Apoplexy. During the reading of the President’*
Message in the House of Representatives, on the 13th
ult. the Hon. Air. Van Horne, of Pennsylvania, was

Capt. Thomas Ap Calerby Jones, of the U. 8. ship
Peacock, and late from a cruise round Cape Horn, is
now On a visit to Washington city. He has Men absent
nearly three years, and visited the Marquesas or Wa
shington isles, Otaheite, and se veral of tho Society Isl
ands, and passed some two or three months at Wahoo,
one of the Sandwich groupe. The National Intelli
gencer states, that Capt. Jones was-charged with du
ties highly-important to our increasing commercial in
terests in those far remote regions; and fbatlhe trust
confided to him has been executed to the entire satis
faction of the government.
Baron Krudtrcr, Envoy extraordinary and Minister
plenipotentiary from the Emperor of all the Russias
to this government, was presented to the President of
the U- on the 22d, and received in his official capacity.
Canada. The Governor of Lower Conada prorog
ued the Provincial Parliament to the 3d of January,
owing to its persisting in the choice of a Speaker who
was obnoxious to him. Halifax papers received at
Boston, state that Earl Dalhousle is recalled from the
government of Canada and appointed to the command
of the Forces in India; and that the Duke of Gordon
is appointed Governor of Canada.
A Disappointment. A man was lately arrested at
Detroit, on a charge of forgery, just as a large compa
ny were assembled to witness ms marringe to an ami
able girl.
Dr. Jacob Jimcrson, a native of'the Seneca tribe of
Indians, a remnant of which still exists in the slato of
New York, has received the’appointment of Surgeons
Afate in the Nary. A Buffalo paper remarks, that this
is the first individual of that claSs-wbo has ever reach
ed the station he now holds.

eral Assembly, assented to on the 24th instant, “To
alter a«d fix the time'Of-holding the Superior Court*
of the Southern Circuit,’’ be immediately published
once in the gazettes of Alillcdgevifle and Macon.

AN ACT to alter the time, of holding the
Superior Courts of the Southern Circuit.
Section 1. Be it enacted by the Senate, and Ho\Cse
of Representatives of the State of Georgia, in General
Assembly met, and it is hereby enacted by the authority
of the same, That from and alter the first day of .March
next, the time of -bolting the Superior Courts iu the
Southern Circuit shall be os follow s:
In the county of Twiggs, on the third and fourth
Mondaysin'March and September;
In the county of Laurens, on'the first Alouday inA-
pril and Wednesday after the fii-st Slonday in October;
In the comity of Pulaski, on'the second Alondayt in

