penal bond in the sum ol Four Thousand Dollars, conditioned
to make or cause to lie made good nnd law ful titles to the east
ball ol lolol land. No.one bundle*d and ninety five, with the
exception of twelve acres sold to John Brit,and also, the east
half allot of laud, No. one bundled und ninety, both lots lying
and being in the tenth district of formally Henry now New
ton county. Aud it appearing to the Court that the said
Eppe** I inker. Jr. departed this life without malting titles to
the said east halves of lots of land with the exception as
aforesaid and without making provision therefor bv will.
Audit also,further appearing to tho Court, that the said Ed
win Payne hns paid the consideration money mentioned in
