ments made on its efficacy, Dr. Berthelot now
confidently assures the public, that he-has in
vented a mixture which will most infallibly des
troy those unwelcome disturbers of our repose,

free from ungi ateful smell.
As Dr. B. is desirous that which he now offers

from the Medical Society of this city in relation j
to the act of the last Legislature for the sup-;
pression of Quackery be received and that the ,
same be published as is required by law, in all
[the Gazettes in this city.

AN ACT i
! To establish a tribunal to enquire into the qua’i-!
fications of persons claiming to practice \le- j
dicine, Surgery, Si midwifery, within t’ e city I
of Savannah, and to grant certificates to the
same if found properly qualifu and.
Whereas, it appears by a memorial of the j
j Mayor and Alileinicn of the city of Savannah,!
[that-the good people of the said city, and es- j
specially the pour & illiterate people thereof, have!
; suffered heretofore much evil from th. w ant of
proper laws to regulate the prac’ ice of medicine,
surgery, and midwifery therein, the conse
quence of which want had been the indisc. iniin
ate and arrogant pretensions and undertakings
of manv unlearned and emnirical persons to
practice therein in the said arts: And whereas,
sound policy and a proper regard for the healths ;
and lives of tlie citizens of a commercial, popu
lous, and'growing city, require that tlie Icgisla
ture should guard against such au evil for the
future.-
§ I. Beit therefore enacted by the senate ar.d
house of representatives of the state of Geor
gia in general assembly met, and it is Iterebv
enacted by the authority of the same. That tlie
Georgia Medical Society established in the city
of Savannah shallbe invested with and pos
essed of full power and authority to examine,
inquire into, invest-gate, and determine on th
professional qualifications, attainments, and ca
pacities of all ar.de ve.ry person orpersons claim
ing to prac l ice within tlu limits ■ ftbe said city the
said arts of medicine, sir gery and midwifery,
orinany two or one of them, and to giant certifi
cates of qualification under the common ‘ seal
of the saia society, or, if there be no common
seal, undej the signs mamtel of their presi
dent and secretary, to him, her,’ or them so
claiming and making application therefor, if,
by a majority of said society, lie, she or they
shall be ih’irtned'duly'learned and qualified And
it shall be the duty of the members • f the said
society,’when application shall be made bv any
person or persons for his, Tier, or ‘heir examina
tion to the end aforesaid, to convene at their
i ustomary place of meeting, and to decide
upon the applicant’s petition, within ten dais
after they shall have been summoned to convene
by their ’'resident, or in his absence, sickness
or other mablity, by the person or persons dis
charging liis duties, > r if there be not any such
person or persons, after they shall have beensum
monedby their secret- ry And it shall be ’he
dutv of the said president, person or persons
performing his duties, or secretary, to summon
each and every member of the sajd society, bv a
written citation, expressing the object ofthe
meeting, the name or names of the applicant
nr applicants, ar.d the day < f the examination,
within ten days after the application shall have
teen made to him or them: Provided always,
that prior to the examination of any and every
applicant, the members of the said society shall
severally take a solemn oath, to be administered
by the mayor or any alderman of the city of Sa
vannah. well, truly, and impartially to examine
and decide upon the attainments and qualifies-,
lions of the applicant or applicants, and t- . gram
certificates of qualification to him, her, or them,
if, in their judgments, he, she, or they sliaii be
found duly learned ind qualified, to practice in
the said arts of surgery, medicine, and midwife
ry, or in any Wvo or one of them: And provided
also, that in flieir examination the said society
shall he restricted and confined to the investiga
tion of professional attainments aud capacity
alone, without regard to an- former or present
professional or moral reputa'ion, and shall not at
any time require as a test of qualification, or any
di grre of evidence thereof, that any applicant
should have obtained a diploma from any medi
cal college or university, or should have studied
thereat, or elsewhere.
4 2 Arid be it further enacted by the authori
ty aforesaid, That if, after application shall have
been made, agreeably to the provisions of this
ac*, the President of said society, or other per
son or per ons, performing his duties, or there
being no such person or persons, if the secreta
ry of said society shall refuse, or shall delay till
after the time heretofore prescribed to issue
summons for convening the members, or if he
or they shall appoint a day lor their conveing
the members, or if he or they shall appoint a
day for their convening more remote Ilian the
tenth d*y from the day of the date of the cita
tion, the per-s in or persons ai -plying may sever,
ally institute an action or suit at law in t! e Su
perior or Inferior courts of the county of Chat
bam, against the said President, or person or
persons performing his duties, nr against the
ecre'ary to recover damages against him or
them, in his or their individual capacities, for his
or their refusal or delay, or improper appoint
ment And if after being summoned to coin ene,
the said society shall fail to d'; so on the day ap
pointed in the citation or afterwards on an ad
journed day. but a day within the time hereto
fore prescribe,! for their convening, or if, hav
ing convened, they shall severally fail to take
the oath aforesaid, or having, taken such oath,
shall fail to proceed to the examiation afore
said, and to a decision thereupon or if the said
society shall n any respect violate the provis
ions of this act, it shall be the duty of the Judge
of the Superior court of the county ot Chat
ham, upon the petition of the party injured,
setting forth any such failure or violation and
support edbyhis affidavit oftlie truth of such peti
tion, to grant as a matter of rig ht, a writ of scire
facias, directed to the president and members
of said society requiring them to shew cause 1
at the next term of Ihe said court, why their 1
charter or act of incorporation should not he
deemed forfeited. A copy of this and of the
petition shall he served upon the president or
secretary, and if the allegations be denied, an
issue shall be joined, and the facts be tried by
a jury empannelled and sworn as in other cases.
If the the petition be found to be
true, or if they be admitted, and no good cause
be shewn for the former failure or violation, it
alia l be the duly ot the court, upon application
of the'party injured, to appoint a day not more
remote than ten days, on which the society ahali
convene, and conform in every thing to the re
quirements of this act, and to the order for this
purpose no return shall be received from said
society but one of absolute compliance under
oath of the President or Secretary; which re
turn snail be filed in the clerk’s office within 5
days after the appointed day. On failure to
make such return, the Judge of said court shall,
in vacation, aw'ard a judgment of forfeiture
of the charter, upon application as aforesaid; and

There are few so ignorant as not to know
that a work like this, if even tolerably execut*
ed. must possess extrinsic value. The compil
ation of this book is alluw-ed bv competent jud
ges, to be performed in a very masterly man
ner ; and the well known character of tlie gen
tleman whose name it bears, forbids the idea
of any deficiency of industry or talent, in exe*
culing the important service confided to him by
the legislature.
It is believed that every man who can con*
venienlly buy this work ought to possess it, be*
cause it behooves every citizen to have some
knowledge of the laws ofhis country. Theo
pinion expressed by Blackstone is certainjy
correct, that “As every man is interested in
the preservation of the laws, it is incumbent
upon every man to be acquainted with those
at least, wiln which lie is immediately concern*
ed ; lest he incur the censure as well as incon
venience, of living in society, without knowing
the obligations which it lays him under”
