deprecated by every citizen who values tSr

meet in one Electoral College ; dropping
the lowest candidate until the election lias
been consummated ? l >r, if the tenacity of
the small sf:it”s should defeat either oftho
modes (w h cli have so many advantages to
recommend them.) cannot the plan of Mr
Stephenson l»t* adopted, referring the idee
tiou to the State Legislatures, but luiutin

We s riously, fear, however, thal 2-3ds of
both houses will In tilde to settle down upon
no amendment to the Constitution: that
every plan of reform will In* defeated, and
that things will go on ns they have dotio
and the election be still referred to tlie If. of
R voting as states with ull tiro objections
that may be made both to their rating at all
for the Piesident, A til** present wanner
their voting The ruling members of the
administration will oppose any amendment
at nil ; under the persuasion that the Con
stitution a« it is is a very “ safe precedent."
But, if every attempt to amend it lm una
vailing, thru it becomes a serious and most
imp*.t>int question, whether those Slates
which disliked an appeal to tlie Il.ofK will
not fall upon some lair plan to move togeth
er, sorno mode of selecting a particular can
didate on whom to bestow their votes ; and
thus supercede the necessity of an appeal to
the II. of K. winch so large a majority of
that body, and winch the common sense of
the mass »■(’ their fellow citizens lias so
strongly comb mood —[Rich. Tnquticr
manner : those which have produced two
• rung shoots of equal vigor, must be rut
down to three eyes each, bearing in mind
to rub off the lower onu ; but in such us
have a strong shoot nnd a weak one, cut off
the weak one altogether, and leave four
oyos to the strung shout, in order to have
wood against the surcoedimr yenr.
In the spring ofthe third y>ir, the ground
should be again worked as before, between
the vines; and two stakes, from one and a
half to two inches square, and six or seven
tent high, should be placed to each of the
vines that have two shoots at such n distance
on each side oftho plant as will admit of
the shoots being fastened thereto. The
shoots should be drawn out on each side o.
tbu stakes, so as to make an angle of forty-
five degrees with the stem : but by no means
should they he bent down horizontally, ns
is by some practised, for the branches lying
too nuttr the earth are generally injured by tin
damps, especially when they b«ve fruit;
which is never so well tasted, nor so early
ripe upon those branches as when they ore
more elevated.
lu tlm mouth of May when tho vinos bo-
giu to shoot, they must bu attentively look
ed over, and all weak dangling shoots car-
fully rubbed off us they are produced ; and
those shoots that are produc ed fVoin strong
eyes should be fastened to the stakes, to
prevent their being broken off by the wind.
This management should he repeated at
least every three weeks, from tho middle of
May to the end of July ; bv which mean*
the shoots which are trained up for tho suc
ceeding year, will not only be stronger, hut
also better ripened and prepared fiji bear
ing ; because they will have tbu advantage
of the sun and air, which ia absolutely ne
cessary to prepare their juices ; whereas, if
they are crowded by a number of small
dangling weak branches, those will exclude
tbu rays of the t>un from the other shouts ;
an.I so by detaining the moisture a longer
time amongst them, orrassion tho vessels
of the young wood to bo of larger dimen
sions, and mere pithy ; which is a groat
disadvantage in making good cuttings, and
producing good grapes. The soil should be
constantly kept elenn, because if thero is
any vegotable, either weeds nr plants of any
kind growing botwmrn the vines, it will de
tain the dews longer, to the great detriment
of the vinos ; so that those who plant other
things between the vines, are guilty of a
great err**r. This was known ever since
the days of Moses, who expressly forbade
the Jews from sowing other plants in their
vineyardsThou shall not how tliy vine-
yef 1 with div t seedt t lost tho fruit of thy
od,whi'-h thou hast *own, aniTthe fruit of
of thy vineyard, be defiled" Dent. chap,
x xi i v. 9.
The vines should be prqne<] in autumn,
which season l approve rather than spring ;
.nil this Ireing the third year from 'planting,
thu vines will be strong enough to produce
fruit tlie next year, therefore they must bn
pruned accordingly. Now, Http pone the two
•boots of the former year widen weto shot-
et ed to three eyes have, each of thorn, pro-
breed two strong branches, tlio summer
past, then the uppermost of these shoots
should bn shortened down to five eyes, nnd
the lowermost should be (shortened down to
three, tho Ibrmer to bear fruit the next year,
nnd l lie latter being designed to produce vig
orous shoots, tn hour fruit in future years.
But a great dual must depend upon the dis
cretion of the vignoron, ns there may l»o
mutes which may make it proper in somo
instances to vary from the nhove, either by
tug more or leas eyes, us circumstances

LAW CASE
From tht Columbia Tilt scope.
Messrs. Editors— A cause has been d
termmed lately in Plnl.ide Iphia, involving
the whole law relating to voluntary Mottle
moots for tlm benefit of a man's family,
to the exclusion of hi* creditors, that de
serves to bo generally known. But as the
very able and c Inborate aigumont of Judge
Di m an, published in YY’nMi sNational Ga
zette of the Bib of March, inst h probably
too long for insertion in the Telescope, I
will extract the loading points determined
in that case, in which the', appears to beau
ucquiCM cm u in the hide ol tiro losing party .
Tlie case ij Tlio.iips oi, vs Dougherty,
March term, H*2t> Mercer, a wealthy
man, proposing, on tho4t!i Apnl, lftlH, to
g., into partnership extensively, with Steel,
an auctioneer, did, on the 27th of April,
in that year, nnd on the Sfctli of November
following, convey to Ins wife El za Mon
real estate in Plidadt Ipliin, of the value of
from 20 to 25,000 dollars, hid whole proper
ty being nt tlie I*.nc worth about 43,000 dol
lari. The subsequent failure of Murcei
A. Sierl, bro ught under discHSiion the fol
lowing princinles, which weru decided by
llio court nr tlie affirmative.
1st. That a man indebted, can make no
valid conveyance of bis property, without
a valuable consideration. The mere vol
untary conveyances for the benefit of ti
man's family, by which existing creditors
arc liable to be defeated of their d* bN, or
delayed in tho payment of thorn, are frau
dulent and void, under Fl Eliz eh 6, which
is sound law in this country.
The debts here contemplated, nro not the
petty debts for sugar or coffoc, or bread, or
meat, for domestic purposes, which no man,
however wealthy, can keep house without
incurring. These funusli no obslucle to
the conveyance.
2d. That nil conveyances of property
w ithout valuable consideration, in cuutem-
plation of incurring future debts, though
made hy a person solvent nnd wealthy at
the time, are fraudulent as against future
rrcdit'zj-s; for the fund to which they have
to iook for pay ment, is lessened by such a
conveyance
3d Tint all conveyance of so large a part
of a maids property ns to incupacituiu him
from carrying on a contemplated business
advantageously, is fair ground to infer a
fraudulent intention as Lord Nortliinglon
held in Partridge, ot ux. vs. Guppot, al
A udder, 5W.
4tli. That a conveyance void f»r these
reasons, a« against * xi»ting creditors at the
lime of the deed, i* void also as against
subs* quent creditors, w Imare let in to claim
the astute so voluntarily con) e \ ed, as assets
for the pny merit of debts generally
5th .^uch a voluntary convayance, tlm'
void ns against creditors, is valid as against
tho grantor
fith That a man not indebted, and not
contemplating any business, occupation or
engagements hy w hich debts must be incur
red, may make a voluntarily settlement fi»r
tin* benefit of Ins family, w liich w ill *.o val
id if not liable to any uf the objections bu-
fore rc( ited.

There was, save the voice of Brougham,
which growled in that under tone of mut
