In all cases the plaintiff shall hove the
first strike. Each paanel of tho Petit
Jury shall fake the oath prescribed
for special juries in section 3655 of thu
new Code -, and Grand Jurors shall
take the oath contained in section 3847
of the same Code: Provided, That
the Judge may in his discretion have
special juries selected from the Grand
JI qry in the maner heretofore presorib-
cd by law for the purposo of trying
issues in civil casos.
Sec. 7. lie it enacted, That if any
person ejiall bo drawn as a juror, and
duly summoned to appear as such at
court; or if anypersou shall be sum
moned asaTalcB Juror, aud shall neg
lect or refuso to appear; or if any ju
ror shall absent himself without leavu
of tho Court, then aud in that evont
it shall bo lawful for the Court to fine
such persou in a sum of not more than
forty dollars.
SecI 8. Be it further enacted, that
wlien from challenge or from any oth
er cause, there is not a sufficient num
ber of persons in attendance to com
plete tho pannel ot the Grand Jurors,
or either pannel of Pettit Jurors, thu
Court may order tho Sheriff or his
deputy to summon persons qualified as
hereinbefore required, sutneiont to
comploto tho pannel. And when tho
Sheriff or his deputy is disqualified to
summon talesmen as aforesaid, then
they may bo summoned by the Coro-
nor, or such other person as the Court
may appoint.
Sec. 9 Be it also enacted, That on
the trial of criminal offences, less than
felonies, the Solicitor and the accused
may select eilboi pannel cf tho Petit
Jury to try the case. But in tho
eveut the Solicitor aud ilia accused
oannot agree upon a pannel, then the
Court shall haie a pannel made up of
tho twenty-four Petit Jurors in attend
anoc, of which thu acoused shall haru
the right to challenge seven peromp-
torilly, aik. tho State five. The re
maining twelve shall constitute the
Jury.
Sec. 10 Be it also enacted, That
when auv person ahull stand indicted
for any offence which, upon convio-
tion, may subject him to tho punish
ment ot death, or to imprisonment in
the Penitentiary,it shall bo tho duty
of the Court to have empanneled forty
eight Jurors, twenty-four of whom
shall be taken from the two pannels of
Petit Jurors, from which to select the
jury for the trial of such offence, and
in tho event the jury cannot be mudo
civil and oriminal, in accordance with
the Constitution aud existing laws of
this State, and sllsnoh tales jnrora as
may be necessary from time to time to
oomplete said juries; and that the
venire bo made returnable to the ap
proaching term of the said Court, or to
such day ot the term as the Jndge
may direct, provided that eaoh regular
Juror so drawn shall bo summoned at
teast two days before tho term of said
Court, or the day. appointed by the
Judge; and that all verdiqta and
other sots done by such. Jurdra shall
be lawful and regular to all intents
and purposes: Provided that this sec
tion shall not bo construed to be in
conflict with the fiitteenth Section;
and tho J udgos of said Courts, in their
discretion, may avail themselves of
the provisions-of either of tho said
scotions. And bo it fiirther provided,
that the provisions ofthis seetion shall
not be ot foroe for thu holding of any
Court whose term may commence
after the first of June next.
Sec 18 All laws and parts ot laws
oanflioting with this Act are hereby

Sec. 12 Be it also enacted. That the
Ordinary, Clerk of the Superior Courts
and three Commissioners in tho ditter-
ther enacted. That ent counties of this State, shall.meet at
