Police Matters.
Iu the Mayor's Court yesterday morning, before Hie
Honor Mayor Andereon, there were a number of cue*
disposed of. The first was that of a man charged with
selling liquor on Sundays, therein violating city ordi
nances. This case was continued on account of the
absence of a witness, who was reported to be down
tho river.
The captain of a schooner was charged with vio
lating city ordinance in relation to iiiarh.^Hn|, coal
from his \ easel without having the necessary tarpau
lins attached. The captain contended that no coal
was dropped in the river, but might have dropped
through the planking on the wharf, as it was broken.
The defendant also stated that the Harbor Master had
told him it was fixed as well as it could be, but that
gentleman being produced stated that he gave the cap
tain a copy of the Harbor Master’s rules, and that he
did not tell him that the gangway was as well protected
as It might be. The Mayor Baid that the captain had
offered no reasonable excuse for not doing his duty iu
this instance and fined him in the sum of $25.
A woman was charged with violation of city ordi
Dances iu selling goods in the market without a li
cense. The policemen testified that she was selling
goods on Saturday in the market when she paid him
the market fee, and he told her she could not sell
without a license. Shd came hack ou Monday morn
ing when he arrested her. The defendant in answer
to a question stated that she kept a store and paid her
license and went o the market to dispose of some eggs
and potatoes ; that she was not a huckster. His Honor
then told the policeman he had no right to take the
market fee from the woman. The policeman said that
the clerk of the market was busy aud had directed him
to collect the teus. Mayor Anderson then dismissed
the case and told an officer to see tlie clerk aud Inquire
into the matter.
A man named Murphy was charged with vending
goods without a license, contrary to ordinance. The
officer testified that he found him with a shawl and
an oil cloth table cover, offering them for sale
and when he asked him if he had a license, the accused
replied that it was • ‘ none of his d—d business,
ben arrested him. Richard had been befere His
Honor once before, aud on his promise te leave the
city was let off, and the Mayor asked him why he had
not gone. He said that his friends (naming several of
them and assuring His Honor that he was
acquainted with them) were about raising funds to
send him to New York, and that he thought he might
sell these artieles to procure some money for his im
mediate wants; but if he would only let him go this
time ho would be sure to leave town immediately and
never be seen in court again. His Honor having no
faith in his protestations, ordered him to be confined
for thirty days in jail.
A man named Roberts was arraigned on the charge
of being a deserter from the revenue cutter Nanse
mond. He said that he was not a deserter; that he had
been discharged some two months since and had been
running on one of the boats in the river; that ha had
a mothar and family to support in South Carolina; and
that his father had been killed at the battle of Chieka-
rnauga, and ho was the only support of the family.
Ilia Honor ordered him to be held until the arrival of
the cutter and then to be handed over to tile officers.
A man named Robinson was charged with driving a
wagon through tlie rows of trees on South Broad
street, said wagon having no badge an it. His Honor
fined the defendant three dollars for driving between
the trees and ordered an officer to enquire into the
fact of the wagon being without a badge.
Tl»c Case of Tow.
The case of Henry Tow, who recently shot and
killed a man named Oluue, and was acquitted by the
verdict of the coroner’s jury but subsequently re
arrested by the military authorities, will be brought
up for examination before His Honor Mayor Anderson
this morning. Shortly after the second arrest of Tow,
Mayor Anderson, iu au interview with Col. Kimball,
commanding the District, expressed a desire to he
permitted to bring him to trial by the proper civil au
thorities through the usual course of proceedings.
Upon communicating by telegraph with Gen. Bran-
nan at Augusta, Col. Kimball was instructed to turn
the prisoner over to the civil authorities. Col. Kim
ball at once notified Mayor Andersou that the person
of Tow would be given iuto his custody at such time
as he migh appoint, iu response to which His Honor
addressed to Col. Kimball the following letter:

Col. Wm. K. Kimball, Commanding, *vc.,
Colonel : Yours of this date is at hand, consenting
to turn over to the civil authorities for trial of one
Henry Tow, for tlie offence of murder. The alleged
offence having been committed in Savannah, the only
civil tribunal having jurisdiction is the Superior Court
of Chatham county, the next session of which will
commence ou the Second Monday in May, but by the
code of Georgia the Mayor of Savauuah is vested with
the powers of a justice of tho peace, within the city,
to suppress riots, etc., arrest, confine, or bind over
offenders against the laws of the State, to answer for
such offences before the proper tribunal. With your
permission, I suggest that Tow be turned over to the
-Mayor for examination on Saturday morning next, 17th
lust., at eleven o'clock, when the proper course for
bringing the ease to a speedy trial can be determined.
It shall be my business to see that the prosecution is
carried on. I need hurdly assure you that the citizens
of Savannah are indignant at the conduct of Tow. and
are by no means disposed to screen what so far seems
to them to have been a great outrage committed by
bim; or to say that it would be a source of mortifica
tion to them if it be for a moment supposed that the
civil authority is not disposed aud ready to vindicate
the laws of peace and good order.

promptitude and energy which he lias displayed in
providing for the meteing out of justice by the civil
authorities and the vindication of peace and order in

Railways in certain streets of the city of Savuun h
Sec. 1. Be it ordained by the Mayor and Aldermiuu
of the City of Savannah In Connell Assembled, afflf
it is hereby ordained by the stulinrity of the same
That there is hereby granted to Wm. Ebliitt, Joint
Condntt Smith, and Chas. 11. Philips, and such oilier
persons as may hereafter become associated with
them, and to their executors, administrators a i„i

side tracks aud switches, in atn or all of the follow
ing streets in said city, to-wit: Bay street with its

