pany, on the second day ol

Arthur B Davis, Robert Collins, and Flam Alexander,
to make and coirtpleie the Kail Road ol suid Company
from Gridin to it* junction with the {State Road in De-
Kalb county, in aujd Mate, and to furnHi engine**, earn,
and all other appurtenances therefor, and for which said
Company bound theiuaelvca to pay three hundred
thousand dollars.
Which contract under the hand and seals of the said
parties, among its other provisions, stipulated and pro
vided as follows, in substance: that the payment for
said work, machinery and materials, and other things, to
bo done nnd furnished, should be by said Company made
to the ether party in the following times nnd manner,
viz: that from and aifer the first day ol October ih*n
next, seventy-five per cent, of the net receipts of the
road alter deducting the yearly expenses, shall he paid
to the Haiti other party : said payments to be made
monthly, w hen there should be any excess of receipts.
Apd the said Monroe Kud-Koud and Banking Comps- I
