REMARKS.— Cotton*. — About 400 bales sca
is’antls have gone off iu the course of this week,
at prices within ihe range of our quotations.—
‘pile sales of Uplands nave hot beta large ; the
extreme prices art about the same as for the last
two or three weeks; but the middling qualities
mav be had at this moment upon rather more
favorable terms, than at any previous period of
. the season.

change since last week.” None of the primest

Corn— has been sold this Week, at all rates fr.
80 to 90 cents.
Groceries, £4c.—The business of the week in
most articles, has been very limited—sales con
fined pretty much to the consumption of the
town. Coffee sells by the tew bags at our
quotations. Sugars are very heavy, and it is dif
ficult to furnish a correct quotation. Molasses
is in rather better request. N. E. Ruth has ad
vanced a little in price since our last. Whiskey
steady at last week’s prices. Brandy, din, &c.
without variation.
Independence oj a Kentucky Judge.
(£/■ A committee of the House of Rep
resentatives, io the Legislature of Kentuck
y, on the 20th ultimo, made a very extra
ordinary report, upon the independent con
duct of James Clark one ol the Circuit
Judges, recommending that an address be
presented to Gov. Adair for his removal
from office. It requires two thirds of each
branch of the Legislature to pass this ad
dress.
The heinotis offence committed by Judge
Clark, was an opinion delivered by him,
that a law of that Commonwealth, author
izing the stay of certain executions, was
unconstitutional and void. It was pronoun
ced in the case of Williams vrßlair. The
Plantiflf had obtained Judgement against
the Defendant, who entered into a Recog
nizance with security under the said law,
by which he was allowed the period of two
years to pay the debt arid coses, units the
Plantin’ would agree to receive satisfaction,
in notes of the Bank of Kentucky. A mo
tion was made by the Plantitt’ to quash the
Recognizance, on the ground that the law,
violated both the Constitutions of tne Uni
ted States and of the Commonwealth of
Kentucky. The Judge considered that
the Act authorising the stay of the Execu
tion •‘impaired, the obligation of contracts
and was therefore void, under the aforesaid
Constitutions.—and declared further, that
the said law also violated the 10th Sec.
and Ist Art. of the Constitution, declaring,
that the Legislature of a State has no pow
er to make anything a‘''legal tender in
payment of debts” bat gold and silver. The
Recognizance was ordered to be quashed,
and (he defendant to pay the costs on the
motion. The Committee of the House, in
their report, stigmatize the principles and
doctrines assumed in this opinion as “in
compatible with the constitutional powers
of the Legislative department, übversive
of the best interests of the people, calcula
ted to disturb the tranquility of the coun
try and to shake public confidence in those
measures of government, called for by
the condition and necessities of the peo
ple,”
The question before the Legislature was
ordered for argument on Monday the 29th
of M iy, Judge Clark was at Frankfort,
and would make his defence in writing.
We are happy to observe, that altlio* in the
House there will probably be a majority,
yet it wrll not be a legal majority, in favor
of the Address—and especially, that in the
Senate, there is a redeeming spirit, which
will save the Judge and the constitution,
unharmed from the ignited combustibles
of the popular branch.
Legislature of Mw-Hampshire.— On
Friday last, Gov. Bell transmitted a Mc-s
----age to both Houses of the Legislature. He
touches upon the three'branches of indus
try. Agriculture* Manufactures and Com
merce,and speaks of their progressive state
of advancement. The State Prison then
engages his attention and he thinks the
fact* in New-Hampshire in regard to it 9 up
on.itiaos, prove the Penitentiary system to
possess advantages over preceding modes
of punishment. -The greatest numbers of
convicts at any one time lta been 74, the
present number is 58. The whole expellee
of the establishment including the salary of
‘he Warden, after deducting the profits
derived from the labour of the convicts ha 9
been as follows : for the rear 1819, g 862

-21. 8232 89. The annual expence ot fur
nishing food and clotning to each convict
was for the year 1819, $49 15—for 1820,
S34 —for 1821,g23 20 cents. We shail

ted with this institution with the following
extract °
“ The maxim, that the certainty of pun
ishment ss more efficacious in the preven
tion us crimes than its severity, has com
irraruled the assent and belief of the execu
tive. Ihe power of remitting the punish
ment of convicts with which if is in vested,
ha 9 therefore been verv sparingly excci
sed. Within the last 3 years, only five
convicts have received a remission of any
part of their punishment. Three of these
labored under diseases believed to be in
curable, by the physician of the prison,
one was affected by mental derangement,
ami the remaining individual had conduc
ted in an unexceptionable manner, during
his residence in prison, and was pardoned
i ;ir the intercession of his aged father and
m helpless family.”— Bos. Gax.
