And be it further enacted, That there shall be levied, collected end paid, on each aud every non-enumerated article which bears asimilitude, either in material, quality, text ure, or the uses to which it may be applied, to any enumerated article*chargeable with duty, the same rate of duty whica ia levied and charged on tho enumerated article by the fora- going schedules which it moat resembles in auy of tho particulars before mentioned; aad if any non-enumerated article equally resem bles two or more enumerated articles on which different rates of duty are chargeable, there shall he levied, collected and paid on such nou-euumerated article, the same rate of duty as is chargeable on the article whioh it resem bles paying the highest duty. Amd be it further enacted, That on the sutry of any goods, wares, or merchandise, im ported on or after the 31st dev of August afore said, the decision of the Collector of the Cus toms at the port of importation and antry, at to their liability to duty or exemption there from, shall be final and oonolusive against ths owuer, importer, consignee, or sgent of sny such goods, wares snd merchandise, unlees the owner, importer, consignee or agent shall, within ten days after suoh entry, give notice te the collector, ia writing, of his distatisfaction with such decision, setting forth therein dis tinctly snd specially his ground of objection thereto, snd shall, within thirty days after date of such decision, appeal thsrefrom to th* Secretary of the Treasury, whose decision on such appeal shall be final and oonolusive; snd the said goods, wares and merchaadioe shall ha liable to duty or exemption therefrom ae- cordiugiy, any Act of Congress to the oontrary notwithstanding, unless suit shall be brought within thirty days after such decision, tor sny dutiss that may have been paid, or may there after be paid, on said goods, or within thirty days after the duties shall hav* bean j>ald ia esses where suoh goods shall be in bend.
