Present, the Hon. O. A. Bull, Judge of. said Court
I T appearing to the Court, l.y the petition of William
Barnes, that cn the first day of May, in the year cl our
Lord eightt en hundred and sixty-one.* Clark Bcpg .rly. of
said county, mad0 and delivered to said Barnes twelve
promissory notes for fifiy i 7Ion each, aud one lor ten dol
lars, all duo ono day after date: and'that afterwards, on
the thirty-first day of May in said year, to secure the pay
ment of said instruments, executed and delivered to said
Barm s, ycur petitioner, his deed of mortgage, whereby he
conveyed to him city lot one hundred and twenty, on land
lot fifty-two. in the fourteenth district of originally Henry,
now Fulton county, bounded north by the southern limit
of the right of way of the Georgia Railroad, and running
back two hundred feet, containing one-half acre, more~or
less—conditioned that if said Clark Boggerly should pay
off and discharge said promissory notes according to their
tenor and effect, that then said deed of mortgage i-nd said
notes should be void.
And it further appearing that said promissory notes re
train unpaid, it is therefore ordered that said Clark Beg-
gerly pay into this Court, by the first day of the next term
thereof the principal, interest and cost due cn said pro
missory notes, or show cause to the contrary, if there bo
any; and that cn failure of said Clark Bcggerly so to do,
the equity of redemption in and to said mortgaged pre
mises be forever thereafter barred and foreclosed.
And it is further ordered, that this rule ho published in
the Sc-nihcrn Confederacy, cncc a month for four mouth”,
or a copy thereof served on the said Cla:k Beggerly, orh 3
sperial agent cr attorney, at To.yst three months before the
next term of this Court.
