I T is ordered, in compliance with an act assented to on the
22d day of December, 1843, that the WcstC’I'll HMft
A tlaillic II ail road he offered for sale on the follow
ing terms; and that sealed proposals, uh to the amount ofthe
bids, be received at this Department, till the Ut «f March
1845; and that the envelopes be marked “Seuled Proposals;
viz:
l. No bid will be considered which does not offer a
least equal to one million of dollars and all expenditures by the
Stato since 22d dny of December, 1843.
2. 'The sum of $300,000 shall be paid bv the purcltiwr
within thirty days alter he ahull be notified ol the acceptance
of his bid. Tlie remainder shull be puid after the expnation
of twenty five years, or sooner, at the option of the pun-liaMr,
with tho six percent. Bonds of the State, and shall bourao „
terest ot the rate of six per cenflimper annum, payable serai'
annually at the Treasury oftlie State.
3. In addition to the above sum of $300,000, the purchaser
shall, at the period aforesaid, reimburse the State ibe amount
expended on the Road since the 22dof December, 1843.
4. Ttw nurchuser shall assume and discharge all the con
tracts ol the fcriute for iron, timber, grading, nml everv other
matter or thing connected with tho Flood, which are *
progress of execution, so that no charge or claim im.v be here
after n.ude against the State for or on account ofsuid Hoad.
5. 'The purchaser shall nut and keep in complete opsralioi
the Road from Murthusville to Burroughs’, opposite to Cua-
ville on or before the first day of November, 1845—to the
Oustanaulee River on tlm first of October 1818—to Cron
Plains or* the first of September, 1847—and to the TennfMN
If iver on or before the first of September, 1851, or such other
time ns the Legislature may cruur.
6. The purchase shall be limited in freight and pattifc
money to the same rates as prescribed in the Act of 1843,
providing for the sale ofsuid Road, except in cases oi wnr
civil commotion, w hen the transportation ol soldiers nml
nilioii8 of war shall he reduced 50 percent, below castoratff
rates.
7. The purchaser shull givo equal privileges and fncilitk*
to the Monroe Rail Road and the Georgia Rail Rond ComPi*
nies, in the transfer of passengers mid property, and uny oil-
crimination whatsoever, ndopted or permitted, in luvor ofeilhrr
of said branch roads, with respect to the place of unloadior
the curs, the granting of free tickets lo agents of either braocf
road, the selling of whnt is called u through ticket to |ia*MD*
gcra, or lor property, or othei wise, shall subject the purchif
er lo suit in every instance, by the injured party,and on legal

engines, cars and officers, and regulate the arrival and ilepit*

9. The State shall have a lien on tho Road nud its appM;
tenances for the faithful performance of each uud eviry ■(>*
pulution hereby made by the purchaser, concerning tlie pay
incut of money, and completion and equipment of the Hoad,
and in case of any breach thereof, tlie Executive of the State
may forthwith luke possession and control ofsuid Road and
its appurtcnunccs.

formed the 2d and 3d specifications, hereinbefore suited he'*
