wc detail the news we promised them, in
itead of conienjing it, and we promise them
that further details arc yet to come.
In our last, we mentioned that a murder
had been committed in Wilkes county.—
The name of the person murdered is John
Barclay, who lived within eight miles of
Washington —his wife, fulpeftcd to have
been concerned in the coufpiracy, with two
men, have teen taken up, and are now
Judged in thtjaii of laid county.,
At the late sale in Millcdgcville, 75 lots
fold for 31,650 dollars.

The following is the fentenccof the Court
Martial, after four days trial, that
I « The Court are of o[)inion, that the con
' <juft of admiral Sir Robert Calder was not
the refillt of fear or cowardice, but of error
in Judgment, for which he deserves to be
f*verely reprimanded, and is hereby severely
reprimanded accordingly.”
On account of the favors of our adver

We present as a grievance the vague man
ner in which a law has been passed to dif
po& of the fraftional parts of the surveys
of land in a treaty held with the creek na
tion of Indians at or near Fort-Wilkinson,
in the year 1802, and we recommend the
Cbmmiflioners, who being authorized to dis
pose of said land, to poll pone the sale until
the meeting of the next Legiflaturc.
We present as a grievance that there is so
little attention paid to the patrole law. W e
recommend it.in the ftriAcft terms that the
field officers should be more diligent in enfor
cing the aforefaid law.
The Grand Jury recognize with peculiar
fatisfafihin—The fevers), important and in
ttrefting dbjefts recommended to their at
tention in the elegant and patriotic charge
delivered to them by his honor the Judge, at
the opening of the present term---Having at
tended, wc hope, with candor and impar
tiality to thofc fubjefts which ordinalily oc
cupy the attention of Grand Jurors, wc
take the liberty of exprefiing in the strongest
terms, our approbation ot the statements
conveyed in the charge—-That there is a ne
cessity of the revision of our criminal code of
laws, and wc present it as a public or go
vernmental grievance tha,t this revision has
been delayed so long.
The Grand Jury are fully impressed wiih
the belief that punifhraent is thought to be
naturally and ncceflarily attached to guilt,
as the performance of conditioni arc attach
ed to a covenant; that the rigor and ncccf
fity of all social laws and regulations arise
from the vice and depravity of mankind,
and therefore, that it is the cerrainty, and
not the extent of the penalty, which gj ves
them dignity, validity hud refpcftability.
With the fame firmnefs we believe that the
degree of punifhraent inflicted, ought to be
apportioned to the degree of guilt ccntra&ed,
as minutely aud exactly as human wisdom
can aflbeiate ; that this is one of the firft die
laics of right reason, one of the fixed and
i mmu table principles of moral teftitude; when
therefore, a great punishment is attached to
a final] crime, or a finali punishment to a
; great crime, this is at once a violation of
the invariable rule, of right and wrong, and
this violation folcmnly fanftioned by the
stamp of civil authority. We have often
fecn with regret the truth of this bright cb
fetvatibn; that laws too sanguinary, defeat
their ownpurpofe. The humanity, of either
witnefles or of Jurors, or finally, of the
executive is excited, and thereby, the cul
prit goes unpunished, or clfe if he is puniih
ed, it is for more than the demerit of his of
fence'requires; in either case, jufticc, which
is the leading objeft in all civil and muni
cipal la ws, is, in some meafurc, set a fide
and disregarded;
Under these impreflions we recommend to
our Senators and Reprcfentatives in the gen.
eral Affcmbly of this state, to use their ut
most endedvor to procure a law providing
for the revifal of our criminal cede, and for
correcting the abnfes and impropiieties
which have ciept, into it, either by the
infiitution of a penitentiary, or by what o.
tiler mode may appear most completely to

of the grand jury, whereupon it was order
ed that so much thereof as contains matter
of criminal proftcutionbe referred to the so
licitor General, and that the presentments
refpefting the disposition of the Fractional
parts of thefurveys of the late ceded lands,
and refpeCiing the revision of our criminal
code, be referred to the Legislature, and that
a copy of these two presentments be furnilh
ed the Senators and Reprcfentatives of this
county, previous to the next general a ffera-.
bly ; and it is further ordered, that the pre
ferments be publilhed as soon as pofilble in
the Augusta Chronicle, —conformable
to thcrequeft of the Grand Jury.

they were presented was, being confined to
the hufinefs of the court, prevented my giv
ing the ncceffary information to the Grand
Jury, of their obtaining licence before they
had made up their preferments.
