contain above one hundred acres, which
(hall be drawn for in the manner pointed
onr by this Aft.

See. 4. And be it further evaded by
the authority aforefaid % That the refpeft-
Jvc Surveyors (hall give bond in the pe
nalty of ten thousand dollars, with such
fecuriry as the Governor, or a majority
<jf the Jufticcs of the Inferior Courts of
the refpeftive counties, where the said
flirveyops may reside, which bond (hall
be taken by the Gbvernor or the afore
faid Jufticcs, and deposited m the Exe
cutive Office, (ball approve of, for the
faithful difeharge of (be trust reposed in,
and duties required of them by this aft.
See. And he it further ettafled by
the authority aforefaidy That it (hall be
the duty of the Surveyors appointed in
pursuance of this Aft, to make the fur
proper person ; to mark or cause to he
marked plainly and diftinftly upon trees,
if prafticable otherwise (lakes may fuffice,
nil lines which it may be required of them
to ran for the purpose of making the sur
veys in their refpeftive diftrifts immedi
ately after the boundary line (hall have
been run by the proper authority, and to
cajufe all such lines to be measured with
the utmost pofiible exaftnefs, with a half
containing two perches of fixtecn
feet and one half each, confiding of fifty
equal links ; which shall he adjufied by
\ (landard to be kept for that purpose in
the Surveyor General's Office ; to fake
as accurately as possible the meanders of
all water courses which shall form natural
boundaries to any of the surveys, and of
all navigable rivers whereby any of such
surveys may happen to be divided; to
note in field-books to be kept by them
iefpeftiv£ly, the names of the corner and
other station trees, which (hall be mark
ed and numbered in such manner as the
Surveyor General (hall direst ; also all
rivers, creeks, and other water courses,
which may be touched upon or eroded
in running and measuring any of the lines
uforefaid ; tranferipts of w hich field
books, after being examined with the
originals, by the Surveyor General, and
certified and signed on every page by the
J)i(lrift Surveyors returning the fame,
shall be deposited in the Surveyor Gene
tab’s Office, there to be reserved as a re
cord ; to make a return to the Surveyor
General in ninety days after the running
the boundary line as aforefaid of a map of
the dill rift to which they may refpeftively
be appointed, in which (hall be correftly
delineated, represented and numbered,
jo such order as the Surveyor General
hall prefcribeall the furveye within such
dlftrift ; and also to return ar the fame
time a detached plat of every such fiirvey
oi land, certified and signed by them,
which plats (hall be filed among the other
records In the Surveyor General’s Office,
and from which copies (hall be made to
be annexed to grants ; and to conform to
such indruftions as they may receive
f irom the Surveyor General from time to
time during their continuance in office,
and prog refs in the duties thereof not
rpilitating with this aft.
Sec. 6. And be it farther evafled by
ihe authority aforefaid , That the survey

three hundred dollars* whereof the Go
vernor is requeued to ilfue his warrant
on the Treafurer,'in favor of each and ''
every Surveyor, immediately after their
entering into bond and security as afore-
Cud, to enable them to proceed without
delays to the. execution, of their duties,
for the balance of which by this law they '
may be entitled ; they fliall .receive a
warrant in like manner,, pn proefucingho
his Excellency the Governor, a certifi
cate from the Surveyor Geieral setting
forth that fucli Surveyor has completed
tiie duties alligned him, and made his
returns conformably to this aft.
Sec. 7. And be it further ennSied by
the authority aforefaid , That the Sur
veyor General or Dillrift Surveyor, or
Surveyors, who may be employed in di
viding the said territory into counties
and diftrifts, (hall receive the fame com
pensation for each mile run and surveyed,
as is allowed by this law for other Sur
veyors, out of which all expences inci
dent thereto, mull be paid without any
additional charge on the (late, and his
Excellency the Governor is requested to
grant his warrant on the Treasurer, for
compensating that service, so soon as he
(hall be advised by the Surveyor General
of its completion.
Sec 8. And be it further- enabled h\

manner following, to wit: after the sur
veying is completed and the returns made
to the Surveyor General, his Excellency
the Governor, (hall cause tickets to be
made out wherebv all the numbers of the
surveys in the different diftrifts, (hall be
represented, w hich tickets (hall be put
into a box to constitute prizes, with o
thers to be denominated blanks, of w hich
blanks the number or amount (hall he de
termined, by fubtrafting the number of
prizes, from the whole number of draws,
to which the said lottery shall be fubjeft
upon the following principles : that is to
fay—Every free male white person twen
ty one years of age and upwards, being a
citizen of the United States, and an in
habitant of this (btc. twelve months
iiuiiicuiatcly precculng of tne paliage of
this ad, or paid a tax towards the sup
port of government (.including such as
may be absent on lawful bufmefc) (hall
be entitled to one draw : Every free
white male person of like defeription hav
ing a wife, legitimate child or children
under twenty-one years of age, shall be
entitled to two draw's ; and all widows,
having legitimate child or children under
tire age of twenty-one years, who have re
dded twelve months in this (late imme
diately preceding the paflage of this aft,
(hall be entitled to two draws j and all
families of legitimate orphans, under
twenty-one years of age, having no pa
rents living, (hail be entitled to one
draw.
Sec. 9. Aud be it further cnadltd by
the authority aforefaid y That lifts of per
sons entitled to draw, in conformity to
the provisions of this aft, (hall be taken
and made out within three months from
the paftage thereof, by any three or more
of the Justices of the Inferior Courts of
the reipeftive counties, or such fit and
proper persons as they may appoint, not
exceeding one for each county, who (hall
previous to their entering on the duties
of their appointments, severally enter
into bond and security to be approved by
the said Justices, in such rcafonable sum
as they may deem ncceffary, for the faith
ful discharge of the trad reposed in them,
and also take and fubfenbe an oath in
writing faithfully to perform the duties
required of them by this aft.. And it
(hall be the duty of the said Justices, or
any three or more of them, or such per.
sons as they may appoint, to attend at
the court-houses of the refpeftive coun
ties, on as many several days as the find
Justices may deem ncceffary,' and appoint
for the purpose of taking and making out
fiich lifts, giving at lead ten days previ
ous notice of such attendance by

places in the refpefttve counties—and the
names of all persons entitled to draw with

