fifty-nine, Ebenezer H. Svvinney conveyed to Joseph
S. Smith, that lotor parcel of land, situated,, lying
and beingin the city of Albany, county of Dougherty
and State of Georgia, and known and distinguished
in the plan cfsaid city as lot number eighty-two, on
State Street, contajning one- acre, more or less, fbV
the purpose of securing the payment of a certain
proroisory mHe, made by the raid EbenezerH.Swin-
ney, payable to the order of said Jnsejih 8. Smith,
dated on the eighteenth day of May, eighteen hun
dred and fifty-nine; and due two’ years after dale, for
