The same Parties, > vs. > The same Parties ) By consent of the parties, in each of the above stated causes, by their respective Counsel, It is ordered, that the said two causes I* tried togeth er, and that the Judgment, and Order, and Decree of this Court, shall apply to and be binding in each case , and be so certified to Ine Court below. ‘l’ltis cause came on to he heard on the transcript of the Record front the Superior Court, of the county of Bibb, and was agreed by Counsel, Whereupon, it is con sidered, and adjudged by the Court, that the Judgment of the Court below be reversed on the following grounds: Fir*.—Because it is the opinion of this Court, that the BiH bidders had a paramount lien only on the Fund raised by the sale of the Railroad from Macon to Griffin, anti so much only of the Road from Griflin to the termi nus, in DeKalh, as was built by the Monroe Kuil Road and Rankin? Company, prior to the 2d day of August, 1842, and that the Contractors of the second part under die agreement of the. 2d August, 1842, in the Record mentioned, had a prior and superior Equity to the Bill holders to he paid out of said fund, in proportion to the relative value of the work done bv them on said Road, ami materials furnished between Griftin and the termi nus of the Road, in the countv of DeKalh, and that the Court below committed error in excluding said Con tractors from a participation in said fund to the extent of the relative value of their claim for work anti labor done, and materials and equipments furnished said Road, between the city of Griftin and the terminus of the. Road in DeKalh, as aforesaid. It is further the J udgtnent of this Court, that the rel ative value ol the work and labor done, and materials and equipments-urnished on said Rood, by said Con tractors, between the places last aforesaid, he apportion ed by three Commissioners to he appointed by the Couit below, with power to hear evidence, in relation thereto, nnd make report thereon within such time us to the said Court shall deem expedient. Second.—Because the Court below committed error in deciding “That the Bank Bills should take each in proportion to the value received bv the Bank for it at the time of its emission by the Bank.” It being the opin ion of this Court, that each Bank Bill should take in proportion to the quantum of consideration paid there for by the Itopler or claimant on the Fund, nnd that such holder or claimant should state the quantum of consid eration actually paid therefor, on oath, in writing, w ith the right of other contesting claimants for said fund to traverse the same.