Sec. to. And be it further enabled by
the authority aforefaid, That immediate
ly after the return by the Diftrift Survey
ors, and the JuSiccs. of the inferior courts;
his Excellency the Governor be author
ifed, and he hereby is required, to cause
fair lifts to be made and arranged in al
phabetical order, of the persons entitled
to draw, and cause the lottery to be car
ried into efteft conformably to the pro
visions contained in this aft, under the
fuperintendancy of five managers, or a
majority of them ; to be appointed by
the Legiftature, who shall apportion the
blanks and prizes, in the manner afore
faid, and give one month’s public notice
in all the Gazettes of iiic state, previous
to the conamcneement of the (!rawing,
and (hall set forth in fucK notification,
the days of drawing for the names enroll
ed under the letter A ; the days of draw
ing for the names enrolled under the let
ter B, and so on throughout the alphabet,
commencing the drawing with the names
belonging to the firft lettey.
Sec. 11, And be it further enabled by
the authority aforefaid, That all persons
against whole names, lands may be drawn
in pursuance of this aft, (hall be entitled
to receive grants, which (hall be iflfued
under the hand of his Excellency the Go
vernor, and the Great Seal of the State,
on application of the fortunate drawers
refpeftively,. who (hall have complied
with the requifinons of this aft, and be
ing applicable to them, their refpeftive
heirs or devifees, investing in them fee, -
simple titles, to the particular survey or
surveys of lands drawn against then
names refpeftively, by paying into the
treafurv of this state, within three months
dred acres for river land, ot the firft qua
lity—seven dollars per hundred acres
for river land of the fccond quality—
—seven dollars per hundred acres for
high land of the firft quality,—four dol
lars per hundred acres for high land of
the second quality—two dollars per hun
dred acres tor all third quality land—and
fifty cents per hundred acres for all pine
land ; and that prices (hall be affixed to
said lands, in the following manner, viz.
All river land, of the firft quality, at
one dollar per acre—All river land of
the fccond quality, at fifty cents per acre
—All upland of the firft quality at fifty
cents per acre—Ail upland ot the second
quality at twenty-five cents per acre—
All upland of the third quality at twelve
and an half Cfints per acre—and all pine
land at fix and a quarter cents per acre ;
which (hall be paid by the following in
stallments, viz. One third of the price
of the refpeftive trafts,. on or before the
expiration of three years, to be comput
ed from the firft payment; and one third
annally thereafter, until the whole price
of the land is difeharged, before the
said fortunate drawers shall receive a grant
for the fame ; and in case of failure in
any of the aforefaid payments, the said
lands (hall revert to, and be veiled in the
state. Provided nevertheless, That the
said fortunate drawers (hall be at liberty
to pay up the whole amount at any time
before the expiration of five years, and
(hall be entiled to receive a grant immedi
ately on so doing.
Sec. 12. And be it further enabled,
by the authority aforefaid*, That no con
trast for the conveyance and sale of tick
ets in the lottery aforefaid, previous to ob
taining grants therefori (hall be binding •
or obligatory on either of the con crafting
parties, their heirs, executors, admini- -
ftrators, aflfgns or devifees, in any court
of law or equity in this state.
See, 13. And be it further enaSed
by the authority aforefaid , That where
' vacancies may happen by death, refigna

Sec. And be tt further tnafid
by the authority That for the
purpose of afeertaining the different qua
lities of lands to be laid off andfuivey
ed in pursuance of this aft, the surveyor
of each diftrift lhall employ one difereet
person, qualified to judge of the value of
lands, whose duty it {hall he to attend
such surveyor, and explore each and eve
ry Purvey of land in the progrefsof lay
ing them off, and report the quality there
of, under oath, to the surveyor, who
lhaii note the fame in his field boose r for
which service, the persons performing
the fame shall receive fifty cents for eve
ry {Purvey by them explored, to be paid
out of the treasury of this ftatet
Sec. 16. And be tt further enabled by
the authority aforefaid, That immediate
agreeably to this aft, five Commissioners,,
to be appointed by the Legislature, (hall y
at the most eligible and suitable place, at
or near the head of the navigation on the
* South fide of the Oconee river, lay out
a traft of land, containing three ihoufand
two hundred and forty acres, or sixteen
of the aforementioned trafts of two hun,
deed two and an half acres each, as laid
off by the Diftrift Surveyors, which ia
hereby reserved and set a part, for a town
to be called and known by the name of
MILLEDGEVILLE, and shall, on such
part ai they may deem most proper, lay
off loss containing one acre each, and
(hall lay a plat of the-laid traft of land,
together with a plan of the town, before
the next General Affembiy, and fuck
number of lots shall be disposed of as they
may deem expedient.
Sec, in. And whereat it may so hap
pen, that pcifons may have Purveyed lands
in the aforefaid cession, contrary to law,
and on which grants may have ifhed.—
Be it therefore maided by the authority
aforefaid , That ail such Purveys or grants,
are hereby declared to be null and void,
to all intents and purposes, as though
the fame had never been made or issued ;
nor stall any Purvey or grant, for lards
in the aforefaid cession, be admitted to a
jury as evidence ot title to the lands/m
this aft deferibed, except those obtained
by virtue, and under the authority of
this aft, any law to the contrary not
withstanding,
