between the two countries in the !a*i few years, no ‘
one can be more convinced than yourself. It is tljen !
with unfeigned regret that the President finds himself
unable to recognize the validity of a demand, a com
pliincu with which you deem so rnatciial to the pres
ervation of the goo I understanding which has been
hitherto manifested between the two countries.
T* o jurisdiction of the scveial hippe* which consti
tute the Union is, within its appropriate sphere, per
fectly iodapciident ol the Federal Government. The
ollfOlce with .vlucli Mr. McLeod is charged was com
mitte l within die territory, and against the la vs and
citizens of the Slate of New York, and is one that
co re's clearly within till! competency of her tribunals,
It does, not, therefore, present an occasion where,
undei the Constitution and laws ofthe Union, the in
terposition called for would lie proper, or tor which a
warrant can be found in the powers w:th which the
Fcdetal Executive is invested, Nor would the cir
ctiui-lances to which you have referred, or the reasons ,
you have urged, justify the exertions of such a power,
if it exiato I. The transaction out of which the ques
tion a rises, presents the case of a most unjustifiable ;
invasion, in time of peace, of a portion of the territory
of the United States, by a band of armed men from the
adjacent territory of Canada, the forcible capture by
them within our own waters, and the subsequent de- |
structiotr ol ashamboat, t lie property of a citizen of
lire Unite I Slates, and the murder of one or more A
merican citizens.— If arrested at the t ime, the offenders
might unqostioiishly h ive been brought to justice by
the judicial authorities of the State w ithin whose ac
knowledged territory these crimes were committed;
nnd their subsequent voluntary entrance within that
territory places them in lire same situation. The Pres
ident is not aware of any principle of international
law,or, indeed, of reason or justice, which entil'cssucl)
offenders to impunity before the legal tribunals, when
coming voluntarily within their independent and un
doubted jurisdiction, b -cause they acted in obedience
to their superior authorities, or because their acts have
become the subject ofdiplomatic discussion between
the two governments. These methods of redress, the
legal prosecution of the offenders and the application
of their government fir satisfaction, are inJepenileiil
of eaeli other, and may he separately anil simultaneous
ly pursued. The avowal or justification of the out
rage hy lire British autlmtiiies might he a ground of
complaint with the government ofthe United JStates,
distinct from the violation of tho teriitory and laws of
tile (State of New \o k. The applicate.n of the Gov
ernment of the Union to that of Great Britain, for the
redress of an authorized outrage ~f the peace, dignity
and rights of the U. States, cannot deprive the State
of New Yoik of her undoub'e.l right of v indicating,
through the exercise of iter till: ill power, the proper
ty and lives of her citizens. You have very properly
regarded the alleged absence ol Ml. McLeod from the
■erne of the offere e at the time when it was committed
as not material to the decision of the present question.
That is i matter to he dev ijed by legal evi l nee; and
the sincere desire of the President is, that it may hr
satisfacln:ily established. It tile i’-tru'tiou of the

which has taken eagnizitic” of the olDnce. with which !
Mr. McLeod is charged, to decide upon i;- validity j

MONROE RAIL ROAD BILLS.
It seems to us that holders of Monroe R. 11. Bills j

flattering ami commendatory, and can endorse them to
a great extent on seeing it. YVe shall therefore rerorve

tlint we discover the work is stereotyped.— YVe are
sorry for this, while it contains such an unfavorable
notice of the ( bailee for good entertainment at the
Rock Mountain, It certainly seems to us impolitic
to stereotype into immortality an indifferent tavern
keeper—such an object is too emphemeral in its dura
tion ; and three months may have wrought a favora
ble change. The grandeur of the immortal mountain,
should have been the only object of this part of the
work. YY itli regard to tiiis plate we would also remark,
that riiuch of the stupendous and overwhelming gran
deur of the object is lost by the view being taken from
the tame side of the mountain. Tiie hold front of the
Northern brow would have presented a mucli more
interesting picture. There then could have been much
less question, whether the view was taken at five or
eigiit miles distance, or on the very base of the moun
tain,
OCML'LGEE AND FLINT RIVER RAIL ROAD.
It will probably tic a matter of news to most of our
readers to learn the name and location of the project of
such a work ; and, also, that it is in a fair way to be
carried into actual being ami existence. There ha*
been granted, a Charter for a Rail-Road from Albany,
Baker County, on the Flint River, to tiie Oemuigce, in
Irwin County. YY'e can inltym those ignorant on this
subject, that tiie Company lias been formed—all the
Stock taken —and tiie Road surveyed and located, and
tiie work ready to he commenced. The route, as might
be anticipated, is very favorable. The w ork is to ter
minste on the Oemuigce, at Mobley's Bluff, a short
distance above Jacksonville. The length nf the Road
will lie seventy-six miles. It is proposed, to complete
it for present use with wood laiis, anJ for horse power
only. Fliiscan t c done at a very moderate expense;
and as business may increase, locomotive power may
be introduced. The region of country it will connect
with our cities on the Atlantic coa-4, i* fertile and pro
! ductive of our great staple ; and it will tend, to a great
extent, to concentrate trade, and provide a market fer
out p oiiuce, within our own borders, which, heretofore
lias found one in another Stitc.

article referred to, will he gathered from them.) As
it is a matter of materia! importance, to those immedt- j

The above is taken from the last Macon Messon
uer. We know not the reason, yet il is nevertheless
true, as asserted ly Gen. CiiiTin. that ** the notes of
the Monroe Kail Koal 13-ink have been iejected by a!!
the Banks,” with hut few exceptions. It hits appear*
ed to us I hat there h.s been, an \ still i* on the part of
some, an unwarrantable opposition to the whole enter
prise over which Gen. Griffin presides. No man in
the Slate ol Georgia his more reputation lor perseve

stand, aa ready to resume as any ol icr, and a* able to
sustain itself. Indeed, our information is such as to
leave no doubt that the bank can and will sustain itself
triumphantly.—There are many banka in the &tto j

hii emergency sustain themselves as well. Homo time
j since* great doubts were entertained of its so Ivency, j
i hut these art now dis ipatrd, so far as we can learn in i
this section of lhe country.
It gives us pleasure to announce thi* fact, as no 1
greater calamity could befall Western Georgia, than
tin* prostration ol that ILmk ind the consequent injury
that the Koail would sustain. It is all important to
this section of the * s tat . and is a matter of no little mo
