And furthermore, that the intrusions, and depreda
tions committed by the ciir/.ena of ether t,lct r,

Wfiatover may bo Mr. Gilmer’s opinion xvith re

may Iiave violated the act ol* tho last Legislature,
t'lhinf? ellcct on the first day of January last, cer
tain il is, that he conceives no riUr.en of the »Slato
could injustice bo punished, cither directly or in
ch root lx> for such n HUjtposcd offence, prior to that
period; because tiio proper Judicial 'J’rihunal of
tins State, before whom olfcndcra had boon nr
rrrtgned, had delarcd no law om ted by which a di
rect punishment could be inflicted, either on the
resident or non-resident ofthe State ; consequent
ly an in tire t punishment upon the citizens of the
State alone, by the operations of an net of its
Legislature, xvltile thousands of the citizens of tin
adjoining states, bad equally trespassed upon the
public, property xx iilt impunity, xvas conoidorcd by
Mr. Gilmer to be subversive of overy principle! ol
justice. I again repeat, these were the well
known opinions hold by Mr. (iilinpr upon this sub
ject during its agitation before the legislature, and
they are his opinions stilt, the declarations of his
enemies to the contrary iiotn ith-sl Hiding’, however
high the source from xv lienee they may spring; and
how far tho opinion.* here expressed tally xvith
those* imputed to him and handled to his injury,
particularly in this section of tho country l leuw
very individual to determine for himself. The
xvriter of this article lias not adopted the Yankee
mode of guessing, xvhicli is sometimes practised
for political purposes, but has taken the trouble to
obtain information on this subject from an unerrinte
source ; he therefore confidently presents tin* re
sult of his enquiries to the people, knowing it to
ho unsusceptible of contradiction.
Another objection urged against Mr. Gilmer, is
his opposition to the immediate occupancy of the
Cherokee country. What tuny be the privuto opin
ions of that gentleman on {this subject, founded on
abstract principles of right, it is unnecessary for
us to enquire ; it is sufficient f>r my purpose xvhicli
is his full and complete justification, that hi* policy
ho established as the correct policy of the coun
try, and founded upon its highest and best interests.
What then is Mr. Gilmer’s policy? and xx hat are
his reasons for recommending and consistently ur
ging t Ii a t. policy ? A full and complete exercise
of sovereignty and extension of jurisdiction over
all classes and description of persons, residing
within tlio constitutional limits of Georgia, togeth
er xvith a full and ample protection ofthe public
property, xvhetlter comprehended in the extin
guished occupant title of tho (Mierohees, or loca
ted in the bowels of the earth, is the fixed and de
termined policy of Mr. Gdiner, so fur ns relates to
that part of the territory of Georgia now in the
occupancy of the Cherokees. Hut an unqualified
interruption of the occupant tillc of the Indians,
contrary to their collective or individual consent,
is not embraced in that policy. His reasons
he found, and amply fortified. 1st. Hy the dc