William or New street to tlie Canal, East Broad street
with the Thunderbolt road to the present and future

limits of the cily. Also East Broad street with a)
the necessary or desirable exchanges or intersections'
as the said Incorporators or railway company may
determine; Provided, nevertheless, that no track
shall pass through any of ilic public squares, aud no
double track be laid in astreet-less than one hun
dred (100) feet .wide; tnd provided, also, that ir the

pump in any of Us operations, that said company
shall at its own expense establish another well anil

aforesaid, That the carriages to be used on said rail
ways shall be of the best style, with all modern iui-
proveraetits, and shall be drawn by horses or mules,
the City Council reserving the right to limit the use of
said raUways within the corporate limits or the city
to the transportation of passengers and their ordi
nary baggage.
Sec. 3. And be it further ordained by the authority
aforesaid. That the City Council may deteimine the
rate of speed at which s .id oars or carriages nniy
be ran, provided that said railway company shall not
be required to run any railway enrorenmage at any
time when the ordinary demand lor passage In the
same would not be sufficient to remuaetate said
company for running the same ; and provided, also,
that tlie City Council sliuil uot restrict the running
of such number of cars or carriages at a reasonable
rate of speed, as said company may think proper.
Sec. 4. And be it furlher ordained by the authority
aforesaid, That the said railways are to be construct
ed and operated as aforesaid on such grade as .-hall
be established and constructed for all the streets of
the city, which said grade shall not, during ihe con
tinuance of said railways, lie altered or changed at
the cost or to tlie damage of said company ; and the
said streets may be, in the first place, plauked at
least twenty-loar (24) feet widp in the centre, on
which said railways are cons’ructed by and at the
expense of said company, provided always that said
company shall be required to pave, macadamize or
otherwise improve the said twenty-four (-24) feet,
when the city shall cause the remaining portions of
said streets corresponding with and opposite thereto
to be so paved, macadamized onotherwlseimprovtd.
Ana ail the monies expended by the city for the im
provements, grading or planking cf either of thes id
streets of benefit or value to ihe said company, for
the object anil purposes in this ordinance and con
tract contained between the time of the passage
hereof, aud the completion of the said lailways shall
be refunded to the city by the company.
Sec. 6. And be it further ordained by the authority
aforesaid, That tlie track of Raid railway shall not be
elevated above the surface or the streets, and shall
he laid with tlieO. G. rail, or sucludher Improved rail
as the company may prefer, arid shall be so laid that
carriages aud oilier vehicles can easily mid freely
cross said tracks at any and all points thereof with
the least possible olistrnction.
Sec. 6. And be it further ordained by the authority
aforesaid, That the rates of rule for any distance
within uuc mile shall uot exceed ten fill) cents, aud
wilhiu the limits of the city over one mile oil anyone
line of railway shall not exceed twenty (20j cents for
each passenger.
Sec. 7. And be it further ordained by the authority
aforesaid. That the rights aud privileges hereby
granted to said company shall be forfeited to the city,
unless the construction of one ur mure of said rail
ways shall be commenced within one veal* from the
passage of this ordinance, aud so much of all the
routes aforesaid as shall uot be fully eompleled u ith-
in teu years from the pass ,ge thereof shall be loi fl-it-
to the city unless the City Council shall extend the
time, and in cose any or either of said routes, or any
pari thereof -hall lie ali.iiidoued by the parties afore
said ail improvements except the iron rails up >n such
tracks or routes or so much thereof as shall be aban
doned shall be forfeited to tlie city.
Sec. 8. And be it further ordained by the authority
aforesaid, That if the said p ti tles or company shall
hereafter become incorporated under or by any act
of tlie Legislature or otherwise as by law directed,
the rights ami privileges granted by virtue of this
ordinance, shall extend to such corporation tor the
time, and upon the conditions herein prescribed.and
when such act of incorporation shall have been ob
tained such corporation according lo terms then of
shall have all the r.glus aud privileges hereby grant

Sec. 9. And he it further ordainod by the authority

name, kind and description, used in the construction

tenances in and about tlie same, in the maimer aud
ou the terms following, that is lo say—said ordinance
shall fix the time wlieu Uie City Council will purchase
and take said railways and other property, appurien-
apees before mentioned, which shall not tie less than
six months nor more than twelve nmnllis alter the
Passage of said ordinance, ami at t lie-time of^ pur-
etiasuig and taking said railway aqd other pro|H*ny
and appurtenances above'Mentioned, the City Coun
cil shall pay to the parties owning and operating the
same a sum of money, the amount of Which shall be
ascertained by computing tlie Interest atBix per cen
tum for one year on each sum or amount as is to be
paid as the purchase money, so that such Interest
shall amount to a sum equal to the earniugs oi said
railways for tl«e year next preceding the time when
the City Council shall purchase, take and pay for the
same.
Sec 10. Aud he it further ordained by the aatliorily
aforesaid, Tiiat this ordinance shall not impair or tn
any manner interfere with the sewerage or water
works of the city or tlie gas light company, but tiiat
tlie rights aud priv ileges hereby grained are subject
thereto.

aforesaid, That tlie said William Ebbilt, John Con
duit Smith aud Chnrles B Philips shall enter iuto an
agreement with the 3$id City Council, to he executed
by them and the Mayor oracling Mayor or the city of
Savannah, and countersigned by the Clerk of the city
Council under ils’corporate eeal, obliging the said
William Ebbilt, John Conduit Smith ami Charles B.
Philips, their associates and assigns of the one part
and the Cily Connell of tlie other part, to abide by
aud perform the. stipulations herein contained re
spectively, which agreement when so executed shall
be obligatory upon both parties as aforesaid in every
particular, and until snch agreement or contract
shall be executed this Ordinance shall have no force
or effect
