by law, for appointing a Commission, to sit in this
city, “ as soon as its provisions are approved and
ratified by the other contracting party, for carrying

LEGISLATION.
In a free state, where good emls only afe
to be sought, and good motives ot-ly a.e to
ho presumed, Legislation may lie erroneous
hut it will he pure. Defective laws will oc
casionally be enacted, because those causes of
crior which an'et l individual conduct, neces
sarily extend themselves to assemblies ol i.r-
d. v.duals. The fruitful source of error is in-
attention, anti consequently ignorance. In
attention inevitably accompanies hurried
and tonfused action, and thus is marred tlfe
d<lil-trivive character of a Legislative Body.
Not that there, may not be. tou much procras
tination in det'isi.in, as has certainly been
seen in some places; but this would he the
safer trrot than ait extreme tapidity of
thought ami of notion, where the highly
gilted o( lieavi n can keep pace with the dis
cussion. Win to you have not time to ex
amine for yourself—wherean imaginary, but
tit truth, tin impassable limit is placed to thu
peiiuii of Legislative Session, and thete is
an obvious irksomeness to listen to any de
bate which may endanger that desited re
sult, it nccessarilly follows that you must
confide in somu one whom you may deem
hi tter acquainted will, the subject than your-
self, and your vote will he either pro or ci tv
as you may estimate the author or the op-
poser of a measure. Thus many things are
taken on faith and Icfiislatorj virtually en
dorse Ihe opiu ions < j’ each olhei.
This mutual confidence is proper where it
cannot he avoided ; as where a local evil re
quires a local and specific remedy,and where
the means of information are necessarily
confined to a few of the members. But in
the formation and application of general and
universal rules, no such practice should ob
tain. There are none who will hesitate iu
denouncing that Legislation which affects
the whole to relieve a purl, or which founded
on an individual wrong would amercea whole
community. Vet partial evils are most apt to
suggest themselves to individual reflection—
while the w hole are rarely found attentive to
the general good. Laws will therefore al
ways be proposed, arising from the best mo
tives, but in their application, although ben-
eficial in a solitary instance, ruinous iu a
general point of view. And it w ill not Le
unlikely that some or many of these will pass
If the discussion be limited to a very slin*t
period, any attempt to protract which is un
fortunate and odious.

fied than by the practice oftho Congress of

Legislature of this Slate, where three data

difficulty was that you would forget the ques

cur, that the votes which you have honestly
given become the source of regiet and paiR.
The time of a Legislative Body should bo
employed only on important topics. It ought
not to be allowed to members to brtt g in
lulls of their own accord and subject tile
Legislature to the gratuitous and profitless
discussion of propositions, sometimes crude)
and immature. The prim tpleufthelaw de
sired, should he distinctly stated ; and if it
he adopted by the Ilohse, they would direct
its incorporation into a bill to be drawn,
which would thus be introduced with a fair
title to notice. The subjects of debate would
thereby become more select— would be bet
ter understood, and more maturely perfected.
This course would be an amendment to the
mode of proceeding at Columbia, fur it is
well kuown, that although leave is asked to
introduce a bill, it is merely pro forma, and
the introduction follows as a tiling of coutsc.
To these theoretical sources of error may
be added a radical one in practice. It is
wrong to give a member his pay bill (unless
he have special leave of absence) until the
Legislature has concluded its session. Mem
bers frequently leave Columbia on the morn
ing of the day fixed for adjournment, relying
that every tiling will remain as they left
it and forgetting that every thing is uncer
tain which is not complete. It is melan
choly, hut it is tiue, that udvan age has beet)
taken ol litis improper confidence of mem
bers in their absence, and every salutary act
itas been endangered. These remarks have
no peculiar reference to the last Session nt
Columbia, although s'riclfy Applicable to it.
The fact is well known to all convetsan;
with our Legislative proceedings, and has
excited equal alatui and sorrow. We will
illustiate it. The two houses by joint reso
lution agree to adjourn at 12 o’clock on a
particular day. It is possible, and it is cus
tomary, that the engrossing and enacting the
laws may require them to remain several
hours later. It is competent for either
House, containing a quorum, to detain the
