THE Et.PORT OF THE COMMISSIONERS.
We have before briefly alluded to tliu re
port of the Commissioners appointed by the
Legislature to draft a code of laws for ilm
protection and government of the Freedinen.
The pamphlet copy of the report not having
reached us, we give a brief synopsis which
we found in a Macon exchange. The entire
report is in process of publication in some of
our exchanges, but as it is too long for our
columns, and as it will not be of force until
after its adoption by the Legislature, by
whom it will undergo amendment and alte
ration, we content ourselves for the present
with a full statement of its main provisions,
which we find in the Columbus Enquirer
When the code shall have been perfected and
adopted by the Legislature we will lay it en
tire before our readers.
Tho code is accompanied with the draft of
a short adopting bill, the passage of which is
recommended, unless the Legislature should
deem that mode of wholesale legislation un
constitutional; in which case the Cominis
sinners recommend the adoption of several
bills including all the provisions of the code.
As the titles of these bills give a comprehen
sive summary of the matters embraced in
toe reported code, we copy them :
1st An act prescribing certain general pro
visions preliminary to other legislation, in
tended to carry into effect the fifth clause of
the fifth section of the second article, and
the latter part of the third clause of the
second section of the fourth article of the
Constitution
2d. An act to establish county courts in
thi9 State.
3d. An act to amend the laws In relation
to husband and wife.
4th. An act to amend the laws in relation
to parent and child.
r>th. Au act to amend the laws in relation
to guardian aod ward.
6th. An act to amend the laws in relation
to muster and servant.
7th. An act to amend the laws in relation
to master and apprentice.
8th. An act to amend the law of contracts.
9th. iVn act to amend the law in relation
to estates of deceased persons.
10th. An act to amend the criminal law.
11th. An act in relation to the grant and
regulation of licenses in certain cases.
The first article for bill) repeals all stal-
utes relating to slaves or free persons of
color; defines persons of color to be those
having one-eighth of negro or African blood
in their veins, and extends to them the right
to acquire and hold property, to sue and be
sued, and to receive protection of person and
property, «fcc.; also the right to testify in all
civil cases wherein ihe rights or liibi ities of
persons of color are involved, in all criminal
cases wherein the accused is a person of
color, or where the proceeding is instituted
because of some alleged injury to a person
of color, his righ's or property ; “and in any
case, civil or criminal, in which a colored
person is introduced as a witness against a
white person, a party to the case, or a white
person against a colored person, a party to
the case, the opposite party may be sworn
and testify as a witness; if he do bo, then
his adversary may also testify as a witness."
Article 2d provides for the organization of
a County Court in each county, the Judge
of which shall be entitled the County Judge.
The compensation of the County Judge to be
$200, to be paid by the State, together with
tees prescribed. The County Judge may
issue bail process in civil cases, admit to bail
in criminal cases, issue attachments, foreclose
mortgages on personal property, issue war
rants of distress for rent, possessory war
rants, writs of habeas corpus, and other writs
or warrants not within the exclusive juris
diction of some other court or officer; he
may also exercise all the usual powers of a
justice of the peace, &c. He shall, by him
self or clerk, keep a record and index of all
court contracts filed in his office, keep proper
dockets, &c. Rules for conducting businos
in the court are prescribed. The cour, is to
hold daily sessions for bearing and determin
ing all cases arnipg out of tho relation of
master and Bervaut, applications for the
eviction of trespassers, distress warrants,
habeas corpus cases, &c., and in all civil
cases in which not more than one hundred
dollars is claimed as damages or as the princi
notice.

following extract of an Ordinance passed August 2,
1S39:
EXTRACT. '■ A
Sec. 3d—If any person shall ride, lead, or drive
any horse, mule, or other animal uaually ridden, or
used for draft in any sort of carriage'whatsoever,
within or between the doable row of trees. In the
centre of South Broad street, or the doable or triple
row of trees on the Bay (except through or across
the said trees when they are Intersected by the
streets) or who shall ride, lead or drive the same
over any of the sidewalks or footways within the
sai«t city, lie or she shall be punished as is herein
after mentioned.
Sec. 5. Upon the conviction of any violation of
anv nf the provisions of this Ordinance the offender
may be fined in a sum not exceeding one hundred
dollars, e.t the discretion of the Mayor, Chairman or
Alderman presiding at the Police Coart, or of the
Council. • * * * * * * *
And the said fineB and forfeitures may be levied, re
covered, collected and enforced In the manner [ire-
scribed by law, and one-half thereof shall be paid,
when collected,‘to the Informer and the remanyler
sh ill be paid to the City Treasurer for the use of the
City.