AN ACT to tell and dispose tf the Unsold Lots in the
town of Macon, and the public Lands on the east and
west side of the Ocmu/gee river, near and adjoining
the said town, and also the Bridge across the OemuT-
gee river at Mucon. r ■ •
B E it unacted by the Senate and House, of
Representatives of the State of Georgia
in General Assembly met, and it is hereby c-
tiacted by the authority of the same, That his
Excellency the Governor shall immediately af-
ter the'passage of this act; appoint throe Com
missioners to lay off and distinctly mark dll
tho reserved and :public lands ou the east and
west sides of the Ocmulgee river, adjoining tho
town of Macon iu the county of Bibb, including
all the fractional surveys adjoining said reserve
on tho west side of the river Ocmulgee, into
such lots aud tracts of-land as shall bo directed
by this act.
Sec. 2. And be it further enacted by tho
authority aforesaid, Thattbcsaid Commission
ers in the execution of the duties by this act
assigned them;., shall causo to bo laid out and
distinctly marked, two ranges ofiots adjoining
on tho south, wust and north of tho lot or square
reserved for tho common aud town of Macon:
tho first range to contain ten acres, and the se
cond range of lots tb'cbutain twenty acres each
—And all the rost and residue Of the reserved
lands lying on the west side of the Ocmulgee
river, near the town of Macon, shall be laid off
by the Commissioners aforesaid into Squafo
tracts of one liundi'od acres each, or into frac
tions’where the same will not adnutof bcinglaid
out into square lots, ' •
Sec. 3. And ho it further enacted, Thai
the blocks of lots containing eight half acre iots
each, and known ih the plan of said town as
tho court-house lot, and Nos. 21 and 40, shall
be sot apart and appropriated to and for the
use of tho county of Bibb, to aid the said coun
ty in erecting their public buildings, and that
the Commissioners of the Court-house and
Jail of the county of Bibb be, and they arc
hereby, authorised to sell and convey a -part or
tho whole of said lots for that purpose; and the
said Commissioners of the Court-hoase and Juil
of the county aforesaid, shall have tho privi-
lego, aud arc hereby, authorised to build tho
Court-house and Jail on tho reserved or public
squaio ih tho town of Macon;
,» Sec. 4. And ho it further enacted, That
tho said commissioners shall causo tho reserve,
on tlio East sido of tho Ocmulgco river, ttt bo
laid off in the following manner, to wit; first a
reserve for.a town common, hot exceeding fifty
acres; and in width running in a direct line from
tho east end of the bridge, not exceeding 100
yards, and running up from tho river for com
plement, making the bridge as nearly central as
practicable'; secondly adjoining said .reserva
tion of common, a range of lots of tho' size of
one aero each; in tho rear of which shall bo a
range of lots often acres each, next of a rango
of twenty aero lots, and last of lots ot 100 acres
ouch; or fractions in the same manner as point
ed out in the second section of this act.
Sec. 5. And.be it further enacted; That the
said Commissioners after having fully carried
into effect tlio foregoing provisions of this act;
shall causo sixty days notice to be given of tho
intended sale in all the public gazettes of this
State and one of tho public gazettes of Charles
ton, South Carolina, andTiiscidoosa; Alabama,
and shall in accordance with the said notice
proceed at some convenient place in the town
of Mucoii, to offer for sale by public outcry dll
the unsold building lots already laid off in the
town of Macon, together with the garden and
planting lots so as aforesaid to bb laid out; and
shall from day to day cOntihub said sales until
tlie whole shall bo disposed of: Provided; nev
ertheless, That if in ihb opinion of the said
Commissioners or a majority "Of them, the
State’s interest ih said iots and land should seem
likely to be sacrificed for tho want of demand
or bidden, or for any other cape, it shall bo
tho duly of said Commissioners to suspend
the sales ofiots and tracts of land for which fair
prices cannot bo had, until such other day or
days ofsalo as they may think proper after the
like publication of notico to order. . ' •- ■
— Sec, 6, And be it furdter. enacted,- That
the Commissioners aforesaid shaU at the
sales of the public property in and near tha
•town of Macon, proceed to soil the bridge acres i
tho Ocmulgee River erected at tho tdwn of
Macon together with one acre of land on the
East sido of the river aforesaid, as a buitment
for the said bridge; the purchaser shall forever
have tlio full and free privilege of occupying;
and using so much of the 5th, or bridge street;
on the west bank of tho Ocmulgee. River as
may bo necessary for a buttment for tho Said
bridge; and tbe said bribgo with the buttment
on the west sido of said river, shall be sold at
public outcry, said commissioners first specify
ing in their advertisement the day on which
said bridge will be sold, upon tho same terms
and conditions as are provided for-in tho 4th
and 5th sections of tiffs act; except as to giving
certilicates to the purchasers, and in lieu there
of, the said Commisioners shall require of tho
purchaser bond with approved security for tlio
tiiithful payment of the four annual instalments
that may hereafter become due for tho said
bridge; and that a grunt or deed shall not he-
made for the simO until tho last instalment and
all interest is fully paid.
Sec. 7. Aud bo it farthor enacted, That the
highest bidder for any 6Ue lot or lots authorised
to bo sold by this act, shall bo the purchaser,
who shall on tho same day, pay ;o tlio Com
missioners uforbsaid, outs fifth part of the pur
chase money in cash or currttUt bills of charter
ed banks of tiffs State,on the payment jf which
the said Commissioners, or a majoriiy oTiltom,
shall givb to such purchaser a certificate stat
ing tlio amount of said purchaso money then-
duo and to bo;paid in four equal annual instal
ments, which said certificates shall bo transfer-
table by written assignment; and any purchaser
failing to .pay any instulmom to tlio Treasurer '
of this State, within CO days after 1 the samo
becomes due shall 'forfeit -tho anrouiit paid,
and the'lol or’lotsso'pureliased,; shall revert to
and becomojlie property of tho Stato.—When
tho last instalment is paid, dr whc-novOr tho
purchaser pays the whole purchase money fof'
such lot or lots, agreeably to the : foco,of-said
certificate, given by the Commissioners afore
said, it shall bo tho dpty of his excellency the
Governor to cause a grant or grants to -btvmado
out iu tho name of tho holder of said certificates,
agreeably to tire daws now illforce 'regulating
grants, which said 1 grants'shall bo given to tho
holder of said- cortificaio on his or hor paying
into tho Treasury of this State; four dollars
uucl fifty cents for olfrcc fees. * ., .
Sec. 8. And be it furrh^ enacted, That ft
shall bo tho duty of said Commissioners, with
in SO days, afior said‘sales, or any of thorn
shall have been closed or suspended, to pay in
to tlio Treasury of this Statu tlio nmt amount
received by them for tho salo of said lots and
bridgo, undshall also return jmd deposit in the
Comptroller General’s office their book or
books, coutaiuiug an account of tiro sales, of
all lots sold by them;, and a general -plan of
tlio lots surveyed and sold hy tho 'Cum'-k
missiouers aforesaid, shall at the same time'bo
deposited by thorn iu tho Surveyor General’s

