causes, by their respective Counsel,
It is ordered, that the said two causes be tried togeth
er, and that the J udgment, and Order, and Decree of
this Court, shall apply to and be binding in each case,
and be so certified to the Court below.
This cau.-e came oc |o be heard t.n the transcript of
the Record from the Superior Court, of the county ol
Bibb, and was agreed by. Counsel, V\ hereupon, it is con
sidered, and adjudged by the Court, that the Judgment
of the Court below be reversed on the following grounds:
First.— Because it is the opinion of this Court, that
the Bill holders had a paramount lien only on the Fund
raised by the sale of the Railroad from Macon to Gridin,
anq so much only of the Road from Griflin to the termi
nus, in Dekulh, as was built by the Monroe Kail Road
and Banking Company, prior lo *)te 2d day of August,
1842, and tlmt the Contractors of the second part under
the agreement of the. 2d August, 1342, in the Record
mentioned, had a prior and superior Equity to the Bill
lioldfrs lo be paid out of said fund, in proportion) to the
relative value of the work done bv them on said Road,
and materials furnished between Griffin and the termi
nus of the Road, in (he countv of Dekalb, nnd that the
Court below lommilted erior in excluding said Con
tractors from a participation in said fund to the extent
of the relative value of their claim lor work and labor
done, and materials and equipments furnished said Road,
between the city of Griffin and the terminus of the Road
in Dekalb, as aforesaid.
It is further tlie Judgment of this Court, that the rel
ative value ol the work and labor done, and materials
and equipments -urnifhed on said Road, by said Con
tractors, between the places last aforesaid, be apportion
ed by three Commissioner* to be appointed by the Crtuit
bejow, with power to hear evidence in relation thereto,
nnd make report thereon within such lime as Id the c-aid
Court shall deem expedient.
Second. —Because the Court below committed error
in deciding “That the Bank Bills should take each in
proportion to th** value received by the Bank for it at the
ime of its emission by the Bunk/’ It being the opin
ion of this Court, that each Bank Bill should Jake in
proportion to the quantum of consideration paid there
for by the Impler or claimant on the Fund, and t lint surli
holder otjMaimant should state the quantum of consid
eration uciuallv paid therefor, on oath, in wiitiug, with
the right of oilier contesting claimants for said fund to