To amend an Ordinance entitled an Ordinance to
levy and assess taxes, and raise revenue for Ihe
City of Savannah, and to amend the various t.x
and revenue Ordinances of said City, passed In
Council 27th December/1865.
Sec. 1. Belt ordained by the Mayor and Aldermen
of the City of Savannah, in Council assembled, and
it is hereby ordained, by tbe authority aforesaid.
That so much of said recited Ordinance of 27th De
cember, 1865, as requires returns to be made
quarterly be as to returns of all receipts for freight
and passage money, so amended as to require that
said returns for freight and passage money be made
monthly ; the first return to be made on ihe first day
of February next, or within ten days thereafter, and
that so much of said recited Ordinance as militates
with this Ordinance, be and the same ls hereby re
pealed.

sec 1. Be It ordained by the Mayor and Aldermen
of the City cf Suvaunal), lu Council assembled, and it
is hercbv ordained by the authority of the same. That
it shall and may be lawful for his Honor, the Mayor,
to make contracts and conditions with the privates
' f tbe City Police, to the effect that no such private,
already or hereafter to be appointed, shall resign or
vacate hia position as such private, without first
giving thirty days’ notice to me Mayor of said pri
vate’s Intention so to do, on pain of loss or all pay or
compensation due at the time of such resignation or
vacation ; and that, hereafter the Mayor he author
ized in make no new appointments ot privates in
said Police, without requiring said stipulation, con
dition or contract to be made.

Savannah, for the purpose of funding a portion of
the public debt of said City.
sec. 1. Be it ordained by the Mayorand Aldermen
or the City of Savannah, lu Council assembled, and
it is hereby ordained by the authority of the same.
That His Honor the Mayor be, and la hereby author
ized to Lsue bond's _of the city of Savannah lOym
amount tior exceeding ($-ioO,u00) lour hundred thous
and dollars, In sums of one hundred, three hundred,
and hve hundred dollars, respectively, and having
twenty years to run, with coupons attached, and
payable semi-annually, that is to say, on the fifth
day of July, and the first day of January, in order to
take up coupons now due on city bonds ; said new
bends to bear the same rate of Interest as the old
ones, to which said coupons now to be funded, be
long ; sud said new bonds to be redeemable in New
York or Savannah, as the applicants for such new
bonds may designate by giving notice to ike Mayor.
Sec. 2. And be it further ordained by the authority
aforesaid, That the coupons so redeemed by the issue
of new bonds be cancelled by the Mayor, or other
wise destroyed by him, under the supervision of tile
F.nance Committee of Council; and that the Mayor
be, and lie is hereby authorized to draw from tho
Treasury such amount as may be necessary for pre-
pai log and Issuing said new bonds.
Sec. 3. Aod be it turther ordained by the authority
aforesaid. That all Ordinances, and parts of Ordi
nances, so far aa they militate with tue ordinance,
be, and the same are hereby repealed-

the court is to be exercised at its daily ses
sions, aud extends to alJ offenses by persons
of color of which exclusive jurisdiction is
not vested in some other court, and ex
cludes the jurisdiction in such cases hereto
fore vested in justices of the peace, mayo s
or intendants. The Court is also to hold
semi-annual sessions, haviDg concurrent ju-
risciiclion with other courts of law in all civil
cases of which exclusive jurisdiction is not
vested in some other court, including juris
diction in legitimatisiDg persons, changing
names, and grautiDg corporate privileges.—
Rules of the Superior Courts to govern it.
Appeals may be taken to Superior Courts.
In cases not specially excepted the Judge's
costs in the semi-annual courts shall be the
same a9 those of the Clerks of the Superior
and Inferior CourlB for like services; in
cases of the daily courts, if the sum of dam
ages claimed exceed fifty dollars, then two-
thirds of such costs ; and if not over fifty
dollars, then one-third of such costs shall he
(axed as Judge's cobIs ; in criminal
cases, two dollars for every case
begun, and two dollars additional for
every case tried or transmitted to the
Superior Court. Otter fees are enumerated.

Simple larceny, larceny from the house of a
chattel less than one hundred dollars value
vagrancy, receiving stolen goods, and at
tempts to commit robbery, burglary, larceny
and arson, to be punished by confinement at
hard labor on the public works or public
K perty; aud in all other cases where by
confinement in tbe penitentiary is pre
scribed as a punishment, the Court in its
discretion may sentence the convict to con
finement at hard labor on the public works
or public property.
