A.try Intorcitlxf. cue, wiring uniior a
qno* warranto information, was heard before
Ula Honor, Judge Clark, on Tuesday last, du
ring the reoent aeealon of the Superior Court
for this county. As the decision of the Court
be a matter of general interest to many
bents In various parts of the State,
ing bona fide commissions;to the wewjy
* offices of Notary’*' Public and
offiele J, P., we publish a brief synopsis of
tho fhota that appeared in the trial.
The Information was filed in tho V.auio of
tho Solicitor General, ex-rel. P. B. Lippitt,
against A. J. Mncnrlhjrand Wm. Oliver, to
know by what authority they exercised the
offices of Notary Publio and ex-*offioio Justice
of the Peaoe for this particular District,
appeared that oaoh one of the parlies held a
valid commission from his Excellency, (he
Governor, to the office of Notary Public for
Dougherty county generally-—Lippltt's being
the eldest. That Lippitt had likewise re
telved a letter fiom the Secretary of the Ex
ooutivo Department shortly after the reoelpt
of his commission, which stated that he was
at liberty to select ony District he chosed in
whioh to act, and that Lippitt had accord*
ingly made selection of this District. Each
of the other claimants being residents, did
Ukewise. and Mac&rlhy in addition, took the
precaution to bo sworu in specially for this
District. It did not appear, however, that
tho above triumvirate were altogether as
harmonius in their aotion or their decisions
as might have been desirable, and showed
conclusively that there might be too uiuoh of
a good thing crowded into one small District,
e*tn q{ law. And as each quo claimed
r ight to negative the proceedings of the
others, on the ground that they were mere in
truders on Am jurisdictional domain, it soon
became evident that proceeding miyhI become
necessary to preserve the peace, e/en among
the conservators thereof themselves. To ob
viate such a calamity, the above proceeding
was instituted. After a patient and thorough
nvestigation of the case, his Honor, Judge
Mark, decided that Lippitt, having tho elds
ent commission, was legally entitled to the
office, and that tho other commissions were
null and void, a decision, which, if entirely
correct, will no doubt vacate a number of
ommissious in the State.
The case wove argued by Col. Joseph Arm
strong lor relator Lippitt, and by Gen. Wl ight
and D. II. 1‘opo for the respondents.

SnniousLY—Wo ask every aflliotcd man,
woman nnd child in this community to read
and seriously ponder the high evidenc^of-
fered in behalf of Darby’s Prophylactic Fluid
by the proprietors. These evidences will be
found in our advertising columns, and are
given by some of the-best men that this or
arty other Stato can afford.—In the summer
of 1807, we saw an arm that had been shot
almoit info frogmtnta, saved from amputation
for more lhau one month by its use. Tho el
bow joint was so badly fractured that had
tho bono been put in n mortar nnd crushed
with a heavy pcstlo it could scarce have pre
sented a worse appearance.—Aud this arm,
in this condition, was Bavcd by this fluid
from amputation for more than a month in
the midst of tho warmest season of this warm
climate; and had a euro been possible it
would no doubt have been effected.—If any
one doubts this statement, the witnesses are
at band to establish it.—Marion, Ala., Com•
