Barnes, that on the first day of May, in the year of our
ford eighteen hundid and siaty-one, Cioik Beggoriy, of
ooid County, made and delivered to said Barnes twelve
uonassory notes for fifty dcllara each, and one for ten dol
ars,all due one day alter date; and that afterwards; on
the thirty-first day of May in said year, to secure the pay
ment of said instruments, executed and delivered to said
Barnes, your petitioner, his deed of mortgage, whereby he
conveyed to him city lot one hundred and twenty, on land
lot fifty-two, in the fourteenth district cf originally Henry,
cow Fulton county, bounded north by tho southern limit *
of the right of way of the Georgia Rhilrcad, and running
back two hundred feet, containing one-half acre, mere or
less—conditioned that if said Clark Beggarly should pay
off and discharge said promissory notes according to tfc»ir
tenerand effect, that then said deed rf mortgage tri said
notes should be vein.
Ann it furthc-r appearing that said promissory notes re
main unpaid, it is therefore ordered that said Clark Beg-
gerly pay into this C ourt, by the first day cf the next term
thereof the principal, interest ani cost due oa said pro
missory’ cotes, c.r show causa to the contrary, if there be
any: ar.d that on failure of said Clark Beggerly so to do,
the equity of redemption in and to said mortgaged pre
mises te forever thereafter tarred and foreclosed!
And it is further ordered, that this rule he published in
the Southern Confederacy, once a month for four months,
or a copy thereof served ou the said Claik Beggarly, or his
special agent or attorney, at least three mcnth3 tefcr« the
next term of this Court. «
