which is the subject of this brief essay. Our
country is composed of twenty-four com
monwealths, nil of which except Louisin
na derive most of what is substantial mid

the same source; the same great interests
arc to be administered nud protected, in each:
the same language, and the same general
similarity of institutions, habits and character
tire found through nil ; while the constitutions
of several of these States tire almost ns di
verse in the tenure they prescribe to the ju
dicial office us if they had been devised by
the descendants of different nations. For
the continuance of this diversity wo have al
ready said no gootl reason can he assigned,
mid the objection which arises from the con
siderations specified in the preceding sen
tence is in our view unanswerable.
The direct object of oar inquiries, howe
ver, is not the difference of legislation tn
the respective slates concerning the tenure

The judges of (It# courts uf tlic several
states and of tlte United States, form n co
ordinate pnrt of the government. The pop
ular use of the terms government and admin
istration, confines their meaning to the Exe
cutive Department ; but the politir.nl accep
tation of these words extends tlieir import
so as also to include the legislative and judi
cial. Indeed, when we lank nt the inherent
power of the Judges, nnd perceive tlint the
very nature of their duties is to expound
nnd declare the laws which affect nil our
rights of person nud property, it woidd bo
striinfie if nny one should contend for tlieir
exclusion from n participation in the func
tions of sovereignty. Their decisions uro in
the nature of the ense rupreme, where no np-
penl is {riven ; nnd unless tiie Ihw, us they
expound it, is nllered hy the Lepislnturc,
their exposition is ns really the law ol the
land as the constitutions from which they
derive their authority. Rut while such is
their undoubted political character, and while
the trusts which they discharge have on nil
occasions ns momentous an influence upon the
pood order nml welfare of the community

partment, very different opinions have been

Rut before wo pursue this question, which
it is our design to do in one or tnoro of the
succeeding numbers of this Jtiunml, we shall
give a brief abstract of some of the provis
ion* contained in the constitutions of the
different States respecting thu judicial office.
They refer to the mode of appointment ;
the length of time for which the office may
he held ; the grounds nnd mode of removal;
und the salaries which the Judges are to re
ceive. The infurmatinii thus presented will
not, we think, he wholly unimportant, nnd
will Imve no indirect hearing upon our fol
lowing observations. The constitutions we
liuve examined are those now extsing; and
the judges affected hy their operation, are
those only of the court which is supreme in
the respective states.
Mode of Appointment.
In Massachusetts, New Hampshire, Marv
lund nnd Maine, by the governor with the
consent of thoconnci'—n distinct body front
the general assembly.
In New Jersey, hy tlte council and gener
al assembly.
Iu Vermont, by the governor, council, and
general assembly.
In New York, Kentucky, Indiana, Louis
iana nnd Missouri, liy the governor, vth the
consent of the senate—the smaller branch of
the general assembly.

governor.
In Rhode Island, Connecticut, Virginia,
North Carolina, South Carolina, Tennessee,
Georgia, Ohio, Mississippi, Alabama nnd Il
linois, by the legislature.
Time of holding the office.
m Massachusetts, New Hampshire,Penn
sylvania, Delaware, Maryland, Virginia,
North Carolina, Smith Carolina, Kentucky,
Tennessee, Louisiana and Illinois, no limit
is prescribed
In Connecticut, Alabama and Maine, the
limit is seventy years of age.
In Missouri and Mississippi, it is 0.1 years,
In New York it is sixty years.
In New Jersey, Ohio nml Indiana, the
judges are appointed for seven years |
In Georgia for three years, and in Rhode
Island nnd Vermont, for one year.
The causes for removal from office, are
the same generally throughout the different
states.
Mode o f removal.
In all the states, except Rhode Island, Ma
ryland and North Carolina, the judges may
he removed after conviction upon impeach
ment. In Rhode Island, no provision is
found in the constitution for removal in nny
manner. In Maryland, n removal follows n
conviction for misbehaviour in a court of
law; and in North Carolina, for a convic
tion tin presentment of a grand jury of the
supreme court.
In M ».achusetts, Connecticut, New York,
Pennsylvania, Delaware, Maryland, Georgia,
Kentucky, Louisiana,Illinois, Alabama, Mis
sissippi and Missouri, the judges may be re
moved by the governor, upon the address of
Iu some
states, a hare majority of the legislature—in
others, two thirds—and iu others, three
fourths, must unite iu this address.
In A’trgiltiii, the judges may lie removed by
a vote of both houses, two thirds ul the mem
bers concurring. .
In nil the Slates except Rhode I.-himJ,
Georgia and A’crmout, thu constitution makes
the oilier dependent on good behaviour-
Salaries.
In Massachusetts,Pennsylvania,Delaware,
A irgiuiu, Ohio, Indiana, Mississippi, Illinois,
Alabama, Maine and Missouri, the salaries
of the judges may he increased, hut cannot
he diminished.
In New Hampshire, South Carolina) Geor
gia ami Louisiana, the salary can neither bg
increased nor diminished.
In North Carolina, Kentucky nnd Ten
nessee, the constitution requires that art nd-
equatefsnlary shall be.nttnched to the office— n
provision, apparently authorizing cither alt
increase or diminution.
In Rhode Island, Connecticut,New York,
New Jersey, Maryland nnd A’crmont no pro
vision is made by the constitution.

