Merchants, tradingin partnership underthenume
and firm of A. & E. YVood assignees of Horatio N
Spencer, shewing in Court that Simeon Durham on
tho 27th of March 1828, mortgaged to said II. N.
Spencer a (ot bf Land, containing one acre, with the
nppurtuuancqs thereto belonging in tho tovyn of Hills
boro in said county, hounded on the cast, and south
by premise's of Cutlibert Reese, on the north by pre
mises of Asa E. Stratton, and on (he west by premises
of Ambrose Niles, on which lot so mortgaged there is
a two story buildingoccupied as a Tavern; ono store
house and various out houses on said lot, to securo.thc
payment of one thousand dollars on the first day of
May 1830, which mortgage was assigned by said II
N. Spencer, to said A. Ot E. Wood, on the 15tbA
prii 1828, and remains unpaid, andsaid A. &.E. YVood
iraying foreclosure of the same; on motion therefore,
t is Ordegpd, that said Simeon Durhnm, pay into this
court the principal,, interest, and cost, due on said
mortgage within twelve months after this time, in do
fault of which the equity of redemption in the mart'
aged premises will, by order of this court be forever
arred and foreclosed; And it is further ordered, that
this rule be published once a month from this time for
twelve months hereafter, or served on said Simeon
Durham orliisspccial agent, atleast six months pre
vioui thereto.
