3. In addition to tlio above sum ol§300,000, the purchaser
shall, nt the period nforesuid, reimburse the State die amount
expended on the Rond since thu 22dof December, 1843.
4. 'The purchaser shall assume and discharge all the cod*
tracts of tlio State for iron, timber, grading, and every other
matter or thing connected with the Road, which are tti.w ia
progress of execution, so that no charge or cluim maybe here
after made against the State for or on account of said Hoad.
5. 'The purchaser shull put and keep iu complete operation
the Road from Marllmsville to Burroughs’, opposite lo Cui*
ville on or before the first duy of November, 1845—to the
Oustanaulee River on tho firm of October 1816—to Croat
on the first of .September, 1847—ami to tlm Tenneeaee
m or before the first of September, 1851, or sijcli other
time ns the Legislature may grant.
6. The purchase shull he limited in freight and psmgt
money to the same rutes us prescribed iu tiie Act of 1843,
providing for the sale of said Rond, except in cases of war or
ivil commotion, when the transportation nl soldiers and mu
nitions of war ahull he reduced 60 percent, below cuBtoin&ry
rates.
7. The purchaser shall givo equal privileges and fncilitici
to the Monroe Rail Road uud the Georgtn Bail Hoad ('ompi-
nice, in tlio transfer of passengers and property, nnd any di»-
crimination whatsoever, adopted or permitted, m favor ofeilher
ol said branch roads, with respect to the place of unloading
the grunting of free tickets lo agents of either branch
road, the Belling of what is called a through ticket lo pnmn-
gers, or for property, or otherwise, shall subject the purchas-
r to suit in every instance, hy the injured putty,and an legal
roof thereof the minimum amount of liquidated damages shall

8. 'The purchaser shall organize and continue on said Rond,
epurute uud distinct front said brunch roads, the m’ceaiiary
ngines, cars nnd officers, and regulate the arrival and depar-
lire of the pusseuger cur or enis by the contract with the
General Post Office Department for the transportation of the
United .States Mail.
9. The .Slate shall have a lieu ou the Rond and its appur-
nances for the faithful performance of each and every ali-
pulation hereby made by the. purchaser, concerning the pay
ment of money, and completion and equipment of the Boail,

y forthwith take possession uud control of said Road and
appurtenances.
10. When tho purchaser, or purchasers, shall have per

appurtenances, and enjoy ull the rightsaud privilege*thereof,
which now belong to the State.