MANIFESTO OF A HYPOCRITE.
Every man has n right to change Ins side;
and it must also he admitted that every man ^
1ms a right to form his opinion of those who
do abandon tlieir friends. It is also n fact
that all Apostates have been solicitous that
the world should believe they were guided by
the most disinterested views. The Holy Al
liance who degraded nud trampled France,
avowed to mankind'that they were impelled
hy no other motives, hut those of philanthro
py nnd religion. It wotdd, however, he dif
ficult to ndduce an instance more memorable
than the one when the Commander of AA esl
Point relinquished the American fur the Roy
al service, lie too talked highly of consci
ence and patriotic fidelity. As soon ns he.
reach'd New York, he issued manifestoes
denouncing Washington nnd his associates,
ns demagogues, nml inviting Americans lo
he false to their country, From these proc
lamations the brief extracts subjoined may
amuse your renders.
Intlint dated New Yo r ’',7th October, 1780,
in one paragraph, he speaks of the Patriots
of the Revolution in thesewords:—
“ To the thousands who sufter under the
tyranny of the usurpers in tlic revolted provin
ces, ns well as to the great multitude who
have long wished for its subversion, this in
stance oi' my conduct can want no vindica
tion, and ns to the class of men who are crim
inally protracting the war from sinister vines,
nt the expense of the public interest, I prefer
their enmity to their applause. 1 nm, therefore
concerned in this uddress only to explain my
self to such of my countrymen as want abil
ities or opportunities to detect Um artifices by
which they have hern duped. Having fought
hy your sitle, when the love ot our country
animated our arms, I shall expect from your
candour and justice, what your Deceivers,
with more art and lessjusticc will find it in
consistent with tlieir own views to admit.’ 1
In another part of the address, lie says of
America:—
And now that her icvrsl enemies nre ia
her own bosom, l should change my princi
ples if I conspired with tlieir designs ; your
selves being judges, was the wur less just be
cause fellowsuhjccts were considered ns ouC
foes I You Imve felt the torture in which
we raised our arms ugainst a brother. God
incline the guilty protectors of these unnat
ural dissontions to resign their ambition, and
cense from tlieir delusions, in compassion to
kindred blood."
Again ho says:—
“I affect no disguise, nnd therefore frarji-*
ly declare that iu these principles I had deter
mined lo retain my arms nnd command for
an opportunity to surrender them to Great
Britain ; and in concerting tlte measures for
a put pose, in my opinion ns grateful ns it
would have been beneficial to my country.—
I vvns solicitous only to accomplish un event
of decisive importance.”
l’bis is the concluding purngraph of this
conscientious patriot:—
“ In behalf of the candid, among the lat
ter, (says lie) some of whom I believe servo
blindly hut honestly—ill the bonds / bare
left them, I pray God to give them all the
lights requisite to tlieir own safety, before it
is too late; nnd with respect to that herd of
censurers, whose enmity to me originates in
tlieir hatred to the principles by which I ntn
now led to devote my life to the re-union of
the. Ilritish Empire, ns the best uml only
means tn dry up the streams of misery that
Imve deluged this country, they mny be assu
red, tlint, conscious of the rectitude id my in
tentions, ! shall treat tlieir malice and calum
nies with contempt and neglect.”

The next proclamation is dated New York,
20th October, 1780. The cuption of it is in
these terms:
“ Ity Brigadier General Arnold, A Procla
mation :
To the officers and soldiers of the Conti-
ncntinl army who Imve the rcnl interest of
their country nt hcurt.and who lire determin
ed tn be no longer the tools anil dupes of
Congress nnd of Franco."
He states the reward of promotion nml
interest of all who will pursue his examplo
and betray tlieir friends; speuks of “the
corruption of Congress;” “the ambitious
and interested views of a desperate party
among ourselves;” “the funds of your coun
try arc exhausted, and tiie managers have ap
plied them to their own privatauses’’—which
wus the very act for which be hud been court-
martialled.
“ Do you know (says be) that the eye
which guides this pen, lately bbw your mean
and profligate Congress at mass for the soul
of a Roman Catholic in purgatory, nnd par
ticipating in the rites of a church against
whose auti-christinn corruption, your pious
ancestors would have witnessed with their
blood!!” * . , _
When wo reiul these cantinas of Dcneuict
Arnold, and recall the plot against the Catho
lics in old England, and remember the delu
sions on witchcraft in New England, do wo
not instinctively apply them to the monstrous
imposture of “ Anarchy mul Civil AVor,"
lately played in our city,-and now in repeti
tion to client us of another election! There
is as much vericty in tliis rumour, ns (hero
nns in the aforesaid Plot nnd tho AVitchcroft
trials, nnd it is trnmpetted about for the satno
purpose—juyiular deception, *
