tioned, or any such articles bo found to con*
•mute part of the oargo, you will take all nec-
•saary aad proper means to provsat the de
parture of the vessel, and to detain the same
in your custody until all such articles shall be
removed therefrom, and for further proceed
ings according to law. You will also make a
careful examination of all flat boats and other
water craft without niaoilesis, and of railroad
c.irs, and other vehicles, arriving at or leav
ing your port, laden with merchandise, the
ultimate destination of which you have good
reasoo to believe is for any port or place un
der insurreotioaary control ; and if arms, mu
nitions of wsr, provisions or other supplies
are found haviug such destination, you will
seise and detain the same to await the proper
legal proceedings for confiscation or forfeit
ure. ' 1
In carrying out these instructions, you will
bear in mind that all persons or parties in arm
cd insurrection against the Union, however,
■ueb persons or parlies may be organized or
named. Are ougsged in levyiog war against
the Uuited Slates; and that all persons furn
ishiog to such insurgents arms, munitions of
war, provisions, or other supplies, are giving
thorn aid and oomfort, and so guilty of treason
within the terms of the second aeotion of the
third article of the Constitution. And you
will therefore use your utmost vigilance, and
eudeavor to prevent the prohibited shipments,
and to detect and bring to punishment all who
are in any way concerned in furnishing to
such insurgents any of ibe articles above de
scribed. You will, however, on the other
hand, be oareful not to interrupt vexatiously,
or beyond necessity, by unwarranted or pro
tracted detentions and examinations, the reg
uiar and lawful commerce of your port. You
will report forthwith whether any, and if any
wbat additional measures may be necessary
in your judgement to carry into full effect the
foregoing resolutions, and yon will report to
this department from lime to time your action
under these instructions.
