Mr. Hponker—It is not with the vain hope of
producing tlio slightest effect on tho decision of tlio
question now pending, that I rise to address you.
Ho must bo blind indeed wlm does not see that
them is a fixed nnd nettled determination on the
part of n very Inigo majority of this House to pose
this hill. It would Hcorcoly bo going too far to
say (nml I hope In-snying so ishall be guilty of no
irreverence) that this majority “would not be per-
suadoil" to reject this hill, even “though um ruse
from tho dead.” No, Sir, tho question ie already
decided; and ns stiro ns the final vote is taken,
just so sure tho bill on the table will become a law
of the bind. Hut, Mr. Speaker, it is n duty which
I owe myself to present my views of this deeply
interesting subject, nnd I beg the a'tention of the
House while I attempt to do so.
It was my fortune to belong to tho Committee
to whom tlio messnee of the President, suggesting
tho inoasuro now under consideration, was refer
red. ()n a careful nnd deliberate investigation of
the vnrions suggestions contained in the second
page, 1 could not give iny assent to tbe most prom
inent ol'them, ami united with n majority of my
associates on tbe Committee in a report which was
some timo since submitted to tho House. Tho
views presented in that report it is now my pur
pose to defend.
it would hnve boon gratifying to me, Mr. Speak
er, to hnve hoard from the advocates of this bill, an
examination nnd defence of its details ; but they
have not thought proper thus to discuss it. My
collcogne, (Mr. Wakx'k,) who Imsjust taken Ilia
,'cat. reflected somewhat on tbe gentleman from
Booth Carolina, (Mr. McDufkib,) beenuso in Ihu
course of bis argument he referred lo but one of
the provisions of tlio bill; nnd yet my colleague
win guilty of tbe very same omission, lie is [ho
strenuous supporter of the whole bill; but did not
bestow even n passing remark upon only oneofit*
fenlures—tho employment of tbe military force.—
I shall not follow tho example of tlio gentlemen
who preceded me. It will lie my object to inrea-
tignte the details of the bill, and notice tbe promi
nent measures which it proposes ; and if 1 run not
bear reasons in favor of them, I will endeavor to
show some against thorn, which, if not satisfactory

It is not to be disguised tlmt this is an adminis
tration iiionsarc. It comes to us not only approv
ed, but asked fur, by tho Executive; and, there
fore, ns a friend to tbe administration, it would
itnvo givon me great plonsuro to Imvo been able
to yield it my feeble support. But, however high
my respect lor tbe President and his constitutional
advisers, I cannot sustain their policy at tbe sac
rifice of my own principles nnd opinions. I shall
nevor bo so much the partisan or friend of any man,
ns to surrender tlio honest convictions ot my own
judgment. In opposing, however, the recommen
dations nf tbe President, with regard to South Car-

Imvo the utmost confidence—quite as much, cet-
tainly, ns many gentleman around me, w-|io aro to
zealously sustaining these recommendations.
I own it to myself, Mr. Speaker, also to say,
that 1 do not appear here as the advocate of South
Carolina, i do not approve her recent measure*.
Do not imagine, however, tlmt 1 am about to join
in those unmeasured censures and denunciation*,
which have boon so lavishly bestowed upon tier.—
N„, Sir, this is n ernsndo iu which i shall he among
the last to enlist. It is an enterprise which pre
sents no temptations to my ambition. It is a field
in which I shall gather no laurels. Sir. South
Carolina is the nntiirni ally, the sister of Georgia,
liar gallant sons nro our neighbors, our brethren,
our fellow sufferers—*lid, while disapproving their
acts, I can most truly say, that, “with nil their
faults, I lovo them still.”
But, Mr. Speaker, I have promised to enter into
nn investigation of the details of tl.o bill under
consideration; and l now proceed to the tnsK
Tho first section provides, iu substance, flint
when, by renson of unlawful combinations or ob
structions, it shall become impossible to collect the
duties on imports,jn (lie ports of any State, the
President shall he authorized to remove the cus
tom houses to some secure place, either on land or
water, nnd to direct that the duties on merchandise
imported into such ports, shall bo paid in cask, lU-
dacting the legal interest. Now, tiir, oltliough no
particular State is designated, vet we ul! know a*
well tlmt tins measure is intended fur South Caro
lina, ns though she were named in the bill. In
deed, tlio ol.joct avowed by the President is to
countervail the ordinance and legislation of South
Carolina.
The very first suggestion which this proposition
must present to the mind of every one, is its pal
pable inequality and injustice. It is well known,
that there arc a great many merchants in Charles
ton, who have no intention of taking the benefit of
the late laws of Carolina, for the purpose ot avoid
ing tlio payment of tho duties. They will con
tinue to import their goods, give their bonds, and
pay them punctually as heretofore. Would it not
then he unjust in the extreme, to deprive thoso men
of rights nml privileges secured to all other cit'f-
zons of tlio United States ? and that too, in a Gov
ernment whose boast Iin3 been, und ever should
he, its equal lair*: 1 Sir, litis injustice is too obvi
ous it affords no ground for argument—the men*
statement amounts to demonstration, and present*
a striking instance of consigning to a common fate,
those who obey and Ihose who transgress the law*,
which it is one of the most sacred duties of Gov
ernment to prevent.
But weighty und conclosi/o as this objection is,
it is light compared with another. Sir, tho requi
sition of cosh pnymonts, as contemplated, will, in
my Immblo judgment, conflict with twoclauses ot
tho Constitution.
I am aware, Mr. Speaker, tlmt on the subject of
tho Constitutional powers ot the Government, I en
tertain what arc new regarded old fashioned no
tions. 1 early conceived a strong bias (many gen
tlemen will, no doubt, consider it a very unfortu
nate one) in favor of n rigid construction of thi*
great charter. It Ims been n part of my political
education—and mature reflection has but confirm
ed tho lessons of early instruction. It may not
become mo to say that I havo been “trained up in
the way I should go,” but there is certainly not
much probability of my “departing from it.—
When then I am called upon to do any net as a
member of this house, I turn to my pettier o/ attor
ney—to thin instrument, which lias been the theme
of so much eulogy, and the subject of so much
abuse, and if I cannot find authority there for the
act required, it is more then 1 dare do to yield my
msent. And gentlemen must pardon me for re
minding them of tho high responsibility under
which they net here—a responeibility much more
solemn and feariul than that which they own to.
