States,
At the Second Session, begun and held at
the City of Washington, in the Ter
ritory of Columbia, on Monday, the
sixth of December, one thousand eight
hundred and two.

AN ACT more effectually to provide for
the organization of the militia of the
d jirtii of Columbia,
Sec. 7. And be it further enafied.
That the President of the United States,
upon complaint of mifeonduft lodged
with the department ol war, in writing,
by any one or more coinmiflioned officers,
may at his diferetion caufc to be arrelled
any major-general or brigad’.cr-general,
and order a court-martial, 10 be compet
ed of ail the other general officers, field
officers and captains, or so many ot them
(having regard to seniority) as (hall a
mounc to thirteen, in the niilbia of the
territory ; which court martial shall pro
ceed in the fame way, and under the
fame reftriftions, as is hereafter provided
for the trial of field officers. And any
major-general or brigadier-general, for
mifeonduft within their own knowledge,
or upon complaint lodged in writing, by
any commissioned officer, shall have pow
er to arrest any lieutenant colonel com
mandant, aid-de-camp, brigade inspec
tor, and major, or any other inferior offi
cer ; and the commanding officer of the
divifton or brigade, (hall order a court
martial, for the trial of such lieutenant
colonel commandant aid-de-camp, bri
gade infpedor, to be composed of one
brigadier-general, and as lieute
nant colonel commandants, majors and
captains, as (hall make up a numoer not
less than thirteen ; and such courts mar
tial shall proceed to hear and determine
on all offences under this aft, and may
cenfurc or cafhicr such officer ; which len
ience (hall be final, when approved by
the president of the United States. And
any brigadier general, lieutenant colonel
commandant or major, for mifeonduft m
any captain or subaltern, within his own
knowledge, or upon complaint lodged in
writing, by any commissioned officer,
may arrest such captain or subaltern;
and the brigadier or commanding officer
of the brigade shall order a brigade
court martial, for the trial of such cap
tain or subaltern, to be composed of one
or more field officers, and a lufficient num
ber of captains and subalterns to make
up a number not less than thirteen ; and
such courts martial shall proceed to hear
and detetmine on all offences under this
aft, and may censure or calhier any offi
cer so tried ; which fen fence shall be ft
nai, when approved by the prefulent ot t he
United States. And for obtaining the
necessary evidences for the trials afore
faid, the president of the United States,
or the presiding officer of the court mar
tial (as the case may. be) shall iffuc his
summonses ; and every perlon so summon
ed, failing to attend and give evidences,
shall be fobjeft to, and may be tried by
a court martial, and if an officer, may
at the diferetioa ot a coart martial, be
uafiutred or Sped, not exceeding 6 months

son not enrolled, to be reported to the
court of enquiry of the regiment or le
gion to which he £hali belong, or with
in whose bounds he (hall refulc, and be
thenfubjed to such fines and penalties as
they may think proper to inflid, not ex
ceeding forty dollars.
Sec. 8. And be it further enabled,
That there (hall be battalion courts of
enquiry, to be appointed by the com
manding officer of the battalion, for the
aflclfment of fines incurred under this
ad, in such battalion, and such courts of
enquiry (ball be held in the months of
May, August and November, in each
year, at fotnc convenient place within the
county, to conlift of ch<* commanding ol
ficer of- tiic batralbn, and the command
ing officers of companies, which fliall
belong, or to be attached to such hatta
lion, or a majority of them, who fliall
take the following oath, to be admini
stered by the preliding officer, and af
terwards by another officer of the court
to him i will truly and
faithlully enquire into all delinquencies
which appear on the returns, to be laid
before me, and will afl'efs the fines
thereon, as shall seem just, without
favor, partiality or affedion —so help
me God.” The presiding officer (hall
then lay before the said court, all the
delinquencies, as direded by law, where
upon they lhall proceed to hear and de
termine. And there shall, moreover,
be legionary courts of enquiry, for the
aifelfinent of fines incurred by the officers
of the legion, and for other duties re
quired by this ad; such courts of en
quiry shall be held by the appointment of
the commanding officer of the legion, in
not less than ten, and not more than
twenty days, after the battalion courts of
enquiry in every year, and moreover, one
legionary court extraordinary, fliall be
in like manner appointed and held, dur
ing the month of March in the present
year, for the purpose of appointing the
company musters of the year, and for
appointing a clerk, provost martial, and
colledor, as hereinafter direded, and for
other duties by this ad preferibed, the
said legionary courts of enquiry to confiit
of the commanding officers of the legion,
battalions and companies, ora majority
of them, who (hall take an oath in man
ner and form as preferibed above; the
commanding officer of the legion shall
then lay before the said court all delin
quencies direded by law, whereupon they
mail proceed to hear ami determine. It
fliall be the duty of the presiding officer
of every such court of enquiry, to re
turn to the next legionary court of en
quiry, all delinquent officers failing to
attend the preceding court, to be proceed,
ed against according to law. The legi
onary court of enquiry may, for good
cause (hewn, remit any fine imposed by
the battalion court, last preceding; the
said court may alio exempt any militia
man from duty on account of bodily infir
mity and may again dired such person to
be enrolled when able to do duty.
Sec 9. And be it further enafled ,
That the refpedive legionary courts of
enquiry, fliall annually appoint by ballot,
a clerk and provost marshal, who (hall
attend the courts herein before direded to
be held ; the clerk shall keep 3 fair re
cord of the proceedings of such courts,
asalfoof the rafter returned by the feve
rai captains or commanding officers of
companies, for regular rotinc of duty,
and (hail make out for the colledor a fair
lift of all the fines aifeiTed by the legion
ary -and battalion courts, and one other
lift which shall be retained by the clerk,
on which Hft the colledor’s receipt shall
be taken ; the said lifts fliall be made out
and delivered to the colledor in fifteen
days after each legionary couit of enqui
ry, and (hall perfor? ail other duties