Sec. U. Attfi bo it further Cnacl.ed, That if
Shy person or persons, bidding for lots, and
failing ou the sumo day to cuhiply with tlio pi u-
visions Df the 5th section of tins act, shall tbi-
feit the : right of having any further, bids cried
by tbe Commissioners; anJ tho Said Commis
sioners shall on tho noxt day ofsalo-pnt up and v:
offer said lot or lots for sale as though the same
had not beon-provibusly bid off. •
Sec. 10. And be ir ffirthcr'enacted, That
each of the Commissioners, bofore ho on.ers
on tlio duties nf said office, shall execute to His
Excellency tho Governor, a bond witli .good;
and sufficient security, in tho penally offcl'O',-
000, to become null and void 06 the condition
of his faithfully performing tho several duties
and requirements specified und pi escribed in
this act~And in case either of. said Commis-'
siofters shall uoglector refuse to make, return,
aud pay over to the IVoasarOr of this’ State,

ed to all and singular tlio Sheriffs of this State,

fieri facias, and have the same effect of such
a writ Whon issued, pursuant tu, (lie judgement

(ot detaining money, shall ■ in no wise exonipt
cither of said commissioners from an action at
law or equity, fdr any other malpractice in ofiito.
Sec. lit And, bo jjt. further onaciod, That
each of said cbmmisifiouers whilst ongngod- im

Sect. 13. And-be it* further enacted,- That
another building lot shall be set spurt for the
Baptist Church, by the commissioners of tho
town t upon tho said chtirch relinquishing ali
right and title to the o*e already laid off and
assigned to thorn, and stfrrehdbl ing up 1 1 ho sami
to be sold pursuant to the provision's of this ret.
Sec. 14i And be it further enacted, That
nothing herein contained,’shall authorise said
comissiouers to sell any of the lots which were
leased of tho Government of the United Saa'-s'
uiftil tho expiration of said lease, tmh---s saic
lot or lots are sold subject to the incumbrance
of said lease;' Provided, nothing Oomaiwd iu
the foregoing law, shall be ao construed a* to
authorise the ramoval of said brioco or the- oc
reef on of any other bridge' or firry on sa d ri a-
serve, which would interfere with said bridge
where it now stands.
