Bo it ordained by the people of the State
of Alabama in Convention assembled, That
ail ibe official acts of ac.ing puDiic officer*
of tins State, and all judgments, orders
and decrees of the several Courts of ibis
t3tate and of the Justices of the Peace,
and of the Courts of County Commission
ers upon then faoe had, done and per
formed, or ordered to be done, under color
of law and iu pursuauco thereof, and all
tbe aete, and sales of executors, adminis
tratoru, trustees, and guardiaus, and of
indioialand ministerial officers, had, done
and performed, and made in pursuance of
and under color of law, since the 11th
day of January, 1861, which ara not in
conflict with the Constitution of the Uni
ted States or the Constitution of this State,
be and the same are hereby ratified and
confirmed, subject, however, to the right
of appeal ana supercedure, according to
law. Provided, that in all cases in waich
judgments, or decrees, have been rendered
in all courts of record of this State since
llth day of January, 1861, and prior to
this date, the party against, whom suoh
judgment has been rendered sha'l be en
titled to a nsw trial, on affidavit that he
was unavoidably absent from tho Court at
the time of the rendition of the judgment,
aud that ho had no attorney present in
the court. Provided, thß court shall be
satisfied, from ail the facts whish way be

that such good and meritorious defense ex

Be it further enacted, That all deeds,
bonds, mortgages, or other contracts in
writing or otherwise, made since the 11th
day of January, 1861, shall have the same
force and effect, at if made under the law
and prior to ths 11th day of January,
1861, and shall be valid and binding in
all the courts of this State, as if made
under th® law and prior to the llih day
of January 1861.
Be it further ordained, That in all pur
suits upon oontraots, made between tho
Ist of September, 1861, aud the Ist of
M»y, 1866, parol evidence, shall be admis
sible to prove what was the consideration
thereof, end whether or not the parties
thereto, understood or agreed, that tbe
same should he discharged by a payment
in Confederate ourranoy or treasury notes,
aud if so, or if It appears so from the con
tract, then to show what was the real and
true value of the consideration of the eaid
coutraot, and what amount the plaintiff
is legally, justly and equitably entitled to
recover acoording to the oontraot by the
Judgment of said court.
Be it further ordained, That exeoutors,
admii istrators, guardians, and trustees,
shall have the power and they are hereby
authorized to agree and compromise with
those against whom they held any claims
or evidences of debt, created sinoe the
Ist day of September, 1861, which were
oantruotei with reference to a payment
m Confederate money or aiiy other cur
rency, and receive in payment or die
charge thereof in par funds, or what wae
the true and fair value of the property or
other considnration of the Baid claim.

race for the stake of $2,000, and the
championship of Amerioa, between the
Biglow brothers of this oity, and tho

won by the Wards, in 32 minutes and 69

gress authorizing the 10-40 loan, fixed
the limit at two huudrad millions of dol
lers, but tha Secretary of the Treasuary
finding that it interfered with the taking
of the 5 per cent loan, discontinued It,
wnen one hundred and eeventy millions
were taken. There ia a growing proba*
bility that the remaining twenty-seven
millions will shortly be put upon the
market.
ALL EBTTRRN MUST BE STAMPED.
The Poßtoffioe Department has issued a
oiroular giving notice that the penalties
filed by law for carrying letters outside
tbe mails, when not enclosed in a govern
ment stamped envelope, will bo rigidly
eaforoed in every instanoe where viola
tions are known, to exclude only letters
relating to cargo and freight of water
orafts, or other vehicles employed upon
mail routes, may be lawfully carried not
enolosed as above. By the terms of this
order, unpaid letters for delivery and
those prepaid by psmtage stamps, oannot
be carried outekte thfe mail by auy*of
these conveyances, without subjecting the
captain, owners, drivers or otoer em
ployees to a penalty of $l6O for eaoh of
fence.
CONFISCATED LANDS IN VIRGINIA.
The first session sinoe the close of the
war, of the United States District Court,
Judge CJnderwood, presiding, convened
to-day in Alexandria, Virginia. The
District Attorney, L H. Chandley, made
a very eloquent and forcible speeoh, urg
ing upon the Court a liberal policy in
treating the large cumber of ooufisoation
oases upon the docket. The Judge, be
fore adjournment, made the following
decision, and ordered that in all cases
where pardons have been granted and
the amnesty oath has been taken, save as
to those under the President’s proclama
tion, suits tor property under the oontls
oatiou law be dismissed upon payment of
costs. A large number of citizens inter
ested under this ruling were present iu
Court, aad many came forward aud paid

Washington, dept, 26.—The Wiiz mili
tary commission re-assembled to-day

amined for the government.
Dr. Win Marsh testified that he had
been employed as agent of the sanitary
commission for tbe dtates of Georgia,
Florida, ana the Carolines, from January,
1862, to the close of the wav. Witness
sent from Beaufort large supplies of
olothiog, such as shirts, drawers, panta
loons aud hats. Also, condensed milk
and coffee, and other articles of food Toe
arrangements for sending relief to pris
oners was made with Geu Bam Junes, ac
cording to which the goods wero passed
over to the agent of the Confederate gov
eminent.
In June, 1864, there was suffsring at
Acdereonvilie, as esoaped prisoners gave
information. Witness had no evidence
that the goods were reoeived by the pris
oners. An order was received from Wash
ington not to send any more euppliea.
After the goods passed from the hands of
the sanitary oommission they went into
the hands of the Confederal® agents.
Judge Advocate Chipman put in evidenoe,
a letter of Wirz, dated Andersouville,
Nov. 12, 1864, addressed to Catft. Neely,
Assistant Quartermaster, in which the
writer acknowledges the reoeipt of eigh
teen packages of clothing, five bales of
blankets, one box of sheets, four boxes
pants, three boxes drawees, socks aud
shirts, and that he should distribute them
without delay.
