit the
taking on board or transporting on any ri
vet, or inland bay of the f«a r within the
jurifdiftion of the United States, any negro,
mulatto or person of colour, (not imported
contrary to the provifioaa of tfui aft) in any
veflcl or fpccics of craft whatever.
Sec. g, ind he it further enafied, That
the captain t maftcr, or commander of any
(hip or veflcl of the burthen of forty tons
or more* from and after the firft day of
January* one thousand eight hundred and
eight, failing coaftwife* from any port irt
the United States* to any other port or placO
within the jurifdiftion of the fame, having
on board any negro, mulatto, or person of*
colour, for the purpose of transporting them
to be fold or disposed of as Haves, or ta
be.held to service or labor, (hall* previous
to the departure of fech (hip or Veflcl, make
out and fehfcribe duplicate manifefts of
every such negro, mulatto, or person of
colour, on beard such (hip or veflcl, therein
fpeeffying the name and sex bf each person,
their age and feature, as near as may be,
and the dal's tb which they refpcftively
belong* whether negro, mulatto, or person
of colour, with the name and place of re
fidcnce of every owner, or (hipper of the
(time* and (hall deliver such manifefts tb
the collector of the port, if (here be one,
otherwise to the surveyor, before whom the
captain* maftcr or commander, together
with the owner* or Ihippcr, (hall fevcrally
fwcar or affirm, to the bell of their know!,
edge and belief* that the perfehs therein
fpecified were not imported Os brought into
the United Slates* from and afti r the firft
day of January* one thousand eight hundred
and eigh», and that unde* the laws of the
date, they are held to fcrvic6 or labor g
whereupon the said colit dor or surveyor
(hall certify the fame on the laid manifefts*
one of which he (hall return to the said cap
tain, maftcr, or commander* with a permit
fpicifying thereon the number* name*, and
general delcriptiou bf such perfons* and
authorizing him to proceed lo the port of
his destination. And if ahy (hip or teffel*
being laden and destined as aforefaid, (hall
depart from the port Where (he may then
be, without the captain, mafier* or com.
raarder* having firft tnade out and fubferibed
duplicate maniteft.*, of every negro, mulatto*
a»d i>erfen of colour, on board such (hip o*
veflcl* as aforefaid, and without having
pievioufly delivered the fame to the said
colleftor or furveyor* and obtained a permit,
iii manner as herein required, «r fliall pre
vious to her arrival, at the port of her
destination, take oh board any negro,
mulatto* or person of colour* other than
thofc (pecificd in the manifefts* as aforefaid,
every such fliip or veflel* together with her
tackle* apparel and furniture, lhall be for
feited to the ufc of the United States, and
may be seized, brofeculed and condemned
m any court of the United States* having
jurifdidlion thereof j and the captain, mai
ler, or commander of every such (hip or
veflcl, (hall moreover forfeit, for every
such negro, mulatto, or perfep of colour,
so traniported, or taken on board, contrary
to the piovifions of this aft, the sum of one
thousand dollars, one inoicty thereof to the
United States, and the other mbiety to the
use of any person or persons who (hall fed
lor, and profccute the fame toefleft.
Sec. 10. And be itfurther enafted, That
the captain, tuafler, or commander of every
(hip or veflcl*" of the burthen of forty tons
or more, horn and after the firft day of
January, one thousand eight hundred and
eight* failing coaftwife* and having on
board any negro* mulatto, or person o£
colour, to fell or dispose oi as Haves, or to
be held to service, or labor* and arriving
in any port within the jurifdiftion of the
United States, from any other port withiri
the fame* (hall, previous to the unlading
or putting on (hore any of the persons afore
faid, or feffering them to go on (hore, de
liver to the colleftor, if there be one* otf
if not, to the surveyor refidihg at the port
of her arrival* the manifeft certified by tho
colleftor or surveyor of the port from
whence flic failed* as is herein before direc
ted, to the truth of which, before such
officer, he (hall fwcar br affirm, and if the
colleftor or surveyor (bill be fatitfied there,
with,' he fliall thereupon grant a permit fo*
unlading or feffering fech negro, mulatto,
or peifon oi colour, to be put oft (hore, ancf

any feCh (hip or vessel being laden as afore
