This muse came on to L? heard on the transcript of tin* Record from the Superior Court, of the county of Bibb, and was agreed by Counsel, W hereupon,it n*ron sidered, and adjudged by the Court, that the Judgment ofthe Court below he reversed on the following grounds: First.—Beqanee it is the opinion of this <*onrt, that the Rill holders had a paramount lien only on the F ind raised by the aide of the Railroad from Macon to Griflin, ana so much only of the Road from Griffin to the termi nus, in DeKalb, as was built by the Monroe Rail Road and Banking Company, prior to the 2d day of August, 1812. and that the Contractors of the second narf under the agreement of the 2d August, 1842, in the Record mentioned, had a prior and superior Fquily to the Bill holders to he paid out of said fund, in proportion to the relative value of the work done by them on said Road, and materials furnished between Griffin and the termi nus ofthe Rond, in the countv of DeKalb, nnd flint the Court below committed error in excluding said Con tractors from a participation in said fund to the extent of the relatiee ea/uc qf their claim for work and labor done, and rhateriulsandequipment* furnished said Road, between the city of Griflin and the terminus of the Road Jn DeKalb, ns aforesaid.
