therein dated, relative to the elertton ot At

the dep ditioo of Major Brown differs in form
fn»m what I related, and whit I had been
informed was the fubftauce of his teltimwuy ;
yet, in mV opinion, this piece of evidence as
it now appears, falls far fhnft of eftablithing
that Alderman’s citizeulhip, and I ake rhe
liberty of obfervingi that the reason of my
having somewhat miftahert'ih thatrefpertibuit
appear to be, what I have before fuggefteo,
the deposition having been taken I t\ private,
and without notice to the oppofers Os the
election. If they had been permitted to be
present, on his examination, they would na
turally have required of him, upon what parti
cular circumstances he founded this .declara
tion ot his “ belief and knowledge ,” as ex
pressed in the affidavit, and if this had
been the case, there can be no doubt but
that he would have aligned the fame rdafon
whjch he had frequently fuggefied previous