Sec. to. And be it further ennfled t
That all fines incurred under the aft of
congress, pafled at their lad fefiion, em
powering the president to organize the
militia of the didrift of Columbia, and
not then returned to the officers thereby
authorised to collect the fame, (hall be
returned to the full legionary court of en
quiry which ihall be held in the respec
tive counties, to be by them proceeded
with as in the case of fines by this aft
alic-lled.
Sec, ti. And be it further enaJlti t
That there Ihall be a mutter of each troop
of cavalry and company of militia, com
prehending the companies made up by vo
luntary enrollment, once in every month*
except the months of January, February,
March, May, Oftober and December*
in each year, to be appointed by the rc
fpeftive legionary courts of enquiry, at
Inch places as may be deemed rood con
venient within the county, and that the
time and place for the mullets aforefaid,
ihall be fixed by the firlt legionary court
ot enquiry which is held next after the
palling of this aft, fubjeft rofuch changes
as future legionary court* of enquiry may
think proper; and there shall be a muder
for cxercife and infpeftion of each batta*
hon, in the month ot May in every year,
to be appointed by the commanding offi
cer of the brigade to which such batta
lions refpeftivdy belong, at such place®
as he may think proper within the coun

year, to be appointed by the commanding
officer of the brigade to which such legi*
on belongs, at such place as he may
think mod convenient within the legion
ary dillrift ; which said company, bat
talion and legionary mnilers, ihall con
tinue one day and no longer ; the time
and place of such legionary, company and
battalion muders, ihall be notified to the
commanding officers of legions, thirty
days previous thereto; the commanding
officers of legions ihall give notice to the
commanding officers of battalions, of
such brigade legionary companies and bat
talion mutters, at lead twenty days ; the
commanding officers of battalions, to the
commanding officers of companies at least
fifteen days; and the commanding offi
cers of companies to their fergants, at
lead ten days, and the fergeams to each
person in his company, at lead three day#
before such musters, refpeftivdy ; the no,
tices to be given by the commanding of,
heers of brigades, legions and battalions,
and companies, ihall be in writing, de
livered to each person to be notified, or
left at his usual place of abode, and eve
ry sergeant failing to give notice agreea
bly to the orders of the commanding of
ficer of his company, to each person
therein, shall forfeit and pay for each and
every offence five dollars, to be adeifed
and recovered as other fines imposed by
this aft; neverthelcfs, all notices pub
licly given by the commanding officers of
companies, at their refpeftive muders of
any subsequent muder, (hall be held and
deemed as legal notice, as to all persons
present at such muders. Every officer
and foidier ihall appear at his refpeftive
muder field, on the day appointed by ten
o'clock in the forenoon, armed and equip
ped. At every muder, the commanding
officer of the company ihall caufie his roll
to be called, and shall examine every
person belonging thereto, and note down
all delinquencies accruing therein, and
(hall perfor.ally infpeft the arms, am
munition and accoutrements, of all on
dcr his command, and make accurate re
turn of the whoh thereof, to the com
manding officer of his battalion in five
