Brunswick bind Company, on the lGth-dny of
October, 1836, made and executed a certain
Mortgage Deed to the said James Fort and Ste
phen C. King, in and to all those tracts of Land
which lying aud being on Turtle River in the
County and State aforesaid, adioving the town
common of Brunswick, containing five tlinttsniid
six hundred aud forty acres, more or less, with
tho exception oftwo acres of Pine Land given by
James Fort, on which tract a house of^ worship
called the Chanel, situate about five miles from
Brunswick, said tracts belli* more particularly
described, and bounded as follows, viz: Two
tracts ofsnul land adjoining nnd containing to-
gather by resnrvey three hundred nnd uinnty-fivo
acres, more or less, granted on the 6th January,
1767, to Henrv Lawrons, including two hundred
acres surveyed for Robort Savage and now form
ing a part ol snid tracts, bounded at the timn of
survey southerly by laud reserved for Uie public
service known as the Brunswick Common, north
erly hy other lends ordered to the said Henry
Lnwrcns, and on all other sides by inarsh and va
cant lands; and the other of said tracts bounded
northwest part by land of Jacob Helvcsline. (or
Helvestnn) and part by vacant Intids, southerly
hy other lands ordered the said Henry Law re ns,
and on nil other sides by marsh and vacant lands;
both of which said tracts hnvo such forms and
marks, natural and artificial, as nre expressed and
delineated on the plats annexed to snid grants.
One other tract of said land granted on the second
day of September, 1766, to Jacob IYelvestine,
containing according to the original survey, four
hundred acres, by resurvey four hundred and six
ty acres, more or less, hounded nt the time ofaur-
vcy on nil sides hy vnrnnt lands, but now south
erly by the above described tract; one other tract
of sain lands called the Peacock tract, containing
originally five hundred acres, and by resurvey
five hundrod nnd seventy-five acres, purchased at
Sheriffs sale hy James Fort on tho I4th day cf
January, 1622, sold ns the property of A. D.

payment of five promissory notes made hy C. W.
Cartwright, President of said Brunswick Land
Company to the said James Fortaud Stephen C.
King, for the stmt of six thousand dollars each,
amounting to thirty thousand dollars with inter
est from the 13th day of October, 1836, nt the rate
of eight per cent per annum, due in five years
from the date of said notes, (which is 13th Octo
ber, 1836) in five equal anuual instalments, and
that the principal on two of said notes amounting
to twelve thousand dollars, os well as tho interest
on twenty-four thousand dollars from Uie I3ih
October, 1637, are sttll due and unpaid to said
James Fort and Stephen C. King. On motion
of A. J. Besaent, plaintiff’s attoruoy, it is order
ed. thatihnsaid Brunswick Land Company, its
officers and meinhers.de within six months from
date hereof, pay into the said Court tho principal
and interest which may then be due on said notes
and mortgage with nil costs, or that in dufaitlt
thereof, the Equity of redemption of said Bruns
wick Land Company in nnd to the said mortgag
ed lands, from thnucbforth bo forever hound und
foreclosed; and it is further ordered that this rule
he published in ono of the Gazettes of Savannah
once a month for four months, or served on the
President, officers and member© of said Bruns
wick Land Company, or tho agent or nttorney
personally at Court three mouths previously to
the expiration of said six months.
